CA Now Has Two Black LGBT State Supreme Court Justices!

LGBT History was made this week with the retention election of California State Supreme Court justice Martin Jenkins on November 8 and the approval of Kelli Evans to join the state's highest court by the Committee on Judicial Appointments on November 10. Jenkins, 69, was nominated to the California Supreme Court in October 2020 by Governor Gavin Newsom. Evans, 54, was nominated to the court by Newson in August 2022. The California State Supreme Court now has seven members and is amazingly diverse:

• Carol Corrigan, 74, white female
• Kelli Evans, 54, African-American lesbian woman
• Joshua Groban, 49, white mam
• Patricia Guerrero, 50 Latina/Hispanic woman
• Martin Jenkins, 69, African-American gay man
• Leondra Kruger, 46, African-American woman
• Goodwin Liu, 52, Chinese-American man

The court is majority women, majority people of color (one-third Black) and two-sevenths LGBT!

Guerrero is the brand-new Chief Justice of the State of California. Guerrero, Jenkins, Groban and Liu were all successfully retained in the November 8 election.

08/08/19: Married 11 Years Today!

Although we have been boyfriends since 1991 and living together since 1994, domestic partners since 1999, and civilly united (in Vermont) since 2000, we were only married in California on August 8, 2008 (Roger Federer's 27th birthday!) before Proposition 8 passed and after the California Supreme Court legalized marriage equality in the Golden State with the In Re Marriage Cases decision and upheld my marriage (and 18,000 others!) in Strauss v. Horton.

POLL: Support For Death Penalty Hits New Low In California

California Governor Gavin Newsom made headlines a few weeks ago when he announced a moratorium on the death penalty in the state along with the dismantling of the death chamber in San Quentin. Since California voters have rejected ballot measures twice in the last decade (and as recently as November 2016) to end the state's death penalty the media characterized the move as "thwarting" the will of the populace. However, new polling shows that Gov. Newsom may be more in line with public opinion in California than expected. According to the Public Policy Institute of California's March 2019 poll, voters approve of mandatory life without parole to the death penalty by a 58% to 38% margin, and when you expand to include all Californians (not just voters) support for the death penalty falls to 31%. The only  demographic group where support for the death penalty has increased is Republicans, with support at 64% while Democrats are at 21% and Independents at 36%. Thank Zeus we have so few Republicans in Deep Blue California their share of the electorate is low and falling and their impact on public policy is negligible!

GODLESS WEDNESDAY: Let Reason Prevail...

The Freedom from Religion Foundation is making banners available this holiday to combat the overwhelming religiosity of the occasion. One of these appeared in San Diego's Balboa Park next to a nativity display The banner reads:

 “There are no gods, no devils, no angels, no heaven or hell. 
 There is only our natural world.
 Religion is but a myth & superstition that hardens hearts & enslaves minds.”

For lots of people, seeing such thoughts expressed in public may seem shocking or disrespectful but from my perspective as a godless person this reaction demonstrates how prous the wall between the church and the state have become.

CELEBRITY FRIDAY: Eric Bauman, Openly Gay Chair of CA Democratic Party, Resigns In #MeToo Furor

Eric Bauman, longtime chair of the Los Angeles County Democratic Party and former vice-chair of the California Democratic Party under John Burton, was elected chair of the California Democratic Party in 2017 after a close and hotly contested election with Kimberly Ellis. He is the first openly gay man to lead the largest Democratic Party state organization.

This week Bauman was in the news again because he abruptly announced his intention to resign his position as party chair one day after multiple accusations of improper sexual comments and unwanted physical contact by Bauman were documented in a blockbuster Los Angeles Times story published on Wednesday November 28.

After the article came out Governor-elect Gavin Newsom and openly LGBT Senate President Pro Tem Toni Atkins were among the high ranking state Democratic politicians who called for Bauman's resignation.

I have known Bauman for years (and been to the annual holiday party at his house multiple times). I never witnessed any unwanted sexual comments but I would say that I have definitely seen him "tipsy." (It was a holiday party, after all!) Initially after word of the accusations were raised last week, Bauman had announced he would take a leave of absence to get treatment for "a problem with alcohol" but soon it became clear that in the current #MeToo era that response would be insufficient. I am somewhat surprised that these accusations of imroper behavior did not come to light last year when the internecine battle between the establishment party folks who backed Bauman and the progressive "Bernie-crat" folks who backed Ellis was raging.

Ricardo Lara Becomes 1st LGBT Individual Elected Statewide In California

Ricardo Lara has been declared the winner of the California Insurance Commissioner race, defeating former Republican (and current Independent) Steve Poizner. Lara is an openly LGBT state Senator and as of today he leads Poizner 52%-48% (or 400,000 votes) with nearly 10 million votes tabulated:

Lara becomes the first openly LGBT individual elected statewide in California!

CELEBRITY FRIDAY: London Breed Elected First Black Female Mayor of San Francisco

London Breed will become the first African-American female mayor of San Francisco when her main rival for the position, openly gay former State Senator Mark Leno conceded defeat. San Francisco is California's 4th largest city (behind Los Angeles, San Diego and San Jose) and the nation's 13th largest. Breed, 43, is the President of the Board of Supervisors and will become the only women of color to currently lead a major American city.

Breed will serve out the rest of Mayor Ed Lee's term (until January 2020) and has not said whether she will run for re-election in November 2019. It is worth noting that te next Governor of California is likely to be Gavin Newsom, who became known to voters as the Mayor of San Francisco. Breed will be the second woman to serve as Mayor; the first is Dianne Feinstein, who is now California's senior U.S. Senator.

GODLESS WEDNESDAY: Secular Coalition Announces Freethinking Caucus in Congress

The Secular Coalition for America announced that there is going to be a congressional caucus for "free-thinkers." The newly announced Congressional Freethought Congress even has a mission statement:

• First, to promote public policy on the basis of reason, science, and moral values;
• Second, to protect the secular character of our government by adhering to the strict constitutional principle of the separation of church and state;
• Third, to oppose discrimination against atheists, agnostics, humanists, seekers, and the nonreligious, and to champion the value of freedom of thought and conscience worldwide; and
• Fourth, to provide a forum for Members of Congress to discuss their moral frameworks, ethical values, and personal religious journeys.

Jerry McNerney (CA-9), the only member of congress with a PhD in mathematics, has agreed to be the co-chair of the Freethought Caucus. I am not sure who the other member of the Caucus is, but presumably that in addition to Jared Huffman (CA-2) they will be from another state other than California!

REPORT: 4.1% of U.S. American Adults Are LGBT, Totals 10M

The Williams Institute at UCLA has released another report on the demographics of adult LGBT population in the United States. They also have an interactive website where you can explore this data for yourself.

One key result is that there are well over 10 million LGBT adults in the United States, which is roughly 4.1% of the adult population. However, there is wide variation in the states in which the LGBT population resides. The District of Columbia has the highest percentage of its population self-reporting as LGBT:

SATURDAY POLITICS: Poll Shows Close CA-GOV Race Between Newsom and Villaraigosa

There is a recent PPIC poll on the June 2018 primary in California which demonstrates the current state of play in the race for governor (which is open due to term limits preventing 4-term Governor Jerry Brown from appearing on the ballot again) as well as the race for the United States Senate seat currently held by Diane Feinstein.

As in every public poll that has been released testing the California governor's race, Lieutenant Governor (and former San Francisco Mayor) Gavin Newsom is in the lead, with 23 percentage of respondents expressing a preference for him while former Los Angeles Mayor (and former California Assembly Speaker) Antonio Villaraigosa relatively close behind at 18 and State Treasurer and State Controller John Chiang far behind at 9 tied with the highest Republican contender John Cox. In June 2018 all gubernatorial candidates will appear on one ballot and the Top 2, regardless of party will advance to the November 2018 ballot.

In the Senate race it appears as if Senator Feinstein is well ahead of her challenger, State Senate head Kevin de León since she leads by a massive 45% to 21% with "Don't Know" at 33%.
However, as most political pundits know anytime an incumbent (especially one who has been in office since 1994(!)) is below 50%, they should be nervous. That being said it is very likely that again that the two top candidates will now will be the two top candidates in June and thus these races could last until November 2018. This is one of the main problems with state's Top 2 primary (which was put into place by a ballot measure championed by "centrist Republican" Abel Maldonado during the Schwarzenegger era of California politics in 2004). It's very possible California voters will have a chance to repeal the Top 2 Primary system in a November 2018 ballot measure.

SATURDAY POLITICS: Toni Atkins, 1st LGBT and Female CA Senate Leader

Toni Atkins, former Speaker of the California State Assembly, has been announced as the next leader of the California State Senate when current Senate president pro tem Kevin De Leon steps down in early 2018. When that happens Atkins will become the first woman and openly LGBT person to head the United States' largest state's upper legislative house.

De León, a Los Angeles Democrat who has served as Senate leader for nearly four years, is stepping down from the leadership position as he runs against Sen. Dianne Feinstein in the 2018 election for her seat in the U.S. Senate.

“Four years ago, our caucus elected the first Latino leader in over a century to lead the California state Senate — and, next year, Sen. Atkins will become our first ever woman to be elected Senate leader,” De León said in a statement. 

“Toni is a leader of great experience, achievement and integrity, and I have every confidence that she will lead America's most accomplished legislative chamber to even greater heights,” De León added. 

Atkins, 55, brings leadership experience to the job, having previously served as speaker of the state Assembly. She will be the third person to serve both as Assembly speaker and Senate president pro tem and the first leader of the state Senate who has come out as gay. 

“Today, I am humbled by the trust my colleagues have placed in me, and I intend to earn that trust every day by working tirelessly and inclusively to keep California a place of opportunity for everyone,” Atkins said in a statement.

#AD51: Carrillo Wins Assembly Seat Over Lopez 53-47 (900+ votes)

The special election in my Assembly District was held yesterday and the results are in: Wendy Carrillo, received approximately 1000 votes more than Luis Lopez in a very low turnout election (estimated to be 7.6%). Carrillo took an early large lead when absentee ballots were tallied.

This means that Carrillo will be the newest member of the Assembly.

SATURDAY POLITICS: #AD51 California Assembly District Race Heats Up!

I am a homeowner and voter in Northeast Los Angeles and thus the last year has involved participating in numerous elections (five lat last count). Due to the 2016 election which resulted in then-Attorney General Kamala Harris going to the U.S. Senate, my congressperson Xavier Becerra was appointed to replace her and then my Assemblyperson Jimmy Gomez won a special election to replace Becerra in the 34th Congressional District. Now we are just a few weeks away from the Tuesday December 5th election to replace Gomez in the Assembly.

The two candidates for the 51st Assembly district are Luis Lopez and Wendy Carrillo. Lopez has run for this seat before (losing to Gomez in 2012) and lived in the District for decades while Carrillo moved into the district when she ran unsuccessfully in the #CA34 special election.

Interestingly, despite the carpet-bagger concerns Carrillo has been endorsed by several Democratic Party establishment figures, including now-U.S. Rep. Gomez, California Senate Majority leader Kevin De Leon (who represents the area in the California Senate) and Jose Huizar who represents sections of the assembly district in the Los Angeles City Council.

As an openly gay man running for a state legislative seat, Lopez has been endorsed by several LGBT organizations (Equality California, HONOR Pac, the Victory Fund and the California LGBT Legislative Caucus).

Lopez and Carillo have faced off in multiple debates around the district. There doesn't appear to be any public polling in the race. I have already voted for my preferred candidate by mail. The election is Tuesday December 5th.

QUEER QUOTE: The entire Palm Springs City Council is LGBTQ!

The City of Palm Springs is Queer. Really, really queer! The Williams Institute at UCLA says that Palm Springs has the largest number of same-sex couples per capita in the state of California and is 3rd in the nation.

After last Tuesday's election, Palm Springs has another reason to be considered really queer. All 5 members of the City Council are members of the LGBT community (and Democrats!) Not even "Boystown, USA" (i.e. West Hollywood) has achieved that feat.

The five openly LGBT members of the City Council will be:

• Lisa Middleton*, transgender woman 

• Christy Holstege*, bisexual woman 

• Geoffrey Kors, gay man 

• Robert Moon, gay man 

• J.R. Roberts, gay man

Middleton and Holstege were just elected. The Los Angeles Times reported:

But now, the city is marking a new milestone in gay politics as well. When the two new members of the Palm Springs City Council are sworn in next month, every person on the panel will be a member of the LGBTQ community.

Lisa Middleton, a transgender woman, and Christy Holstege, a woman who identifies as bisexual, each won about 30% of the citywide vote to beat four other candidates and fill two vacant seats on the council. The pair will join three gay men on the five-person body.

Hmmmm, I haven't been to Palm Springs for awhile either. Time to make a trip!

QUEER QUOTE: California Enacts Law To Provide Nonbinary Gender Option In Official Documents

Wow! The state of California completed its 2017 legislative session recently and there are some fascinating new laws on the books thanks to Democratic supermajorities in both Houses and a Democratic governor in Jerry Brown.

One of the important bills Governor Brown signed into law was SB179, the Gender Recognition Act, which provides the option of "nonbinary" on official identity documents issued by the state of California which ask about the gender or sex of an individual.

USA Today reports:

The state of California will now legally recognize non-binary as a third gender on official state identification documents.  

Gov. Jerry Brown signed SB179 on Sunday night. The bill, dubbed the Gender Recognition Act, will allow a third gender choice on driver's licenses, state identification cards, and make it easier for people to change their gender and name on state identification papers.  

Non-binary, is a catch-all term for people who do not identify as exclusively male or female, and has been slowly acknowledged by some states as a gender option. 

In June, the District of Columbia followed Oregon's lead and began offering the gender-neutral choice of "X" on driver licenses and identification cards, and similar legislation is currently pending in New York.

The bill was authored by Senators Scott Wiener (D-San Francisco) and Toni Atkins (D-San Diego),  who are two of the many openly LGBT members of the Legislature. Equality California (an organization MadProfessah used to be a Board Member of) issued a statement on the occasion of the enactment of the bill into law.

SB 179 makes it easier for transgender, intersex and non-binary people to get official identification documents that accurately reflect their gender identity. In addition to recognizing a nonbinary gender, this bill streamlines the process to change the gender marker or name on state-issued identification documents. Previously, individuals faced difficult and burdensome obstacles to change their identification documents, such as requirements that a person obtain a physician’s verification or that they appear in court, which ultimately made the process intimidating and added expenses that an individual might not have. 

“Gov. Brown’s signature today has put California at the forefront of ensuring the dignity and safety of its transgender, non-binary and gender-non-conforming residents,” said Rick Zbur, executive director of Equality California. “When your ID doesn’t match your gender identity or expression, it can expose you to potentially dangerous situations. SB 179 eliminates unnecessary obstacles from the process of getting state-issued identification documents for thousands of Californians.” 

“With this simple change, California has made daily life infinitely safer and easier for many gender nonbinary and transgender people,” said Kris Hayashi, executive director of Transgender Law Center. “We’re asked for identification everywhere from banks to bars to airports, and it can be devastating and even dangerous for nonbinary and transgender people to navigate life with an I.D. that doesn’t reflect who they truly are.” 

According to a 2015 national survey of 25,000 transgender people, only 11 percent reported that all their identification documents had their name and gender that is consistent with their gender identity, and one-third of respondents who showed an ID with a gender marker that did not match their appearance reported being verbally harassed, denied services or assaulted.

CELEBRITY FRIDAY: Kevin de León Announces Challenge to Dianne Feinstein's Re-election Bid

Whoa! Kevin de León is my State Senator and is the head of the California State Senate. The 50-year-old Latino politician from Los Angeles is termed out of the legislature next year and many people have been wondering what higher office he would seek next. This week he announced that he is running to become a U.S. Senator from California. Currently, California's Senators are Dianne Feinstein (who was elected in 1992) and Kamala Harris, who was elected in 2016. Feinstein recently announced that she would be trying to win a 6th 6-year term in 2018.

de León has announced that he will try to stop that from happening.

Since both are Democrats and California has a top 2 primary it is very likely this race will not e decided in the primary, but almost certainly go the distance to November 2018.

SATURDAY POLITICS: #AD51 Runoff On 12/05/17 With Wendy Carrillo and Luis Lopez

The special election to replace now-Congressman Jimmy Gomez in the 51st Assembly District happened this Tuesday October 3 and the top 2 finishers were Wendy Carrillo (who had also run against Gomez in the special election in the 34th Congressional District) and Luis López. Carrillo received the most votes (4,771) in a crowded field of 13 candidates while López was second with 4,086 and Mike Fong was close behind with 3,515.

However, only the top 2 finishers advance to a run-off election to be held on Tuesday December 5. López has run for this seat before, way back in 2012 (against Gomez), while Carrillo is something of a perennial candidate in Northeast Los Angeles elections. López is openly gay and is a healthcare executive and was endorsed by various progressive democratic clubs (East Area Progressive Democrats and Stonewall Democrats) while Carrillo used to work for a local affiliate of Service Employees International Union, which ran an independent expenditure campaign that spent hundreds of thousands of dollars to support her.

This is my home district (and I voted) so I am following the race quite closely. It will be interesting to see who (if anyone) Gomez endorses as well as what the other candidates in the race do.

POLL: 12% Of California Voters Are #LGBT

Equality California has released a poll which shows that 12% of California voters identify as LGBT. Interestingly, this number varied only slightly by geographical region in the state, from 10% in the Los Angeles area (11% in Los Angeles county) to 14% in the San Francisco Bay Area.

The poll discusses the margin of error:

The survey’s margin of error is plus or minus 4 percentage points at a 95 percent confidence level. This means that 95 times out of 100, if a response to a given question to which all respondents answered was 50%, we could be 95% confident that the true percentage would fall within +/-4% of this percentage - or between 46% and 54%. As 12% of respondents in this survey answered “yes” when asked if they were a member of the LGBT community, we can infer that the sampling error specific to that response is +/- 2.4% or between 9.6% and 14.4%.

The poll's methodology of asking the question "Are you a member of the lesbian, gay, bisexual, and transgender community, also known as the LGBT community?" online may be an explanation for why they received such larger values than the more typical 2-4% number  that we have been more used to.

Saturday Politics: Race For CA-34 U.S. House Seat (Not Yet) Crowded

Cue the musical chairs! Last week California Governor Jerry Brown announced his intention to appoint U.S. Representative Xavier Becerra to replace U.S. Senator-elect Kamala Harris as California Attorney General. Becerra, 58, is currently my congressman, representing California's 34th congressional district; he would become the first Latino attorney general in the history of the state (in 2016!)

Becerra had been a rumored candidate in the race to replace Barbara Boxer that Kamala Harris ultimately won over another Latino candidate, Loretta Sanchez. Within hours of the announcement that a rare safely Democratic Los Angeles-area Congressional seat was open, former Speaker of the House John Perez announced his candidacy for the race. Soon after that, my state Assemblyman, Jimmie Gomez, also announced his intention to run for the seat. Activist Wendy Carillo has also declared she is interested. Surprisingly, my City Council person Jose Huizar has so far declined to enter the race to replace Becerra, as has fellow Councilperson Gil Cedillo. For the special election, you just need to be a resident of California (and a U.S. Citizen and over age 25).

Today comes the surprising news that Perez is withdrawing from the race, citing an unnamed health condition which is serious enough that it will prevent him from running a rigorous race in the 2017 special election, according to the Los Angeles Times.

Citing a recent diagnosis of a serious health problem, former California Assembly Speaker John A. Pérez said Saturday he is dropping out of the race to replace U.S. Rep. Xavier Becerra (D-Los Angeles).
"I've got to focus on my health right now," Pérez said in an interview. "But it was a very hard decision."
The 47-year-old Democrat declined to offer specifics about his condition, citing a desire to keep it private. But he said it was serious enough that it would keep him from waging a vigorous political campaign in 2017.
"The treatment is one that doesn’t lend itself to the intensity of a campaign that the community deserves," he said.

Almost certainly there will be other prominent (and not so prominent) Los Angeles area politicos joining the race. MadProfessah will keep you posted, since it is literally happening in my back yard!
