Terms of Service

Kyma API is a service of Affitor LLC, a Wyoming limited liability company, doing business as Kyma API. References to "Kyma," "we," "us," or "our" mean Affitor LLC.

1. What Kyma does

Kyma API is an aggregator. We give you a single, OpenAI-compatible endpoint that routes your requests to a curated set of large language models, image generators, video generators, and speech synthesizers. We handle routing, load balancing, fallbacks, and reliability — you focus on building.

Because we are an aggregator, the actual computation happens on third-party AI infrastructure. Your use of those underlying models is also subject to the terms of the model creators (for example, the open license attached to a Llama or DeepSeek release). We surface the most relevant terms below; you are responsible for any model-specific restrictions disclosed on a model's page in the dashboard.

2. Eligibility

  • You must be at least 13 years old to use Kyma at all. If you are under 18, you confirm a parent or legal guardian has reviewed and accepted these terms on your behalf.
  • You must be at least 18 years old to use any image, video, or audio generation models offered through Kyma.
  • You must not be located in a country subject to a U.S. government embargo, and you must not be on any U.S. government list of prohibited or restricted parties.
  • If you are using Kyma on behalf of a company or other organization, you confirm you have authority to bind that organization to these terms.

3. Your account & API keys

  • Register with a valid email to get your API key. Provide accurate information and keep it current.
  • Keep your API key secure. You are responsible for all activity under your key, including charges, content generated, and any harm caused — regardless of who actually pressed the keys. Treat the API key like a password.
  • One account per person. Creating multiple accounts to exploit free credits, referral bonuses, or rate limits is not allowed.
  • No reselling raw access. You may not resell, sublicense, share, or redistribute your Kyma API key, your account, or raw token-by-token access to the underlying models. You may build products on top of Kyma where the value is your product, not raw model access.

4. Acceptable use

Your use of Kyma is governed by our Acceptable Use Policy (the "AUP"), which is part of these terms. The AUP lists categories of content and behavior that are not allowed — including child sexual abuse material, non-consensual intimate imagery, deepfakes of real people without consent, election manipulation, and other categories.

Violating the AUP is a material breach of these terms and may result in immediate suspension or termination of your account, refund forfeiture, and reporting to law enforcement where required by law (for example, suspected child sexual abuse material is reported to NCMEC).

5. Your content, your responsibility

Inputs. "Inputs" means anything you send to Kyma — prompts, files, images, audio, system messages, conversation history. You retain ownership of your Inputs. By sending Inputs to Kyma, you grant us a worldwide, non-exclusive, royalty-free license to host, process, route, log, and transmit them as needed to operate the service, debug, improve reliability, and comply with law.

Outputs. "Outputs" means content generated in response to your Inputs. Subject to applicable law and any restrictions imposed by the underlying model's license, you own the Outputs you generate through Kyma. You are responsible for what you do with them.

You warrant that:

  • You have all rights necessary to provide your Inputs and to use the Outputs in your intended way.
  • Your Inputs do not infringe anyone's intellectual property, privacy, publicity, or other rights.
  • Where you submit images, audio, or video of real people, you have valid consent from those people for your intended use.
  • Your use of Outputs complies with all applicable law, including disclosure obligations for AI-generated content.

6. AI outputs & disclosures

Outputs are produced by statistical models. They can be wrong, biased, offensive, fabricated, or unsafe. Outputs may sometimes match content the underlying model was trained on. You are responsible for reviewing and verifying any Output before relying on it.

Outputs are not professional advice. Do not use Kyma as a substitute for licensed legal, medical, financial, psychological, or safety advice. Do not rely on Outputs in any high-stakes decision (medical diagnosis, legal action, financial trade, safety-critical control loop, infrastructure operation) without independent professional review.

AI marking. Where required by law (for example, EU AI Act Article 50), you must disclose to your end users that content shown to them was generated or substantially modified by an AI system. Kyma includes machine-readable AI markings on image, audio, and video outputs where the underlying model or upstream service provides them; preserving and surfacing those markings is your responsibility.

7. Credits & billing

  • New accounts receive a small welcome credit to get started.
  • Additional credits can be purchased at any time. Payments are processed by Stripe; we never see or store your card number.
  • Each request deducts credits based on the model, tokens (or seconds, characters, or images for non-text models), and any applicable surcharges shown at the time of the request.
  • Credits are non-refundable, non-transferable, and never expire unless required by law. They are usable only for API consumption on Kyma. They have no cash value and cannot be withdrawn.
  • We may adjust your credit balance — including clawing back credits — if we detect that they were obtained through abuse, fraud, chargeback, or violation of these terms or the AUP.
  • Prices may change. We will give reasonable advance notice for material price increases. Continued use after a change means you accept the new prices.

8. Referral program

Kyma offers a referral program where you can earn credits by inviting others.

  • How it works: Share your referral link. When someone signs up and uses at least 1 million tokens, both you and the referred user each receive $0.50 in credits.
  • Pending status: Referrals start as "pending" and become "verified" only when the referred user uses 1M+ tokens. There is no time limit.
  • Legitimate referrals only. Each referral must be a real person who genuinely intends to use Kyma. Creating fake accounts, using bots, or any form of automated signup to earn referral credits is strictly prohibited.
  • One account per person. Multiple accounts created by the same person will be considered fraudulent.
  • Enforcement: If we detect referral abuse, we will reset earned credits to zero, revoke referral privileges, and may permanently ban the account.
  • Kyma may modify or discontinue the referral program at any time.

9. Rate limits

  • Tier 0 (free): 30 requests/min, 25 per-model RPM, 200K tokens/min.
  • Tier 1–4: Higher limits based on credits purchased ($10–$1,000+). Up to 300 RPM, 200 per-model RPM, 10M TPM.
  • Image, video, and audio models have separate per-model concurrency and rate limits shown in the model dashboard.
  • Underlying models may impose additional limits we do not control.

10. Privacy & data handling

We log API requests — including message content — to monitor quality, detect abuse, prevent fraud, and satisfy take-down obligations. Logs are retained for 90 days. Image, video, and audio outputs are stored for 24 hours by default (or 30 days if you opt in via a request flag). We do not use your Inputs or Outputs to train AI models.

11. Take-down procedure

If you believe content stored or transmitted by Kyma infringes your copyright, depicts you in a non-consensual intimate image, impersonates you, or otherwise violates the AUP or your rights, you can submit a report.

  • How to report: Use the form at kymaapi.com/report, or email [email protected]. Include enough information for us to identify the content, your relationship to it, and your contact details.
  • Response time: Non-consensual intimate imagery reports are actioned within 48 hours. DMCA copyright notices are processed under 17 U.S.C. § 512.

  • Counter-notices and bad-faith reports: A counter-notice procedure is available for users who believe content was removed in error. Knowingly submitting a false report subjects you to liability under § 512(f) and may result in account termination.

12. Indemnification

You agree to defend, indemnify, and hold harmless Affitor LLC and its officers, employees, and agents from and against any third-party claim, demand, loss, liability, damage, judgment, settlement, fine, fee, or expense (including reasonable attorneys' fees) arising out of or related to:

  • your Inputs, Outputs, or use of Kyma;
  • your breach of these terms or the AUP;
  • your violation of any applicable law or third-party right (including intellectual property, privacy, publicity, or contract rights);
  • any product, service, or content you build, distribute, or sell that uses Kyma.

We will give you prompt written notice of any claim. We may participate in the defense and you may not settle any claim that imposes liability on us without our prior written consent.

13. Disclaimers, liability cap & third-party services

AS IS. Kyma is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory. To the maximum extent permitted by law, we disclaim all warranties, including merchantability, fitness for a particular purpose, accuracy, non-infringement, and availability. We do not warrant that Outputs will be accurate, safe, non-infringing, or fit for any purpose.

Liability cap. To the maximum extent permitted by law, in no event will Affitor LLC's total cumulative liability arising out of or related to these terms or your use of Kyma exceed the greater of (a) the fees you paid to Kyma in the twelve (12) months immediately preceding the event giving rise to the claim, or (b) USD $100. We are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost data, or business interruption — even if we have been advised of the possibility of such damages.

Third-party services and force majeure. Kyma depends on third-party model creators, inference infrastructure, payment processors, and connectivity providers. We are not liable for outages, errors, latency, content moderation decisions, or other failures of those third parties. We are not liable for delay or failure caused by events outside our reasonable control, including acts of god, internet failures, government actions, war, civil unrest, labor disputes, or upstream provider outages.

Some jurisdictions do not allow the exclusion of certain warranties or liability for certain damages. Where so, the disclaimers and caps above apply to the maximum extent permitted in your jurisdiction.

14. Suspension & termination

We may suspend or terminate your account, with or without notice, if we reasonably believe you have violated these terms or the AUP, if continued service would expose us to legal risk, or if required by law. We will try to give notice when reasonable.

You may stop using Kyma at any time. Sections that by their nature should survive termination (including ownership, indemnification, disclaimers, liability cap, and governing law) survive termination.

15. Governing law & disputes

These terms are governed by the laws of the State of Wyoming, USA, without regard to conflict-of-laws rules. The exclusive forum for any dispute that cannot be resolved informally is the state and federal courts located in Wyoming, and you consent to personal jurisdiction there. The U.N. Convention on Contracts for the International Sale of Goods does not apply.

Before filing any claim, you agree to first contact us at [email protected] and attempt to resolve the dispute informally for at least 60 days.

16. Changes to these terms

We may update these terms as the service evolves. For material changes, we will give notice by email or in-product banner at least 14 days in advance. Continued use after the effective date means you accept the new terms. If you do not agree, stop using Kyma.
