Update:
Settlement and mutual walk away/dismissal between Hoge and Schmalfeldt?  This is potentially very good news (provided it is not like a Hamas ceasefire). I will give Schmalfeldt the benefit of doubt (still trust but verify).

Convicted felon Brett Kimberlin has filed a Maryland lawsuit naming bloggers Aaron Walker, W. J. J. Hoge, Robert Stacy McCain, National Bloggers Club President Ali A. Akbar and the anonymous blogger “Kimberlin Unmasked” as defendants.The defendants believe that the suit is without merit and is part of Kimberlin’s continued effort to use lawfare to silence journalists and bloggers who have written about Kimberlin’s criminal past. The defendants will not be made available for comment until they have finished initial consultations their respective legal counsel.

Why won't the Howard County, Maryland Prosecutor Protect The Innocent From Cyber Bullies?

Why is that?  These are not victim less crimes. I recognize prosecutor offices have limited resources and have to prioritize, but they should not thwart innocent private citizens trying to protect themselves through the courts. This is a real problem.

Aaron Walker SWAT-ted. Who did it?

Neal Rauhauser and Brett Kimberlin

That this would come on the same day that Aaron Walker prevailed in court over Brett Kimberlin is (at the least) very strange and certainly not a coincidence.  It was an important victory for Walker today in court.   The trial judge was essentially reversed on appeal (granted there is still a hearing on July 5).  Was it Kimberlin who called in this SWAT-ting?  Was it Rauhauser?  They certainly had motive, but we do not know.  It could be a copy cat sympathizer (either inspired directly or indirectly by these two).  We do know that Kimberlin has acted bizarrely over Aaron Walker's personal information.  Which of course strongly suggests, but does not confirm, Kimberlin being involved.

Interesting that Charles Johnson suggested just a few days ago that SWAT-ting may be a right wing false alarm.  Excellent timing Charles Johnson--which makes you wonder if one of his followers called this in.

We should be following the money (also know as their funding) which is coming from lefties such as Barbara Streisand and George Soros' Tides Foundation.

The best way you can help?  Let your elected officials know this nonsense has to stop (because Team Obama seems more intent in investigating his political opponents in Arizona than doing anything to stop actual terrorism at home.  Also, support bloggers fighting back like Robert Stacy McCain.

I will say emphatically that I do not believe Brett Kimberlin made any of the prior SWATting calls himself and I would be very surprised if he made this one. 

But on the other hand, Occam’s razor tells us this was done in retaliation against me for having won today in court against Kimberlin. Which doesn’t mean Kimberlin has anything to do with it, but it suggests a motive for whoever did.

There is likely a connection.  But the question is was it a follower motivated on his own or something more conspiratorial?  We just do not know yet.

Tomorrow is Aaron Walker's emergency appeal (via his attorney Reginald Bours with consulting assistance by Constitutional expert Eugene Volokh).  Hopefully the law is actually applied to this case and the insane "peace order" of Brett Kimberlin against Aaron Walker is vacated.  Patterico is also reporting on it.

Robert Stacy McCain notes the hearing and wonders why Mark Singer has not spoken out about Kimberlin over the last few years.  McCain has been tracking down and reporting on facts and connections pertaining to Kimberlin and Rauhauser and their supporters on the left and in the media.  RSM notes that Rauhauser's behavior seems bizarre and paranoid.

Patterico notes that Rauhauser is claiming Patterico set up Anthony Wiener (how in the hell did Patterico get Wiener to email underwear shots to women).  It if just further evidence of how delusional these two are.  Nevertheless, they are cunning and absolutely ruthless.  The sooner their abuse of the system ends the better.

Breaking story:  This is horrible.  The world is upside down.   The Other Mccain reports:  

Just spoke to a source who confirms that witnesses saw Walker led out of the courtroom in handcuffs. Ali Akbar, president of the National Bloggers Club, Tweets:

Judge Vaughan had read up on the matter, knew Kimberlin’s history of felony convictions, but clearly was technically ignorant of even basic facts about what Twitter is, in one instance point saying “He Googled you 500,000 times” through the Tubes or whatever. The Judge had identified himself, earlier, as being “of the Royal Typewriter Generation,” and at another point, when confronted with the voluminous material from both sides, asked “don’t people have jobs, who reads this stuff?”

For the Judge’s faults, he really did try to let Walker make his case. When Walker was able to question Kimberlin–not about everything, but merely the facts that had occurred in the last 30 days (which is all that’s relevant in a Peace Order Hearing),it became clear that Kimberlin would unravel under any kind of competent examination. The guy’s story changed 3 times in 5 minutes. First it was that Walker had issued 14k tweets against him–which the Judge assumed were to Kimberlin’s account, and by Walker. Then it was 54 pages of 10 tweets each actually by Walker. Then it was 15k tweets about Muslims or something. 

Walker was also able to introduce for the record–again, Peace Order, it’s only about the last 30 days–Kimberlin’s convictions for bombings from I guess 1980, his revocation of parole in 1998, and even something where Kimberlin was convicted of perjury in 1973… ish. Then, when it came to actual convictions, there was one moment when Kimberlin came up with a defense about the judge being convicted of bribery, so he didn’t feel that those particular verdicts should be discussed, but that turned out to be an unrelated civil matter, and Judge Vaughan then insisted that the convictions remained in the record. 

But, Walker didn’t press the credibility of Kimberlin enough. He was too easily sidetracked by the latter’s machinations, and every time Walker veered off, the Judge got madder.

Here is the Peace Order that Aaron Walker was found to have violated.   Brett Kimberlin has things turned around.  This story is breaking and it is unclear what Aaron Walker was arrested for.  Possibly a judge who did not realize that commentator comments are not attributable to a blog.  Possibly contempt of court.  More updates to come.

I agree with Bob Belevedere this is an outrage.  Ironically this is the sort of thing that could prompt main stream media attention, a conservative blogger getting arrested.  Aaron Walker needs a competent civil rights/constitutional attorney admitted in Maryland and the federal courts to take this case on.  Here is a fund for donations (I am usually hesitant about linking to "fundraising funds" but this one I got via The Other McCain and Ali Akbar).
