Fighting Over Dogs and Cats

Nowadays, many of us pet parents, consider our fur babies our children. There is nothing wrong with that, in my humble opinion. Except that the law considers them property not kids. Still, issues like divorce bring up similar considerations between spouses, what to do about the fur kids. Who gets to “keep” the fur kids? Will custody be shared? Can one party “keep” the fur baby and how often can the other party visit? Below an attorney, guest blogger, Charla Bradshaw, flushes out the issues more fully.

The American Academy of Matrimonial Lawyers conducted a poll of 1,500 members and nearly a quarter said they had noticed an increase in custody issues over pets. Courts have had to determine not only who gets the pet but whether one party has the right to see the pet after the marriage breaks up.  Identifying the best interests of the pet in a divorce case can safeguard that the pet is properly cared for after divorce.

Pets can provide unbelievable companionship and unconditional love for adults and children.  Animals such as dogs, cats and horses are considered personal property for divorce purposes and unfortunately can also be the subject of domestic violence.

In a divorce, pets must be awarded as part of the property division and therefore will usually go to one spouse or the other.  However, spouses can choose to co-own the pet going forward and create a visitation schedule for the pet.  We have done these orders and they actually work very well.  We also see pet schedules associated with a child’s visitation schedule where the pet goes with the child.  When spouses co-own a pet, going forward, we must provide provisions for the expenses related to the animal. This can be important when dealing with livestock, such as horses, or an animal that has health issues.

Since pets are considered personal property, there can be disputes over whether the pet is the separate property of one of the spouses or community property.  Separate property can be acquired by a gift, inheritance, or if the property was owned on the date of marriage.  Separate property cannot be divided by a court.  Spouses may argue over whether the pet was a “gift”, or whether the spouses bought the pet together, making the pet community property subject to being awarded to one spouse or the other.

Unfortunately, pets are often targets in family violence but Texas has come to the rescue.  Texas courts can now include pets in protective orders in domestic violence cases. Because pets have suffered abuse when family violence has occurred, in 2011 the Texas legislature amended the law to prohibit the removal of animals from the possession of a person named in the protective order.  In a protective order, the court may prohibit a party from removing a pet, companion animal, or assistance animal, as defined by Section 121.002 of the Human Resources Code, from the possession or actual or constructive care of a person named in the protective order.  The “actual or constructive care” verbiage was added in 2013.  In turn, in 2013, the Texas Penal Code was amended to specify what the possession of a pet, companion animal, or assistance animal by a person actually means.

So what do these protective order laws actually mean for pets?  They mean that a person subject to a protective order that violates a pet provision in the protective order can go to jail, plain and simple.  An abuser will often turn on a pet to cause pain and suffering not only to the pet, but to the perpetrator’s victim(s).  An abuser may also threaten a pet’s life in order to keep their victim(s) close.  As a result, a victim may stay in an abusive situation to keep the companionship of the pet, not realizing the court can make orders with regard to the pet.

One of the problems is that most facilities and shelters for those running from family violence are not equipped to take animals and therefore the animals are left behind. There is a growing need in this regard not only for the safety of the pet but because the unconditional love a pet can give may be lost at the time it is needed the most.

Divorce or abuse can actually take a toll on a pet.  The Humane Society of the United States sets forth the following signs of pet stress:

•    They become depressed

•    They sleep a lot

•    Their appetite lessens

•    They’re not interested in their walks or other daily activities

•    They start to cry or whimper

•    They groom, lick and/or bite themselves excessively

•    They have accidents in the home

The bottom line is that pets are often the subject of divorce and family violence and the laws are improving to protect them.  It is important for everyone to be aware of these laws especially so that abuse victims may realize the court can include a pet in a protective order.  Abuse is bad enough for the lives of those who suffer it, but losing or leaving behind a pet can only make the suffering worse.

Victims asking a court for a protective order should ask the court to make orders regarding their pet(s).  Additionally, spouses in a divorce should be aware that pet(s) are property.  Sadly, a pet may become the subject of a very expensive fight when the real issue is to cause pain to the other spouse.

This is the best butterscotch I’ve ever eaten. The candy gets its unique flavor from the ingredients from a recipe from Zeke’s mother, Old Wuss as she was called, who found it in a cookbook that was published in Chicago around 1860, way before imitation flavors were invented.   REAL butterscotch is made with real ingredients.  The main ingredients are Hawaiian pure cane sugar, butter, Grade AA Creamery Butter and lots of it and unsulphered molasses which gives Zeke’s Butterscotch its deep, rich flavor.  The apple cider vinegar in the candy creates a chemical reaction that softens the butterscotch when it is warmed – as in your mouth, and that’s when you’ll start drooling.  It has a very juicy, buttery flavor.  Two more minor but very important ingredients are water (pure and natural) and salt.

Americans love dogs but do we love women?  just throwing that out since it seems like some people who call themselves American are waging war on women. They also don’t seem to care that much about dogs, animals, the environment, other people either.

Romney’s pitch is that he’s Mr. Fix It — a corporate turnaround artist with an MBA. Looking for a candidate who’ll get the economy moving and put people back to work? Just so long as you overlook his only leadership experience in government and all the mass layoffs he orchestrated at his vulture-capital firm, Romney’s your guy.

What happens to that pitch if the economy improves, growth strengthens, and job creation picks up steam before the election? I don’t know. More importantly, I don’t think Romney knows, either.

Santorum’s pitch is altogether different. Whether the unemployment rate is 8.3% or 3.8%, Santorum is offering a message about culture, values, and religion. He doesn’t like contraception; he wants to restrict access to pornography; and a spirited defense of the separation of church and state makes him, in Santorum’s words, want to “vomit.”

As the former senator put it yesterday, “My campaign doesn’t hinge on unemployment rates and growth rates. It’s something more foundational that’s going on.”

Whether one finds Santorum’s agenda offensive or not, at least this is coherent and consistent. Unlike so many Republicans, he’s not rooting for bad economic news before the election, because the health of the economy is independent of his right-wing societal vision.

Learning compassion on the streets

for everyone, especially those in power, it should be mandatory to walk in another’s moccasins… furry paws and all… what would happen if shelter admins actually had to live for a night or a week in a hard damp cell, in a shelter with a concrete floor, no pillow, no blanket, all kinds of upsetting noises, many dogs crying, barking, whining, and little attention.  Double dog dare ya shelter employees to do this as an adventure/experience in LEARNING COMPASSION, growing a heart for the animals you are supposed to be servicing.

As many as 3.4 million Americans are likely to experience homelessness this year  a 35 percent increase since the recession started in December 2007  and a majority will be families with children.

And I commend these people in Tennessee for getting out of their comfort zone and experiencing life through another lens.

(Chattanooga)-What would happen if you were 18 years old, three months pregnant, from Chicago, and your boyfriend left you in Chattanooga, Tennessee, with $5 to your name? A small group of Dr. Lisa Muirhead’s nursing students at The University of Tennessee at Chattanooga embraced that scenario as part of The Homeless Project.

When her students arrived for what they thought would be a lecture, Muirhead instead divided them into groups, dropped them off at downtown locations, gave them different identities and challenges, and asked them to spend three hours exploring how they would survive.

This “lived experience” allowed students to view lives in a very vulnerable population. Students explored whether they could wash dishes for a free meal, tried to seek shelter, searched for resources and located people who could likely guide them, including homeless individuals.

“At the conclusion of the experience, students examined their preconceived ideas, attitudes and assumptions about the homeless. These ideas and attitudes, when present in the health care system, can lead to poor interpersonal relationships between patients and health care providers, patient resentment, distrust, disparate care and poor health outcomes,” said Muirhead, Assistant Professor in the School of Nursing.

One group met with Chattanooga Mayor Ron Littlefield to gather the facts about the local homeless situation. According to the mayor’s office, there is a base rate of 300-400 homeless in Chattanooga. Since the population moves seasonally, Chattanooga’s spring thaw may cause the number to bal¬loon to more than 1,000. Economic pressure has created a growing demographic of homeless single earner families, often mothers with children.

Armed with experience and knowledge of the health issues and needs of homeless individuals, the students developed a community service project that met both their educational and service goals.

“The students decided to participate in a commu¬nity-wide event called Project Homeless Connect. Starting with an operating budget of zero money and no supplies, students had to consider marketing, media, resource procurement, logistics and educating their own group,” Muirhead said.

Students at The University of Tennessee at Chattanooga respond:

“You look at people and you sort of sum up how you think they live their lives very quickly. And you can be so wrong, so absolutely wrong. So I’m not going to assume anymore.” —Julie Henry

My dog’s a genius, I knew it…

This basic canine intelligence test was developed by researcher Stanley Coren, PhD, at the University of British Columbia. “Animals who keep trying until they succeed are brighter,” Coren says, “but the longer it takes, the less bright they are. Giving up is not a good sign.” With your dog watching, put a treat under a can; then see how long it takes for her to retrieve it. Less than 15 seconds is very good. Set up three cans, and place a treat under one while your pet watches. Remove him from the room for a couple minutes and then let him back in. Does he run straight to the cans? Does he find the right one? How many commands, hand signals, and noises does your pet respond to? More than 200 means you have a superpet.

not only did CC get the first and second treats right away, but I didn’t know that she had gotten the first one… duh… she was sooooo fast at retrieving and eating it up in a flash…  such a genius… she also continued looking for the treats afterwards and sniffing at the bowls, where did those treats go??? it’s like when she eats up a raw bone or rawhide bone and finishes it and looks around, wherever did that bone get to?  (in your tummy, silly)… 

she knows a few commands but not 200 … so she’s not a superpet… oh well, but this morning, first thing upon arising, she looked for the raw bone that I had taken away from her last night, that she had been chewing on for a couple of hours, and now she is happily chewing it again… but the point is that she remembered the bone overnight… smarty pants.
