Investigations into inter-level relations in computer science, biology and psychology call for an *empirical* turn in the philosophy of mind. Rather than concentrate on *a priori* discussions of inter-level relations between 'completed' sciences, a case is made for the actual study of the way inter-level relations grow out of the developing sciences. Thus, philosophical inquiries will be made more relevant to the sciences, and, more importantly, philosophical accounts of inter-level (...) relations will be testable by confronting them with what really happens in science. Hence, close observation of the ever-changing reduction relations in the developing sciences, and revision of philosophical positions based on these empirical observations, may, in the long run, be more conducive to an adequate understanding of inter-level relations than a traditional *a priori* approach. Intergovernmental relation is an interaction among different levels of government. Intergovernmental relation is often times conflict-ridden, and the extent of the conflict depends on how they are managed by the actor operating at the government levels. This study examines conflict management in intergovernmental relation in Nigeria. The content analysis method would be used. This will be carried out by analyzing data obtained from extant literature on the subject matter. This paper found that intergovernmental conflicts mainly borders on tax jurisdiction and (...) revenue allocation. Other areas of conflict were found to include domination by the centre of other units, as well as, parallel and vertical misunderstanding among units on administrative, legal, social and economic matters. It was suggested that levels of government should introduce such method as discussion, integration, good management of communication in other to attain a peaceful intergovernmental relations regime. This expository paper presents a general framework for representing levels and inter-level relations. The framework is intended to capture both epistemic and ontological notions of levels and to clarify the sense in which levels of explanation might or might not be related to a levelled ontology. The framework also allows us to study and compare different kinds of inter-level relations, especially supervenience and reduction but also grounding and mereological constitution. This, in turn, enables us (...) to explore questions such as whether supervenience implies explanatory reducibility and whether there can be irreducible higher-level explanations or even “emergent” higher-level properties. The paper finally discusses some further philosophical applications: to the free-will debate, the determinism-indeterminism distinction, indexicality and consciousness, and the relationship between positive and normative facts. Within physics there are two ways of establishing the relative fundamentality of one theory compared to another, via two senses of reduction: "inter-level" and "intra-level" (Crowther, 2018). The former is standardly recognised as roughly correlating with the chain of ontological dependence (i.e., the phenomena described by theories of macro-physics are typically supposed to be ontologically dependent on the entities/behaviour described by theories of micro-physics), and thus has been of interest to naturalised metaphysics. The latter, though, has not (...) been considered interesting for metaphysics, because it is not thought to correlate either with ontological dependence, nor causal or dynamical dependence. I argue, however, that this is a mistake, and that actually, the intra-level relation does reflect ontological dependence (in the same sense as the inter-level relation) and thus should not be neglected by metaphysics of physics. This argument further supports the assertion that the same notion of fundamentality underlies both the inter- and intra-level claims of fundamentality in physics. (shrink)

Philosophy of science has long operated under the implicit assumption that genuine explanation requires reduction to more fundamental levels of description. This assumption has been reinforced by the historical success of microphysical explanation, leading to the widespread view that higher-level descriptions are at best heuristic and at worst illusory. At the same time, actual scientific practice relies irreducibly on multi-level explanations-spanning physics, chemistry, biology, psychology, and the social sciences-without treating these levels as interchangeable or eliminable. This tension reveals (...) a conceptual gap: there is no widely accepted ontological account explaining how multiple descriptive levels can coexist without contradiction, redundancy, or ontological inflation. Reductionism explains inter-level relations but struggles to justify the continued explanatory legitimacy of higher-level descriptions. This paper proposes a structural resolution through the Three-Circle Ontology, a meta-ontological framework that distinguishes explanation from reduction by grounding levels of description ontologically rather than methodologically. Within this framework, explanatory adequacy is understood as level-relative satisfaction of structural constraints, not as elimination in favor of a privileged fundamental description. The account does not introduce a new scientific methodology, does not challenge the empirical success of reductionist explanations, and does not endorse metaphysical pluralism. Its primary contribution is a conceptual reframing of explanation as structurally constrained, level-relative understanding rather than ontological reduction. (shrink)

Introduction: the objective of the investigation is to analyse the informational operating-mode of the brain and to extract conclusions on the structure of the informational system of the human body and consciousness. Analysis: the mechanisms and processes of the transmission of information in the body both by electrical and non-electrical ways are analysed in order to unify the informational concepts and to identify the specific essential requirements supporting the life. It is shown that the electrical transmission can be described by (...) typical YES/NO (all or nothing) binary units as defined by the information science, while the inter and intra cell communication, including within the synaptic junction, by mechanisms of embodiment/disembodiment of information. The virtual received or operated information can be integrated in the cells as matter-related information, with a maximum level of integration as genetically codified info. Therefore, in terms of information, the human appears as a reactive system changing information with the environment and between inner informational subsystems which are: the centre of acquisition and storing of information (acquired data), the centre of decision and command (decision), the info-emotional system (emotions), the maintenance informational system (matter absorption/desorption/distribution), the genetic transmission system (reproduction) and info-genetic generator (genetically assisted body evolution). The dedicated areas and components of the brain are correlated with such systems and their functions are specified. Result: the corresponding cognitive centres projected into consciousness are defined and described according to their specific functions. The cognitive centres, suggestively named to appropriately include their main characteristics are detected at the conscious level respectively as: memory, decisional operation (attitude), emotional state, power/energy status and health, associativity and offspring formation, inherited predispositions, skills and mentality. The near-death and religious experiences can be explained by an Info-Connection pole. Conclusion: consciousness could be fully described and understood in informational terms. (shrink)

“Realization” and “emergence” are two concepts that are sometimes used to describe same or similar phenomena in philosophy of mind and the special sciences, where such phenomena involve the synchronic dependence of some higher-level states of affairs on the lower-level ones. According to a popular line of thought, higher-level properties that are invoked in the special sciences are realized by, and/or emergent from, lower-level, broadly physical, properties. So, these two concepts are taken to refer to (...) class='Hi'>relations between properties from different levels where the lower-level ones somehow “bring about” the higher-level ones. However, for those who specialise in inter-level relations, there are important differences between these two concepts – especially if emergence is understood as strong emergence. In a recent book and an article, Carl Craver construes the relations between different levels of a mechanism, which he also refers to as constitutive relations, in terms of mutual manipulability (MM). Interpreted metaphysically, MM implies that inter-level relations are symmetrical. MM thus violates one of the main desiderata of scientific explanation, namely explanatory asymmetry. Parts of Craver’s writings suggest a metaphysical interpretation of MM, and Craver explicitly commits to constitutive relationships being symmetrical. The paper (...) furthermore explores the option of interpreting MM epistemologically, as a means for individuating mechanisms. It is argued that MM then is redundant. Philosophers almost universally believe that concepts of supervenience fail to satisfy the standards for physicalism because they offer mere property correlations that are left unexplained. They are thus compatible with non-physicalist accounts of those relations. Moreover, many philosophers not only prefer some kind of functional-role theory as a physically acceptable account of mind-body and other inter-level relations, but they use it as a form of “superdupervenience” to explain supervenience in a physically acceptable way. But I reject (...) a central part of this common narrative. I argue that functional-role theories fail by the same standards for physicalism because they merely state without explaining how a physical property plays or occupies a functional role. They are thus compatible with non-physicalist accounts of that role-occupying relation. I also argue that one cannot redeploy functional-role theory at a deeper level to explain role occupation, specifically by iterating the role-occupant scheme. Instead, one must use part-whole structural and mechanistic explanations that differ from functional-role theory in important ways. These explanations represent a form of “superduperfunctionalism” that stand to functional-role theory as concepts of superdupervenience stand to concepts of supervenience. (shrink)

This paper argues that currently operative approaches to the protection of Indigenous rights and capabilities cannot help but fall short of accommodating relational, co-creative dynamics of Indigenous being in the world due to insufficient engagement with the participationalist, networked understandings of Indigenous paradigms. Discussions during the preparation of the United Nations’ Declaration of the Rights of Indigenous Peoples (UNDRIP), in a necessary first step, focused on responses to shared histories of subjugation by colonial powers, and on safeguarding Indigenous rights and (...) capabilities in relation to the powers exercised by what have since become encapsulating nation states. While the respect implied in the safeguarding of such rights and capabilities constitutes a crucial first step towards fruitful forms of coexistence, its conception from within a predominantly representationalist, Newtonian, post-Enlightenment Western paradigm necessarily falls short – at least as yet – of allowing space for Indigenous forms of networked, often acausal relationships of inter-species kinship to thrive. As a corollary, it also entails limitations remaining operative with regards to any potential networking between networks: to the extent that an Indigenous network’s own ability to thrive is impeded, so is the ability of its neighbouring networks to fruitfully interact with its contribution to inter-network co-creative activity and thriving. Understandings on their own terms are going to be needed of Indigenous conceptions of agency residing in inter-species relationship, so that space can be opened up for Indigenous societies not only to exercise rights and capabilities at bounded individual or group level, but also to practise participationalist ways of dynamically centering the co-creative agency of relationships. Quantum entanglement is routinely described as exhibiting nonlocal correlations or “spooky action at a distance”, despite the absence of superluminal signaling and despite full agreement with relativistic causality at the operational level. This persistent conceptual tension suggests that the difficulty posed by entanglement is not empirical or dynamical but descriptive. In this paper, we analyze entanglement from a structural perspective that distinguishes between different levels of physical description. We argue that entanglement is a quantum– relational structure internal to spacetime (...) descriptions and that it becomes paradoxical only when classical local requirements are imposed outside their domain of validity. By separating projection, reduction and dynamics, we clarify why entanglement correlations are independent of spatial separation and why attempts to localize them inevitably generate misleading inter- pretations. The resulting account preserves experimental practice and the formal structure of quantum theory without invoking nonlocal influence or additional physical mechanisms. Entanglement is thereby reinterpreted not as evidence for action at a distance but as a manifestation of the limits of classical local description in the presence of irreducible quantum relations. The thesis explores and suggests a solution to a problem that I identify in John McDowell’s and Lynne Rudder Baker’s approaches to mental and intention-dependent (ID) causation in the physical world. I begin (chapter 1) with a brief discussion of McDowell’s non-reductive and anti-scientistic account of mind and world, which I believe offers, through its vision of the unbounded conceptual and the world as within the space of reasons, to liberate and renew philosophy. However, I find an inconsistency in McDowell’s (...) criticism of Davidson’s anomalous monism (chapter 2), stemming from a tension between McDowell’s naïve common sense view of mental causation and an understanding of ordinary physical causation which I think McDowell ought to embrace, which portrays it as both objective, in the sense of being recognition- independent, and as belonging within the space of reasons. The question of the relation between these two concepts of causation is an aspect of the more general question of the relation between the space of reasons and the realm of law. In chapter 3 I begin examining the possibility that Baker’s account of material and property constitution could form the basis of a bridge between the two spaces, and find it generally promising. However, I find that her defence of her version of non-reductive monism against Kim’s causal arguments also runs into problems, which I attribute to the fact that she holds a view of causation as secondary to causal explanation. 2 3 In chapter 4 I develop an account of what I call manifest physical causation – of objective causal relations in the world of Sellars’s manifest image. Based upon McDowell’s transcendental empiricism, which takes the existence of the ordinary perceived world as a condition of the possibility of our possession of conceptual capacities, I contend that it is this picture of reality, rather than that of fundamental physics, that should be the starting point of our theorizing. Causation in the manifest image, I argue, covers the behaviour of the familiar physical world as well as that of its well-understood extensions into the special sciences and engineering. Manifest physical causation, on my account, is productive, acts through mechanisms which are almost entirely mechanical, electromagnetic, and/ or chemical, and is causally closed. In my view, normative, semantic, contentful property-instances are not part of the manifest physical causal nexus. In my final chapter I suggest a modification of Baker’s constitution account, which I call Constituted Causation, whereby higher-level – mental and other ID – causal relations are constituted, in favourable circumstances, by lower-level ones. ID causal relations belong in their own causal nexus but are connected to the manifest physical world through constitution, a relation of unity without identity. Causation and constitution are, respectively, intra- and inter-level relations, and they are non-overlapping. The constituted network of rational and normative relations bears, I believe, striking parallels with McDowell’s view of reality. According to Baker’s view of constitution, the essential properties of constituted entities subsume those of their constituters; extending this to my account enables us to say that the real cause and explanation of someone’s action is that they consciously performed it 4 rather than that certain manifest causal processes occurred at the lower level. I consider a problem for functional reductionism, based on the following tension. Say that b is functionally reduced to a. On the one hand, a and b turn out to be identical, and identity is a symmetric relation. On the other hand, functional reductionism implies that a and b are asymmetrically related: if b is functionally reduced to a, then a is not functionally reduced to b. Thus, we ask: how can a and b be asymmetrically related if they are (...) the same thing? I propose a solution to this tension, by distinguishing between ontological levels and levels of description. While calls to integrate ethics into computer science education go back decades, recent high-profile ethical failures related to computing technology by large technology companies, governments, and academic institutions have accelerated the adoption of computer ethics education at all levels of instruction. Discussions of how to integrate ethics into existing computer science programmes often focus on the structure of the intervention—embedded modules or dedicated courses, humanists or computer scientists as ethics instructors—or on the specific content to be included—lists of case studies (...) and essential topics to cover. While proponents of computer ethics education often emphasize the importance of closely connecting ethical and technical content in these initiatives, most do not reflect in depth on the variety of ways in which the disciplines can be combined. In this paper, I deploy a framework from cross- disciplinary studies that categorizes academic projects that work across disciplines as multidisciplinary, interdisciplinary, or transdisciplinary, depending on the degree of integration. When applied to computer ethics education, this framework is orthogonal to the structure and content of the initiative, as I illustrate using examples of dedicated ethics courses and embedded modules. It therefore highlights additional features of cross-disciplinary teaching that need to be considered when planning a computer ethics programme. I argue that computer ethics education should aim to be at least interdisciplinary—multidisciplinary initiatives are less aligned with the pedagogical aims of computer ethics—and that computer ethics educators should experiment with fully transdisciplinary education that could transform computer science as a whole for the better. Amie Thomasson challenges advocates of layered conceptions of reality to explain “how layers are distinguished” and “what holds them together” by “examining the world” (2014). One strategy for answering such questions is mereological, treating inter-layer relations as parthood relations, where layers exist whenever composition does, and the number of layers will be equivalent to the number of answers to Peter Van Inwagen’s Special Composition Question, while answers to his General Composition Question explain what holds the layers together (...) (1987). Various answers have been proffered for these questions, from the physicalist atomism of Richard Feynman (2015), Hilary Putnam (1958), and Kit Fine (1992) to the holism of Jonathan Schaffer (2010), the two-layer emergentism of Van Inwagen himself (1995), Tim Maudlin’s three-layered “flash ontology” (2011), and Rob Koons two-layered “thermal substances” (2019). In this PhD project, I seek to meet Thomasson’s challenge by identifying which of these proposals are compatible with plausible interpretations of quantum physics. Atomist answers may have difficulty with relativity, while holistic and emergentist models have trouble giving an account of experimental conditions. Maudlin and Koons’ views, meanwhile, may make testable predictions about the scope of entanglement. Examining the world can lead us to sharply winnow our theories about how layers are distinguished and what holds them together. (shrink)

Relationships between current theories, and relationships between current theories and the sought theory of quantum gravity (QG), play an essential role in motivating the need for QG, aiding the search for QG, and defining what would count as QG. Correspondence is the broad class of inter-theory relationships intended to demonstrate the necessary compatibility of two theories whose domains of validity overlap, in the overlap regions. The variety of roles that correspondence plays in the search for QG are illustrated, using (...) examples from specific QG approaches. Reduction is argued to be a special case of correspondence, and to form part of the definition of QG. Finally, the appropriate account of emergence in the context of QG is presented, and compared to conceptions of emergence in the broader philosophy literature. It is argued that, while emergence is likely to hold between QG and general relativity, emergence is not part of the definition of QG, and nor can it serve usefully in the development and justification of the new theory. I introduce "nomic-role nonreductionism" as an alternative to traditional causal-role functionalism in the philosophy of mind. Rather than identify mental properties by a theory that describes their intra-level causal roles via types of inputs, internal states, and outputs, I suggest that one identify mental properties by a more comprehensive theory that also describes inter-level realization roles via types of lower-level engineering, internal mental states, and still higher-level states generated by them. I defend this position on (...) grounds that mental properties should be understood by our best scientific theories, which at present include informatioin about mental engineering. I further defend this claim by a "parity of reasons" argument. Causal-role functionalists are justified to include sensory stimuli in their theory of mind as opposed to, say, the remote causes of sensory stimuli because the former but not the latter are items of direct mental production. But ditto for the system's physical realizations. They too directly produce mental states, only not by "causing" them but by "realizing" them. Engineering realizations and their input triggering conditions work in tandem. In addition, I tell a related but more general metaphysical story about property identity, namely, that the traditional causal theory should be replaced by a more comprehensive nomic theory that individuates properties by their intra-level causal powers as well as their inter-level realization capacities. Introduction: This article discusses the brain hierarchical organization/evolution as a consequence of the information-induced brain development, from the perspective of the Informational Model of Consciousness. Analysis: In the frame of the Informational Model of Consciousness, a detailed info-neural analysis ispresented, concerning the specific properties/functions of the informational system of the human body composed by the Center of Acquisition and Storing of Information, Center of Decision and Command, Info-Emotional Center, Maintenance Informational System, Genetic Transmission System, Info Genetic Generator and Info- Connection (...) center, in relation with the neuro-connected brain areas, with a special attention to the Info-Connection and its specific properties. Besides a meticulous analysis of the info-connections/neuro-functions of these centers, a special attention was paid to limbic/cingulate cortex activities. Defined as a trust/confidence center, additional features are highlighted in correlation with the activity of the anterior cingulate cortex, consisting in the intervention/moderation of amygdala emotional signals, conflicting opposite YES/NO data and error elimination in the favor of the organism adaptation/survival, the intervention in the certainty/uncertainty balance to select a suitable pro-life information (antientropic effect), in moderation of pain and in the stimulation of the empathic inter-human relations/communication. Representing the correspondence between the informational subsystems and the brain area map, itis shown that the up/down integration of information by epigenetic mechanisms and the down/ up evolution are correlated. Results: The analysis of the functions of the anterior cingulate opens new gates of investigations concerning the involved intimate mechanisms at the level of cell microstructure, specifically on the compatibility with quantum assisted processes admitted by the Informational Model of Consciousness and the quantum-based models The discussion on the information integration/codification by epigenetic mechanisms shows that this process starts from the superior levels of brain conscious info-processing areas and progressively advances to the automatic/autonomic inferior levels ofthe informational system, under insistent/repetitive cues/stress conditions, pointing out an hierarchical functional/anatomical structure of the brain organization. Additional arguments are discussed, indicating thatthe down/up progressive scale representation is a suggestive illustration of the brain evolution, induced/assisted/determined by information, accelerated at humans by the antientropic functions of the Info-Connection center. Conclusions: The hierarchical organization of the brain is a consequence of the integration process of information, defining its development accordingly to the adaptation requirements for survival during successive evolution stages of the organism, information playing a determinant/key role. Maurice Merleau-Ponty was an important twentieth century contributor to the theory of recognition, even though he made literal reference to the concept only sparingly. He emphasized the importance of recognition, not only at the level of inter-personal relations and in the individual’s inclusion in the social, but also in terms of the capacity of human beings to communicate across cultures and across historical distances. The shift towards ontology in his later work provided a renewed grounding for his (...) interest in intersubjectivity and cross-cultural communication. Such continuity might be traced to lasting Hegelian and Marxian legacies in his thinking, which inflected his political interpretation of recognition. (shrink)

Functional reductionism characterises inter-theoretic reduction as the recovery of the upper-level behaviour described by the reduced theory in terms of the lower-level reducing theory. For instance, finding a statistical mechanical realiser that plays the functional role of thermodynamic entropy allows for establishing a reductive link between thermodynamics and statistical mechanics. This view constitutes a unique approach to reduction that enjoys a number of positive features, but has received limited attention in the philosophy of science. -/- This paper (...) aims to clarify the meaning of functional reductionism in science, with a focus on physics, to define both its place with respect to other approaches to reduction and its connection to ontology. To do so, we develop and explore two alternative frameworks for functional reduction, called Syntactic Functional Reductionism and Semantic Functional Reductionism. They represent two different possible stances on the view that expand and improve the basic functional reductionist approach along different lines, and make clear how the approach works in practice. The former elaborates on David Lewis’ account, is connected with the syntactic view of theories, is committed to a logical characterisation of functional roles, and is embedded within Nagelian reductionism. The latter adopts a semantic view of theories, spells out functional roles mainly in terms of mathematical roles within the models of theories, and is expressed in terms of the related structuralist approach to reduction. The development of these frameworks has the final goal of advancing functional reductionism, to make it a fully-fledged alternative account for reduction in science. (shrink)

We characterize four fruitful and underappreciated epistemic roles played by the concept of an individualized niche in contemporary biology, utilizing results of a qualitative empirical study conducted within an interdisciplinary biological research center. We argue that the individualized niche concept (1) shapes the research agenda of the center, (2) facilitates explaining core phenomena related to inter-individual differences, (3) helps with managing individual-level causal complexity, and (4) promotes integrating local knowledge from ecology, evolutionary biology, behavioral biology and other biological (...) fields. Objective: The study was conducted to determine predictive effect of anxiety and burnout levels related to the COVID-19 Pandemic and organizational commitment on their ıntention to leave the organization of the healthcare professionals. -/- Methods: The sample of study consisted of 251 healthcare professionals who actively worked during the pandemic process. Data were collected by applying the "Coronavirus Anxiety Scale", "COVID-19 Burnout Scale", "Organizational Commitment Scale", and "Intention to Leave the Organization Scale". The data was analysed in the SPSS 22 (...) package program. -/- Results: 66.5% of all participants worked in the pandemic units during the pandemic process, 57.4% of them had COVID-19, 75.3% of them had COVID-19 vaccine, and 32.3% of them lost a relative due to COVID-19. 42.2% of the healthcare professionals had dysfunctional anxiety and they experienced a very high level of burnout, their continuance commitment, which is one of the subscales of organizational commitment, was high, their affective and normative commitment was moderate, and their intention to leave the organization was moderate. The anxiety level of healthcare professionals explained 7.7% of the change in their intention to leave the organization. The anxiety (p<0.05) and burnout levels (p>0.05) together explained 8.5% o the change in intention to leave the organization. The Anxiety and burnout levels and organizational commitment levels together explained 25.9% of the change in intention to leave the organization (p˂0.05). -/- Conclusions: The anxiety levels and the levels of affective organizational commitment of healthcare professionals during the pandemic process are significant predictors of intention to leave the organization. 1 Introduction1 In the 1980s, hermeneutics was often incorporated into deconstructionism and literary theory. Rather than focus on authorial intentions, the nature of writing itself including codes used to construct meaning, socio-economic contexts and inequalities of power,2 Gadamer introduced a different perspective; the interplay between effects of history on a reader’s understanding and the tradition(s) handed down in writing. This interplay in which a reader’s prejudices are called into question and modified by the text in a fusion of understanding and (...) topic revitalized the study of the printed word. Gadamer’s turn to language for understanding the meaning of Being also appealed to the post-modern antipathy toward modernity and metaphysics.3 If the truth and validity of interpretations are limited to communities of language, then our mode of being in history cannot but be historical. This point of view rendered Gadamer’s phenomenological hermeneutics vulnerable to the critique of moral and epistemological relativism. However, Gadamer’s theory of interpretation also stems from re-examination of the beginning of knowledge in the Pre-Socratics and Plato, and on this basis, is receptive to another dimension of inquiry than that which was trending in North America. -/- At the East-West Center, University of Hawai’i at Manoa in 1982, Chung-ying Cheng for the first time introduced onto-hermeneutics to an audience of esteemed philosophers including Li Zehou, Ren Jiyu, Feng Youlan, and Zhang Liwen.4 In contrast to schools of deconstruction and literary theory that had disengaged the interpreter from trans-historical sources of meaning and truth, Cheng explained that interpreters exist within a cosmological order inextricable from responsibility to harmonize Heaven and Earth in creative acts of interpretation. By integrating Chinese cosmology into hermeneutics through ontology, he tacitly challenged philosophers in the West to re-examine assumptions about humanity’s place in nature and by implication, Gadamer’s recovery of the beginnings of knowledge in Western philosophy. -/- Cheng’s Neo-Confucianism is inspired by the method and goals of Thomé H. Fang. The following words by Fang seem to prefigure, although in an indistinct and bundled way, aspects of Cheng’s philosophy including a Mencian theory of human nature, comprehensive observation, and creativity: “In the very process of living in concord with creative Nature, Man is charged with an ideal to be fully realized in the light of the principle of comprehensive harmony.”5 Like Fang, Cheng reinvigorates Chinese culture and language, but not solely in order to vindicate the insights of Neo-Confucianism. He has studied Western thought, from pragmatism and the analytic school to German idealism and phenomenology, to unlock and clarify philosophical concepts within the Yijing tradition and thereby render them intelligible to Anglophones. The result has been an awakening of Western scholars to the moral and cultural consequences of decoupling their thought from metaphysical foundations that are neither dogmatic nor doctrinal. -/- Not unlike the dialectic of Gadamer’s dialogue form, onto-generative hermeneutics integrates contrary positions on the same topic in order to blend both sides into a world philosophy, or as Cheng says, a “totalizing or integrative theory,”6 not to be confused with a theoretical rewording of a theory. On the contrary, the universal scope and relevance of hermeneutics stems from personal experience. Just as Gadamer, in response to faction and strife, immersed himself in Plato during the war years, and developed a method with which to harmonize opposites, so too, according to On-cho Ng, was Cheng moved by faction, strife and political persecution to develop a path toward unity.7 Gadamer taught at McMaster University in Hamilton, Ontario, and Cheng at the University of Hawai’i at Manoa among other institutions in North America. They facilitated trans-continental educational and cultural ties. Similar experiences yield similar insights irrespective of differences of time and place. Hence, authors in this issue who reside in Europe, China and North America, delineate the differences between Gadamer and Cheng, yet also, in light of Cheng’s onto-generative method and cosmology, develop integrative theories. Due to the page-budget restriction of the publisher, certain articles of this special theme will be subsequently published in the next issue. -/- 2 Integrative Theory This special issue of The Journal of Chinese Philosophy confirms a dimension of hermeneutics that Cheng has both motivated and inspired. The contributors do not abide by the conviction that since thought is mediated by language, interpretations cannot transcend culture. On the contrary, their research exemplifies the fruits of trans-historical onto-dialogical hermeneutics within limits defined by their field inquiry, organized into Parts I and II, around three themes: language, the philosophy of history and ethics. -/- Andrew Fuyarchuk introduces the theme of ontology in relation to Gadamer’s turn to language. Fuyarchuk argues that Chung-ying Cheng’s criticism of Gadamer’s hermeneutics is informed by Heidegger’s concept of Dasein and thereby overlooks how Gadamer’s Platonic-Pythagorean problem of the division between the One and Many is harmonized in the event of language, which in turn positions Gadamer in proximity to the presupposed grounds of receptivity in Cheng’s onto-generative hermeneutics. Lauren Pfister’s contributing article addresses the year 2000 meeting between Cheng and Gadamer in Heidelberg and expands the transhistorical grounds of meaning in Gadamer to matters of theology. Pfister’s summary of the written Chinese record of their conversation indicates that Cheng does not address the role of Christian philosophy and hence, the role of the inner word in Gadamer’s hermeneutics. This is important not only for detecting changes in Cheng’s philosophical development, but also for modifying his hermeneutics along the lines of a living conversation, possibilities explored by Pfister in a sequel to the article submitted to this issue. Nevertheless, by raising the issue of how Gadamer’s turn to language for understanding the meaning of Being extends possibilities in Cheng’s thought, Pfister anticipates the article by Katarina Gajdosova. She returns to the roots of Chinese thought during the Warring States period and broadens the meaning of names in recently excavated texts. Contrary to the conventions about how to understand terms, she appeals to both Heidegger’s ontology and Cheng’s notion of receptivity and creativity to reinterpret naming in relation to cosmology. Along the same lines, insofar as the event of Being is lingual, Jay Goulding captures its emergent structure in an evolving community of scholars and scholarship. He recalls his philosophical journey toward Cheng’s philosophy that begins in conversations with Gadamer at McMaster University in Hamilton, leads to Heidegger and Asian thought, expands into turning points with teachers and colleagues from various backgrounds that by increments contributed to Goulding’s formulation of “Daoist phenomenology.” -/- Although differing traditions guide their inquiries and research, Cheng and Gadamer recall the wisdom of the past to ameliorate the fragmentation in contemporary life. This leads them to re-examine the origins of philosophy; historical roots and thus sources of creative re-interpretations East and West whose affinities are developed in contributions by Hyun Höchsmann and Friederike Assandri. Höchsmann assesses convergences and divergences in the origins of Chinese and Western philosophy (Confucius and Socrates, the Yijing and Pre-Socratics) that culminates in pairing Gadamer’s understanding of paideia in the context of Plato’s political cosmology in the Timaeus with moral and social cultivation in The Western Inscription. She delineates the limits of this comparison which in turn justifies introducing Vattimo’s notion of locality. Assandri’s comparative analysis moves between India and China, Buddhism and Tang Daoism. Based on Gadamer’s argument that writing detaches concepts from their cultural moorings, she defines and applies three levels of understanding in onto-generative hermeneutics to Buddhist terms that were assimilated into the Benji Jing and in so doing clarifies essential dimensions of Daoism. -/- Contributions by Stephen Palmquist and Nicholas Brasovan position Cheng in relation to Kant and Gadamer by way of Aristotle’s ethics respectively. On the one hand, Palmquist plots Cheng’s evolving criticism of Kant’s moral philosophy and draws on crucial dimensions of Gadamer’s hermeneutics to reposition that criticism in a constructive relation to Kant’s emphasis on the philosophical conditions of morality while also indicating how religious dimensions of his thought answer Cheng’s concerns for lived moral action. For Palmquist, Gadamer enables a constructive criticism of Cheng. On the other hand, Brasovan compares Cheng’s Yijing-based account of moral deliberation with Gadamer’s Aristotelian-based ethics and reasons that in contrast to Cheng, Gadamer’s hermeneutical consciousness is disengaged from practical knowledge. For Brasovan, Cheng is a constructive critic of Gadamer. Palmquist and Brasovan’s divergent angles on Gadamer and Cheng map onto a dialectic of contrast and complementarity that constitutes the inner logic of Cheng’s philosophy. In other words, Gadamer and Cheng ought to be read alongside one another for the sake of removing discrepancies and contradictions, which constitutes the organic structure of their thinking. -/- 3 Our Mode of Being in History Is Not Historical The conversations between Cheng and Gadamer in this issue of The Journal of Chinese Philosophy pivot on language, philosophy of history and ethics within a comparative framework of analysis, but also explore the grounds that make the comparisons possible. Those grounds are informed by Chinese cosmology, and function to wrest Gadamer from the shadow of Heideggerian facticity and reposition him within the range of Cheng’s ideas about our place in nature that is embedded in his question about how mind emerges from inorganic matter.8 -/- For Gadamer scholars of Heidegger, human finitude, our ownmost individuating death ensures that hermeneutics is always open to the other as other, always on the way toward understanding the meaning of Being. To arrest the process in a concept of “the Absolute” cannot but represent someone’s point of view, and thereby render hermeneutics indistinguishable from ideology. However, insofar as finitude is defined by them in terms of an onto-theological concept of immorality, finitude is a metaphysical concept consistent with epistemologies and confuse beings with the meaning of Being. As a result, the celebrated political value of hermeneutics to always be on the way toward an understanding of the meaning of Being admits subtle variations on the same worldview that are insufficiently self-critical. -/- Gadamer scholars of Heidegger are right. A transformation in ethos and opening to the meaning of Being depends on awareness of finitude. Yet this awareness does not yield openness to more of the same, i.e., discourse structurally incapable of coming to unity but instead, for both Gadamer and Cheng, openness to a distinctly different ontological dimension of reality. As Sandra Wawrytko and So-Seong Park indicate,9 this ontological dimension is prefigured in the experience of being-as-a-whole or the totality of all possible relations in both Chinese totemic shamanistic rituals,10 and Greek Dionysian festivals.11 Through these religious experiences human ethos and therefore consciousness is expanded and elevated from being centered on one’s ownmost concerns toward an affinity with all sentient beings from insects and plants to animals. The channel for this affinity is an auditory disposition and hence, the emotions, compassion, and feeling response. -/- The capacity for an auditory disposition, or as Gadamer calls it, listening consciousness to respond to the inter-relationality and therefore inherent balance of nature is developed through music, song and dance of the religious rituals and festivals. They facilitate the unity of mind with nature. This use of music, that transforms ordinary consciousness, explains Cheng’s emphasis on the receptivity of feeling response in comprehensive observation, and Gadamer’s emphasis on openness to the other in attunement. However, an auditory disposition characteristic of pre-literate oral cultures that reveals the “All” need not rely on religion. As theorists about the evolution of language have explained,12 modern languages preserve their pre-historical past in music or prosody. That is to say, the song and dance that revealed the totality of inter-related beings to an ethos of comprehensive observation and attunement toward beings in classical civilizations is retained in the back-and-forth movement or rhythm of the dialogue form. Our mode of being in history is a mode of being in nature – through the music of language. -/- While alerting the reader to the limits of a nominalist interpretation, Gadamer expresses the inner law of the nature as follows: “in perishing there is always becoming, and in becoming there is always perishing.”13 Considered in process, opposites generate and blend into each other. This law of nature applies to everything.14 Hence, in a manner comparable to Pfister’s concluding insights, onto-dialogical hermeneutics is not only open to discrete events of otherness but moreover, to the moving structure of reality expressed, as Gajdosova suggests, in the existential moment of naming. Considered as interplay of tension and resolution with a life of its own, the dialectic of a dialogue is self-similar to the way in which an organism grows (by instinct). There is, therefore, a sense in which the art of interpretation extends the human mind into the eternal cycles of nature such that we participate in the articulation of the inner telos/homeostasis toward which all beings strive and importantly for Gadamer scholars of Heidegger, within the material limits of energy to which our embodied minds are self-evidently subject. PHILOSOPHY OF HUMAN RIGHTS: HUMAN RIGHTS IN LIGHT OF THEIR INTERNATIONAL PROTECTION Summary The book consists of two main parts: in the first, on the basis of an analysis of international law, elements of the contemporary conception of human rights and its positive legal protection are identified; in the second - in light of the first part -a philosophical theory of law based on the tradition leading from Plato, Aristotle, and St. Thomas Aquinas is constructed. The conclusion contains an application (...) of the results of the analysis conducted in the second part. The first part comprises four chapters. The first aims at revealing characteristics of human rights on the basis of an analysis of historical conditioning of the inter-national law of human rights and its development. The historical context displays the practical, vindicative, and critical character of the positive legal protection of human rights. Moreover, the process of change of positive human rights law is distinguished from the process of change of human rights as such. In the second chapter the content of human rights - a topic which is only auxiliary to the conducted analysis - is discussed. Basic typology and catalogues of rights proclaimed in the Universal Declaration of Human Rights and protected in the International Covenants of Human Rights are presented. The review of the content of rights aims at a more precise limitation of the field of research. The examination shows a diversity of rights which poses a serious challenge to the coherence of every philosophical theory of human rights. In the third chapter, central in the first part, international law is analyzed with regard to the characteristics of rights and the foundations of them. The analysis of documents shows a number of solutions referring to the anthropological foundations of rights. The inherent dignity of the human person is the source of all human rights. Each human being is recognized as free, and endowed with both reason and conscience. In the propounded conception of man individuals are not rivals but create a community which is a condition for their development. International law characterizes the rights as universal, inherent, inalienable and inviolable. The reconstructed conception also comprises the following basic elements: on the level of the structure of rights, a recognition of their equality, interdependence, and comprehensiveness; in the grounding of these rights, a recognition of the anthropological foundations of law; in the conception of positive law, a recognition of the secondariness of the positive law of human rights to human rights themselves, and a recognition of human rights and justice as the basis for legal order; in the conception of state, a recognition of the well-being of the individual as the fundamental aim of actions undertaken by political institutions, and recogni¬tion of rights which form an impassable boundary to the power of the state, includ¬ing its legislative actions. The characterization of the international legal paradigm serving for the under¬standing of human rights is supplemented by analyses of the structure of their posi¬tive legal protection. Various meanings of the terms "right" and "freedom" are distinguished. Subjective right, as basic structure of the positive legal protection of human rights, is understood as a complex relation formed by various legal situations of the subject of a right which create a functional whole in respect of the subordi-nation of human person to its good. Subordinating person to a good proper for it, expressed usually in a proclamatory norm, is the central element of particular rights around which further elements aiming at the realization of this good are built. In the second part of the book a philosophical theory is developed which allows for the location of a coherent foundation for the presented characterization of human rights and their positive legal protection. This part consists of two chapters. The first includes a review of some - not entirely satisfactory - means of founding of human rights; the second presents philosophical conceptions of law and man which may form a basis for the constructed theory. The review of arguments contained in the first chapter does not aim at a detailed analysis of various specific ways of argumentation encountered in works on this subject but rather at a concise presentation of the main possible lines of argumentation. These analyses also serve to emphasize the positive solutions which are pro¬posed later and to underscore the explanatory power of the elaborated theory. This theory, retaining accurate intuitions contained in the presented types of argumenta¬tion, helps in avoiding their consequences which are difficult to reconcile with the reconstructed paradigm of human rights. Efforts to base human rights on the norms of international law rightly take into account the necessity of determining the content of the rights and their positive legal protection as a means for the realization of man's good. These attempts, how¬ever, do not properly take into account the inherent character of human rights, which are independent of positive law and provide grounds for applying specific legislative measures and not others. Founding human rights on freedom accurately points at the freedom of an indi¬vidual as a constitutive element of some rights; however, absolutization of freedom leads, to a loss of an important element of the contemporary paradigm of under¬standing human rights. This foundation undermines recognition of the fact that human rights may set limits to both the freedom of others and the freedom of the subject of rights itself. Additionally, attempts at the so-called axiological justification of human rights are discussed. This type of justification has a few variants depending on the as¬sumed conception of value. Subjectivistic conceptions have similar advantages and disadvantages to the conceptions basing human rights on freedom; objectivistic conceptions while providing for the universality of human rights place, the fundamental aim of human rights protection beyond the individual human being - in the idealistically existing world of values; finally, conceptions rooting values and human rights in culture, while accurately noting that human rights are learned through the medium of culture, place the source of human rights beyond a concrete individual - in culture and processes which take place in it - which leads to difficulties in finding a basis for the universality of rights. Furthermore, attempts to ground human rights in specific characteristics of the human being are presented. This type of approach points to an important problem of dependence of the content of rights on what man is. However, recognition of specific characteristics of a human being as an ontic foundation of the existence of rights poses a danger to their universality since one has to accept that it is not enough to be a man to be a subject of rights, but a man possessing specific charac¬teristics. The second chapter aims at outlining solutions worked out by Saint Thomas Aquinas. For a fuller understanding of his propositions selected elements of Plato's and Aristotle's philosophy are presented. It was them who formulated the founda¬tions for reflection on law and justice in the ontological context. A qualification is made that Stoicism is not be analysed in depth. Although Thomas' concept of law was undoubtedly developed under the influence of the Stoic doctrine as well, it is not in this that one should look for the tools to understand the ontic foundations of human rights and law in general since the Stoic moral philosophy and philosophy of law were developed in the context of a theory of being which assumed monistic and pantheistic premises as foundations, leading to the recognition of a total subor¬dination of the human individual to a larger unity of which man is only a part. The analysis of Plato's and Aristotle's texts concentrates on problems of justice. Plato seems to be the first philosopher who reflected on the formula basic in the history of European thought: to render to each his due. It appears that justice as both a characteristic of man and his acts is understood in the perspective of that which is just, that which is a good for another man - the recipient of the act. The basis for determining what is just is the relation of correspondence between some¬one and something. While in the case of Plato this relation is based on something beyond its terms, namely on ideas, in the case of Aristotle the relation occurs on account of the elements of the relation itself. Something is just when it contributes to the develop¬ment of the recipient of an act realizing that which is just. At the same time, the realization of that which is just is a good for the agent. In the analysis of the just two types of relation are revealed: the relation of due-to-recipient occurring on account of the compatibility of that which is due, with the recipient of the act; and - a "superstructure" - a relation of obligation-of-subject occurring on account of the compatibility of the acting subject with the thing which should be done. The basis for being that which is due is formed by various potentialities of development of man - the recipient of agency; the basis of being that which is an obligation is the possibility of development of the subject of action. Aristotle distinguishes various types of freedom and points to the necessity of taking them into account in the discussion of justice. Among other things, as the core of man's freedom, he considers life for its own sake, which can be seen as his expression of the basic indices of the autotelic character of man - which is funda¬mental for later conceptions of dignity. The freedom which is described by him is not, however, inherent and inalienable; being free is conditioned by a factual possi¬bility of undertaking actions, which are not solely means to the realization of aims set by others. Thomas Aquinas takes over the Aristotelian research perspective both in his conception of man and of law. At the same time, however, he significantly enriches it. In anthropology he develops a conception of personal being. Drawing upon his distinction between existence ("that something is") and essence ("what something is"), he sees the basis for being a person in the dignity of personal being which is a certain way of existence of a rational being more perfect than that of non-personal beings. The person is a being which, by virtue of its act of existence, is individual¬ized in a specific way. It is an aim in itself. Expressing it in a negative way, one may say that it does not exist as a means for the realization of the aims of others and, in this sense, that it is free. As distinct from Aristotelian conclusions, being a person is not conditioned by the specific actions of a being. Dignity is inherent, based on that which is the foundation of the factual existence of every rational being. Although freedom requires that a being is rational, dignity still encompasses all being, all its properties and potentialities. Thus an act conforming with dignity has to take into account a whole human being. Among different types of that which is just, ius, the first place, from the point of view of understanding law, falls to "the just thing itself ("ipsa res justa"), which is right in the full meaning of the word. On the one hand, it is that which is due; on the other hand, it determines the way of acting in the utmost degree, since the course of every act is determined in the fullest extent by its aim. The content of ius may be determined both by elements independent of free decisions - ius naturale - and by free decisions taking into account the state of things - ius positivum. Recognition of the objective structure of being as the basis of law does not entail that it is possible or desirable to determine unequivocally "the only right" patterns of conduct. This concept is very well justified within the system proposed by Saint Thomas. Individualization of being is a significant element of the develop¬ment of a person as a person. It is attained by the realization of individual aims which are not unequivocally determined by circumstances and the nature common to all people. By virtue of free choices made in the sphere of that which is not by its nature unjust, the object of action becomes ius. Since in the realization of the person the individualization of human being is central, Aquinas clearly sees the need for the protection of the sphere of "dominion of will". This sphere itself constitutes ius naturale, something which is due to man independently of the acts of will. Therefore "law should forbid nothing which is not unjust" ("nihil debet lege prohiberi quod licite fieri potest", In 3 Sent., dist. 40, q. I, a. 1, 3). Besides the relation of due-to-recipient, ius also includes the relation of obligation-of-subject which is superimposed on the relation of due-to-recipient. As far as the ontic foundations of obligation are concerned, in explaining why man is subordinated to realization of the good of others, Aquinas generally follows Aristotle in accepting that this basis is the subordination to moral good - to actions conforming with the learned truth about reality. Aquinas' systemic solutions allow, however, to reach deeper and understand why moral development is also a development of the whole human being. This was difficult within Aristotle's system, since he was reluc¬tant to decide whether precedence should be given to intellectual or moral develop¬ment. The inclination to realise good of another appears to be a transcendental characteristic of being, based on its very existence. Morality understood as rational and free subordination to realize the good of another is a specifically personal way of the realization of this inclination. Thus just actions contribute to the actualization of being in the aspect of its existence and therefore to the actualization of being as a whole. Thomas' conception of natural law (lex naturalis) as participation in eternal law (lex aeterna), offers possibilities for grasping that which is just as something which is basically accessible cognition, independently of Revelation and independently of faith in God, and at the same time as something based in eternal law, understood as a design of God's wisdom. Eternal law, embracing all particular actions, is not, from the human perspective, accessible cognition directly. It is enacted in the struc-ture of the created being and - in case of human beings - in free choices taking this structure into account. In the concluding remarks, the results obtained earlier are applied directly to the contemporary conception of human rights. Human rights are understood in the first place as "just things" - concrete goods of man; as that which is due because of subordination, based on dignity, to the personal development of man. That which is just is understood as a relational - actual or potential - state of things, which exists by virtue of existing relations. Evaluations referring to that which is right are true when respective relations of due-to-recipient take place; norms of conduct are true when respective relations of obligation-of-subject take place. Examples of the application of the sketched theory outside the field of human rights are also presented. Procedural consequences of the developed theory are shown, such as the discrimination of two types of legislative procedures which differ significantly in the structure of argumentation: the first aims at recognition of that which is just independently of the will of the legislator, and the second, at making individual or collective "projects" of development compatible. Finally the possibilities of applying the theory to the increasingly important problems of the protection of the environment and the "rights" of animals are mentioned. The central issue is a philosophical conception of man and his freedom and a conception of law. It is also indispensable to turn to a general theory of being. The search for a comprehensive theory of human rights requires attention to the Abso¬lute Being - God - as well. This is important for at least two reasons. First, a conception of the Absolute Being is integral to philosophy of the systemic type -of which the present book is a piece. A conception of the Absolute Being is signifi¬cant for understanding all being, including, first of all, man as a personal being. Second, every theory of human rights which does not comprise the problem of the Absolute may be questioned as to whether solutions adopted in it do not lead, in consequence, to eliminating God from the perspective of the understanding of law. It is desirable that a philosophical theory should deal with this problem directly. A theory which eliminates God from the perspective of the understanding of rights will be unacceptable for all those who, for philosophical reasons or relying on faith, consider God as the author of inherent rights. Nevertheless, a theoretical approach to rights from the perspective of the Absolute Being should only be a possible extension of a philosophical approach which bases rights on something which is cognizable independently of the acceptance of the existence of God so that the theory is also acceptable for those who reject the existence of God or suspend their judgment on this subject. The pursued theory should therefore contain, on the one hand, reference to natural, faith-independent foundations of human rights, but on the other hand, point to a possible extension accounting for the Absolute Being. The analyses contained in this chapter have undoubtedly some historical value since they are based on source texts. Nevertheless, the use of these texts and not critical works was dictated, first of all, by a conviction that analyses embrace a given theory in the aspect selected by the interests of the researcher. Therefore to find out what past thinkers say on the subject characterized in the first part it is simpler to reach to the sources than to adopt the existing critical works. The pre¬sented reconstruction of Aquinas' views on philosophy of law incorporates proposi¬tions of supplementing and developing some of the ideas undertaken by him. Obligation to act in this and not an other way arises because human actions are subordinated to the conformity, on the one hand, of aims realized by these actions and, on the one hand, the order of being determining that which is favourable to man or destroys him. The content of the order of being is, on the one hand, determined by the structure of being independent from man's will and, on the other, by free decisions of man. (shrink)

Through the writings for this volume and the extant literature, we observe a shift in the justice tectonic plates; a different Zeitgeist. It relates to how you and I view, pursue, achieve and indeed want to experience justice at the inter-personal, inter-community and inter-state levels. The role of restorative justice in praxis is being explored. This book deconstructed the restorative justice concept through normative analysis of current debates and phenomena. The Epilogue is an ambitious attempt to reconstruct (...) restorative justice philosophy. There is a widely accepted distinction between being directly responsible for a wrongdoing versus being somehow indirectly or vicariously responsible for the wrongdoing of another person or collective. Often this is couched in analyses of complicity, and complicity’s role in the relationship between individual and collective wrongdoing. Complicity is important because, inter alia, it allows us to make sense of individuals who may be blameless or blameworthy to a relatively low degree for their immediate conduct, but are nevertheless blameworthy (...) to a higher degree for their implication in some larger (or another person’s) wrongdoing. In this paper, I argue that there is a distinctively epistemic kind of complicity. First, I motivate the distinction between direct and vicarious responsibility with three interlocking arguments, respectively appealing to: i) the structure of rational agency; ii) linguistic considerations; iii) the role of “principal vs. accomplice” in legal doctrine. I show how these arguments naturally extend to the epistemic domain, motivating an epistemic form of vicarious responsibility. I then examine complicity as a mechanism of vicarious epistemic responsibility. To fill this out, I engage with an epistemic analogue of the debate about the role of intention versus causal contribution in complicity. I propose a Casual Account of Epistemic Complicity, arguing that it accommodates a wide range of cases, and enables fine-grained explanations of degrees of culpability for epistemic complicity. With an adequate account of epistemic complicity on hand, we can explain what is objectionable about an important class of epistemic agent who, on an individual level, may be epistemically blameless or blameworthy to a relatively low degree, but whose relation to other individuals or collectives nevertheless makes them epistemically blameworthy to a higher degree. This article provides an exposition of restorative justice ethics, briefly explaining how and why its relational constitution enables it to comprise a theory of justice. I then describe how that relational constitution permits it to overlap, and work in tandem, with a wide range of religious and philosophical traditions. Numerous writings in religion and peacebuilding explore the roles that restorative justice has played in transitional justice contexts (Tutu 2000, Abu-Nimer 2001, de Gruchy 2002, Biggar 2003, Walker 2004, Villa-Vicencio 2009). Less (...) examined are cases in which restorative justice aims to provide a sustainable alternative to justice institutions and systems that generate substantial systemic injustices—what peace studies scholars describe as the inter-lacing of structural, cultural, and direct forms of violence (Springs 2015). In part two, then, I make the case that intervening in, and countering, structural and cultural violence, and systemic injustices, is conceptually intrinsic to restorative justice. Moreover, this opens possibilities for restorative justice to present sustainable alternatives to—and work to transform— structural violence occurring in retributive justice systems. Restorative justice can uniquely intervene in these ways, I argue, because of the form of moral and spiritual association its relational constitution engenders. As a test case, I briefly examine its capacity to intervene in the justice system that perhaps leads the world in the levels of structural and cultural violence—the United States. (shrink)

: ‘Ecological civilization’ has been put forward as a utopia, as this notion has been defended by Ernst Bloch and Paul Ricoeur. It is a vision of the future that puts into question that which presently exists, revealing its contingency while offering an inspiring image of the future that can mobilize people to create this future. Ecological civilization is a vision based on ecological thinking, seeing all life as interdependent communities of communities. Humanity’s place in nature is redefined as participating (...) in communities, both human and non-human, including the global ecosystem. From this perspective, the end of life in both ethics and politics should be to augment life through augmenting the conditions for life, that is, through ‘ecopoiesis’ or ‘home-making’. What is involved in this has been clarified by work in biosemiotics and biohermeneutics where life is identified with semiosis, the production and interpretation of signs. Advancing biosemiotics and biohermeneutics, I will argue that living processes can be understood as proto-narratives organizing living processes to advance the conditions for life. They are inchoate in Ricoeur’s sense because they are not reflectively formulated as such but are being lived out. Developing our understanding of the world involves understanding these inter-related proto-narratives, including the proto-narrative that has operated in the creation of the biosphere and semiosphere, and recognizing the potential of human culture as part of this semiosphere to make explicit and re-emplot these proto-narratives. Most importantly, it is to make explicit and further develop the proto-narrative of the global ecosystem to augment the conditions for life. This will involve articulating a new grand narrative of not only humanity but of terrestrial life, orienting human communities at all levels to create and sustain a global ecological civilization. Gender, sexuality and embodiment in digital spheres have been increasingly studied from various critical perspectives: From research highlighting the articulation of intimacies, desires, and sexualities in and through digital spaces to theoretical explorations of materiality in the digital realm. With such a high level of (inter)disciplinarity, theories, methods, and analyses of gender, sexuality, and embodiment in relation to digital spheres have become highly diversified. Aiming to reflect this diversity, this special issue brings together innovative and newly developed theoretical, (...) empirical, analytical, and critical approaches in the study of gender, sexuality, and embodiment in digital spheres. By connecting intersectionality and digitality to one another, it adopts an integrated approach that reflects the intricacy and interconnectedness of social categories and markers of difference, privilege, performance, and discrimination. The contributions explore a range of differently situated digital cultural practices, including intimate and sexual experiences with(in) digital media, online self-presentation, expressions of digital resistance, and forms of backlash and online attacks. What connects all these articles, is their critical approach to intersectional inequalities and privileges in relation to digitality, plus their nuanced perspective on gender, sexuality, and embodiment interferentially. The final article is based on a roundtable discussion and aims to encourage interdisciplinary connections and suggests ways of doing research that builds bridges between academia and activism. The principle of common but differentiated responsibilities is a key principle in inter- national climate and environmental governance. This paper explores the normative impli- cations of the differentiation of responsibilities. I explain how responsibility as a four-digit relation can be used to reconstruct the complex networks of responsibilities in climate and environmental governance. I argue that depending on the area, governance level and concrete case of climate and environmental governance, other or differently specified norms become relevant for the (...) differentiation of responsibilities. However, I show that the attribution of responsibility must always consider the actors’ ability for responsibility. I argue that it is not only the fairness of the attribution of responsibilities that matters, but the capacity for responsibility of the relevant agents and their dependence on networks and institutions of responsibility. A recent panel at the annual meetings of the American Society for Aesthetics had the title “Can films philosophize?” The answer is, obviously, no, if we take this question literally. But books can’t philosophize either, in this sense. People philosophize, and they generally use natural language as the medium in which they carry out this activity. So our question is, can film serve as a philosophical medium in the ways, or in some of the ways, that language does? To answer (...) this question, we must first ask in what ways language functions as a philosophical medium. At a very general level, the answer to this question is fairly straightforward, if uninteresting. Language functions as a philosophical medium in that we use language to identify, articulate, clarify, and inter-relate what are viewed as philosophical issues, and to deepen our understanding of these issues and of the things that others say about them. What we take to be the significant philosophical issues, however, and what we take to be a contribution to deepening our understanding of these issues, may differ according to the philosophical tradition in which we work. If, for example, we think that the most fundamental philosophical issue is asking the question of Being, then our judgment as to when the linguistic medium is being used to ‘do philosophy’ is likely to differ substantially from the judgment we would make if we think that philosophers are best occupied analyzing everyday discourse or tending the separate gardens of the sciences. This paper presents a contemporary empirical test of a restricted class of observer-dependent information cosmologies—views on which large-scale informational structures (meanings, semantic clusters, conceptual organizations) are generated, collapsed, or reconfigured differently for each individual observer. I construct a distinctive recursive conceptual fingerprint, inject it into the public information ecosystem, and compare its retrieval across independent observers, platforms, and semantic engines. The resulting behavior of search systems, language models, and academic indexes shows that, at the level of the public information (...) layer, semantic structure is stable, shared, and mechanically organized rather than personalized or observer-generated. -/- I argue that this cross-observer semantic invariance constrains informational solipsism and related subjectivist models, at least in this domain: instead of collapsing into private hallucinations, the public semantic field exhibits attractor-like stability, recursive fidelity, and inter-observer invariance. I propose that this can be usefully described as a form of external recursion—a dynamical information system in which meaning persists and stabilizes outside any particular mind. The analysis is explicitly scoped: it concerns information-access reality, not qualia or physical ontology. Within that scope, the results support a mechanistic, Φ-recursive identity framework and challenge strong claims that individual consciousness “generates” informational reality on demand. (shrink)

Background Analysis of aphasic narratives can be a challenge for clinicians. Previous studies have mainly employed measures that categorized speech samples at the word level. They included quantification of the use and misuse of different word classes, presence and absence of narrative contents and errors, paraphasias, and perseverations, as well as morphological structures and errors within a narrative. In other words, a great amount of research has been conducted in the aphasiology literature focusing on micro-linguistic structures of oral narratives. (...) Aspects of macro- linguistic structures, such as the analysis of content information by a speaker, consistency of using cohesive devices to present information within a narrative, and order of presenting information necessary to form a coherent discourse, have not been extensively investigated. The current investigation proposes a clinical analytic system to target three aspects of macro-linguistic structures in narratives among speakers with aphasia. Specifically, (1) the presence of search events (i.e., the mentioning of key events that allow the listener to understand; Capilouto, Wright, &Wagovich, 2006) within a narrative, (2) the sequence of the mentioned events, and (3) the informativeness (i.e., the fulfillment of lexical items that allow the user to understand what the event is detailing) of the event contents, were focused in the proposed framework. Method Ten controls transcripts from were selected from the AphasiaBank (MacWhinney, Fromm, Forbes, & Holland, 2011). Three narrative tasks, including sequential picture description of ‘Refused Umbrella’, procedural narrative of making a ‘Peanut Butter and Jelly Sandwich’, and telling of ‘Cinderella’ story, were used to establish normative data for the basis of analysis. Specifically, the Search Events (e) and Informative Words (i) used by at least 70% of the speakers were listed for each genre. The sequential order of mentioning the Search Events, i.e., common order of events in 90% of the speakers, (s.total) was determined. Twelve speakers with aphasia (nine fluent and three non-fluent) were recruited and administered the Western Aphasia Battery and Object and Action Naming Battery. Their performance in the above three discourse tasks were orthographically transcribed and analyzed using the following measures: e.total, e.matched with norm, e.missed, e.irrlevant, e.extra, s.total, i.pb&j, i.umbr, i.cind, and i.total. Three samples were randomly chosen to be re-analyzed for inter- and intra-rater reliability. Results Results of an independent t-test suggested significant differences between the fluent and non-fluent subjects in sequential order of Search Events for all genres (s.total) and i.total, suggesting sensitivity of this framework to differentiate between the two fluency groups. Results of Pearson product-moment correlations revealed significant relation between Informative Words and WAB spontaneous speech scores, AQ, as well as OAB scores, for both aphasic groups. The mean value of coefficients for intra-rater reliability (0.992), with significant correlations on e.match, e.miss, and e.extra, was higher than that of inter-rater reliability (0.897). Discussion Based on our preliminary results, this objective framework allowed clinical evaluation of impairment in macro-linguistic structures present in aphasic discourse. Further extension should involve more subjects encompassing a wider range of severity with different types of aphasia. (shrink)

In a world of partially overlapping and partially conflicting interests there is good reason to doubt that self-seeking behaviour at the micro-level will spontaneously lead to desirable social outcomes at the macro-level. Nevertheless, some sophisticated economic writers advocating a laissez-faire policy prescription have proposed various 'invisible hand' mechanisms which can supposedly be relied upon to 'educe good from ill'. Smith defended the 'simple system of natural liberty' as giving the greatest scope to the unfolding of God's will and (...) the working out of 'natural' providential processes free of interference by 'artificial' state intervention - the expression not of divine order but of fallible human reason. Hayek, adopting a similar policy stance, based it in an evolutionary process in which those institutional forms best adapted to reconciling individual interests would, he believed, spontaneously be selected for in the inter-group struggle for survival. Keynes shares the holistic approach of Smith and Hayek, but without their reliance on invisible hand mechanisms. If spontaneous processes cannot be relied upon to generate desirable social outcomes then we have to take responsibility for achieving this ourselves by establishing the appropriate institutional framework. Keynes takes a historical view of the role of capitalism and analyses its pathology as rooted in what we would now refer to as a multi-player prisoners' dilemma. The paper draws out the significance of his methodological standpoint here. Keynes's policy standpoint assigns a critical role to his own class, the 'educated bourgeoisie' in the reform process he maps out. A distinction, but also an intimate connection, is highlighted between, on the one hand, micro-level individualism (the 'Manchester System, and, on the other, the macro-level collective action ('planning') required to preserve it. Finally Keynes is considered in relation to the themes of laissez-faire, holism, reductionism, providentialism and the invisible hand. (shrink)

Arthur Kaufmann is one of the most prominent figures among the contemporary philosophers of law in German speaking countries. For many years he was a director of the Institute of Philosophy of Law and Computer Sciences for Law at the University in Munich. Presently, he is a retired professor of this university. Rare in the contemporary legal thought, Arthur Kaufmann's philosophy of law is one with the highest ambitions — it aspires to pinpoint the ultimate foundations of law by explicitly (...) proposing an ontology, a general theory of knowledge and concept of a person. Kaufmann's work derives, first of all, from the thinking of Gustav Radburch, his teacher, and then from ideas of Karl Engish and Hans-Georg Gadamer. The philosophy undertakes to pursue the ultimate foundation of law, law which is understood by Kaufmann, first of all, as a "concrete judgement" that is, what is right in a concrete situation. Justice belongs to the essence of law and "unjust law" is contradictio in adiectio. Kaufmann opposes all those theories, which as the only foundation for establishing just law (Recht) adopt legal norms (Gesetz). In Kaufmann's opinion , such theories are powerless in the face of all types of distortions of law rendered by political forces. He suggests that the basic phenomenon which needs to be explained and which cannot be disregarded by a philosopher of law is so-called "legal lawlessness" ("Gestzliches Unrecht"). "Legal lawlessness" which forms a part of life experience for the people of twentieth century totalitarian states. It proved "with the accuracy of scientific experiment" that the reality of law consists of something more than bare conformity with legal norms. The existence of lex corrupta indicates that law contains something "non-dispositive" which requires acknowledgment of both law-maker and judge. Kaufmann, accepting the convergent concept of truth and cognition, assumes that "non-dispositive" content, emerging as the conformity of a number of cognitive acts of different subjects (inter-subjective communicativeness and verifiability), indicates the presence of being in this cognition. The questions "What is law?" and "What are the principles of a just solution?" lead straight to the ontology of law, to the question about the ontological foundations of law. Kaufmann discerns the ontological foundations of law in the specifically understood "nature of things" and, ultimately, in a "person". He proposes a procedural theory of justice, founded on a "person". In my work, I undertake to reconstruct the train of thought which led Kaufmann to the recognition of a "person" as the ontological foundation of law. In the first part, the conception of philosophy adopted by Kaufmann, initial characteristics of law — of reality which is the subject of analysis, as well as, the requirements for proper philosophical explanation of law posed by Kaufmann are introduced. In the second, Kaufmann's reconstruction of the process of the realisation of law is presented. Next, the conception of analogy which Kaufmann uses when explaining law is analyzed. In the fourth part, Kaufmann's conception of ontological foundations of law is discussed. A critical analysis is carried out in which I demonstrate that the theory of the ontological foundation of law proposed by Kaufmann and the concept of a person included in it do not allow a satisfac¬tory explanation of the phenomenon of "legal lawlessness" and lead to a number of difficulties in the philosophical explanation of law. Finally, the perspectives of a proper formulation of the issue of the ontological foundations of law are drafted in the context of the analyzed theory. My interest is centered on the conception of philosophy adopted by Kaufmann, according to which the existence of the reality is inferred on the basis of a certain configuration of the content of consciousness, whereas at the point of departure of philosophy of law, the data to be explained is a certain process, which is, basically, a process of cognition, while the reality appears only as a condition for the possibility of the occurrence of the process. I wish to argue that the difficulties which appear in the explanation of law are a consequence of the assumed fundamental philosophical solu¬tions, which seem to be characteristic, though usually not assumed explicitly, in philoso¬phy and theory of law dominant at present in continental Europe. Thereby, I wish to show the significance of ontological and epistemological solutions to the possibility of a proper formulation of the problems posed by philosophy and theory of law. Kaufmann proclaims himself in favour of a philosophy which poses questions about the ultimate foundations of understanding of the reality. In epistemology, he assumes that answers to the questions "What is reality like?" and ultimately "What is real?" are inferred on the basis of uniformity of a cognitive acts of different subjects. Cognition of the reality is accomplished exclusively through the content of conceptual material. The two fundamental questions posed by philosophy of law are "What is just law?" and "How is the just law enacted?" The latter is a question about the process of achieving a solution to a concrete case. Since, in Kaufmann's opinion, law does not exist apart from the process of its realisation, an answer to the question about the manner of realisation of law is of fundamental significance to answering the question: "What is law?" and to the explanation of the question about the ontological grounding of law, which is, as well, the foundation of justice. The proper solution has to take into account the moment of "non-dispositive" content of law; its positiveness understood as the reality and, at the same time, it has to point to the principles of the historical transformation of the content. Law, in the primary meaning of the word, always pertains, in Kaufmann's opinion, to a concrete case. A legal norm is solely the "possibility" of law and the entirely real law is ipsa res iusta, that which is just in a given situation. Determination of what is just takes place in a certain type of process performed by a judge (or by man confronted with a choice). Kaufmann aims to reconstruct this process. A question about the ontological foundation of law is a question about the ontological foundations of this process. In the analyzed theory it is formulated as a question about the transcendental conditions, necessary for the possibility of the occurrence of the process: how the reality should be thought to make possible the reconstructed process of the realisation of law. Kaufmann rejects the model for finding a concrete solution based on simple subsump¬tion and proposes a model in which concrete law ensues, based on inference by analogy, through the process of "bringing to conformity" that which is normative with that which is factual. Kaufmann distinguishes three levels in the process of the realisation of law. On the highest level, there are the fundamental legal principles, on the second legal norms, on the third — concrete solutions. The fundamental principles of law are general inasmuch as they cannot be "applied" directly to concrete conditions of life, however, they play an important part in establishing norms. A judge encounters a concrete situation and a system of legal norms. A life situation and norms are situated on inherently different levels of factuality and normativeness. In order to acquire a definite law both a norm (system of norms) and a life situation (Lebenssachverhalt) should undergo a kind of "treatment" which would allow a mutual conformity to be brought to them. Legal norms and definite conditions of life come together in the process of analogical inference in which the "factual state" ("Tatbestand") — which represents a norm, and in the "state of things" ("Sachverhalt") — which represents a specific situation are constructed. A "factual state" is a sense interpreted from a norm with respect to specific conditions of life. The "state of things" is a sense constructed on the basis of concrete conditions of life with respect to norms (system of norms). Legal norms and concrete conditions of life meet in one common sense established during the process of realisation of law. Mutatis mutandis the same refers to the process of composition of legal norms: as the acquisition of concrete law consists in a mutual "synchronization" of norms and concrete conditions of life, so acquisition of legal norms consists of bringing to conformity fundamental principles and possible conditions of life. According to Kaufmann, both of these processes are based on inference through analogy. As this inference is the heart of these processes it is simultaneously a foundation finding just law and justice. How does Kaufmann understand such an inference? As the basis for all justice he assumes a specifically interpreted distributive justice grounded on proportionality. Equality of relations is required between life conditions and their normative qualification. Concrete conditions of life are ascribed normative qualification not through simple application of a general norm. More likely, when we look for a solution we go from one concrete normative qualified case to another, through already known "applications" of norms to a new "application". The relation between life conditions and their normative qualifica¬tion has to be proportional to other, earlier or possible (thought of) assignments of that which is factual to that which is normative. Law as a whole does not consist of a set of norms, but only of a unity of relations. Since law is a, based on proportion, relative unity of a norm and conditions of life, in order to explain law in philosophical manner, the question about ontological base of this unity has to be asked. What is it that makes the relation between a norm and conditions of life "non-dispositive"? What is the basis for such an interpretation of a norm and case which makes it possible to bring a norm and conditions of life into mutual "conformity"? This is a question about a third thing (next to norms and conditions of life), with respect to which the relative identity between a norm and conditions of life occurs, about the intermediary between that which is normative and that which is factual and which provides for the process of establishing of norms, as well as, finding solutions. It is the "sense" in which the idea of law or legal norm and conditions of life have to be identical to be brought to mutual "conformity". In Kaufmann's opinion such a sense is nothing else but the "nature of things" which determines the normative qualification of the reality. Since establishment of this "sense" appears to be "non-dispositive" and controlled inter-subjectively (namely, other subjects will reach a similar result) so, in conformity with the convergent concept of truth, the "nature of things" must be assigned a certain ontological status. According to Kaufmann this is a real relation which occurs between being and obligation, between the conditions of life and normative quality. However, it should be underlined that from the point of view of the analyzed system the "nature of things" is a correlate of constructed sense, a result of a construction which is based on the principle of consistent understanding of senses ("non-normative" and "normative") and is not a reality which is transcendent against the arrangement of senses. In Kaufmann's theory, inference from analogy appears to be a process of reshaping the concepts (senses) governed by tendency to understand the contents appearing in relations between that which is factual and that which is normative in a consistent way. The analogical structure of language (concepts) and recognition of being as composed of an essence and existence is an indispensable requirement for the possibility of the realisation of law, based on specifically understood inference from analogy. It is necessary to assume a moment of existence without content which ensures unity of cognition. Existence emerges thus as a condition of the possibility of cognition. According to Kaufmann, the "nature of things" is the heart of inference through analogy and the basis for establishment of finding of law. Inference from the "state of things" to a norm or from a norm to the "state of things" always means inference through the "nature of things". The "nature of things" is the proper medium of objective legal sense sought in every cognition of law. In Kaufmann's view, the question whether the "nature of things" is ultima ratio of interpretation of law or is only a means of supplement gaps in law or whether it is one of the sources of law, is posed wrongly. The "nature of things" serves neither to supplement the gaps nor is it a source of law as, for example, a legal norm may be. It is a certain kind of "catalyst" necessary in every act of making law and solving a concrete case. Owing to "nature of things" it is possible to bring to a mutual conformity the idea of law and possible conditions of life or legal norms and concrete conditions of life. In Kaufmann's conception the "nature of things" is not yet the ultimate basis for understanding the "non-dispositiveness" of law. The relation between obligation and being is determined in the process of the realisation of law. Both the process itself and that which is transformed in this process are given. A question about the ontological bases of "material" contents undergoing "treatment" in the process of the realisation of law and about being which is the basis of regularity of the occurrence of the process arises. Only this will allow an explanation that the result of the process is not optional. Thus, a question about reality to which law refers and about the subject realising the law has to be formed. To this, Kaufmann gives the following answer: that which is missing is man but not "empirical man" but man as a "person". A "person" understood as a set of relations between man and other people and things. A "person" is the intermediary between those things which are different — norm and case are brought to conformity. A "person" is that which is given and permanent in the process of the realisation of law. It determines the content of law, is "subject" of law; this aspect is described by Kaufmann as the "what" of the process of realisation of law. A "person" consists of precisely just these relations which undergo "treatment" in the process. On the other hand, a "person" is "a place" in which the processes of realisation of law occur, it is the "how" of normative discourse, a "person" is that which determines the procedure of the process, being "outside" of it. This aspect of a "person" is connected with the formal moment of law. A "person" being, at the same time, the "how" and the "what" of the process of the realisation of law, is also, to put it differently, a structural unity of relation and that which constitutes this relation (unity of relatio and relata). According to this approach a "person" is neither an object nor a subject. It exists only "in between". It is not substance. Law is the relation between being and obligation. That which is obligatory is connected with that which is general. That which is general does not exist on its own, it is not completely real. Accordingly, a "person" as such is also not real. It is relational, dynamic and historical. A "person" is not a state but an event. In Kaufmann's opinion, such a concept of a "person" helps to avoid the difficulties connected with the fungibility of law in classical legal positivism. A "person" is that which is given, which is not at free disposal and secures the moment of "non-dispositiveness" of law. Kaufmann concludes: "The idea (»nature«) of law is either the idea of a personal man or is nothing". Theory points at the structure of realising law and explains the process of adoption of general legal norms for a concrete situation. The analysis has shown however, that in this theory a satisfactory answer to the question about the ultimate foundations of law is not given. It seems that in the analyzed theory the understanding of human being takes place through understanding of law. What is good for man as a "person", what is just, what a "person" deserves may be determined only against the existing system of law. A "per¬son" adopted as a basis of law is the reality postulated in the analysis of the process of the realisation of law. It is a condition of possibility of this process ( explaining, on one hand, its unity and, on the other hand, the non-dispositive moments stated in this process). A "person" in the discussed theory is entirely defined by the structure of law, it can be nothing more than that which is given in law, what law refers to, what law is about. Being, which is a "person", is constituted by relations between people and objects, the relations which are based on fundamental links between norms and conditions of life established in a process of bringing them to conformity. It has to be assumed that man as a "person" is a subject of law only as far as realising law "treats" given senses according to their current configuration. The system of law is a starting point and it describes in content what man is as a "person". Moreover, being a "person" is the condition for entering legal relations. Consistently, Kaufmann writes that "empirical man" is not the subject of law, man is not "out of nature" a "person". People become "persons" due to the fact that they acknowledge each other as "persons" — acknowledging, at the same time, law. This acknowledgement is a con¬dition of existence, of the possibility of the occurrence of process of realisation of law and of constituting legal relations which ultimately constitute a "person". Kaufmann assumes, that law tends towards a moral aim: it may and must create an external freedom, without which the internal freedom to fulfil moral obligations cannot develop. However, this postulate is not based on the necessary structure of human being. From the point of view of his system, it is nothing more than only a condition for the possibility of the occurrence of the process of the realisation of law — lack of freedom would destroy the "how" of this process. Thus, the postulate to protect the freedom of personal acts has to be interpreted, in accordance with the analyzed theory, as a postulate, the fulfilment of which aims ultimately at the accomplishment of the very same process of realisation of law itself and not the realisation of a given man. Kaufmann considers a "person" to be an element which unites the system of law as a whole. Law is a structure of relations, which are interdependent and inter-contingent. Consequently, a "person" which is to form the ontological basis of law has to be entity consisting of all relations. Being also the "how" of the process of realisation of law, if a "person" is to warrant its unity, it has to be a common source for all procedures. Hence, a single "person" would constitute a subject of law. Man appears to be only a moment of a certain entirety, realisation of which should be an aim of his actions. Law, creating a "person" as an object and subject of law becomes a primary entity. In the analyzed theory, the basis for determination of aims which law sets to man is not the allocation of man-subject to something which improves him but rather, such relation is only just constituted by law. A question appears, why should aims set in law also be the aims of "empirical man"? Why is this "empirical man" to be punished in the name of a "person" understood in such a way? If, however, it is assumed that what is man is determined by a system which is superior to him, then man has to be understood only as a part of a whole and there are no grounds to prohibit istrumental treatment of man and so the road to all aspects of totalitarianism might be opened. A problem of the application of created theory to the reality arises, the reality which the theory pretends to explain. Ultimately in his theory Kaufmann does not give any systemic grounds for a radical questioning of the validity of any legal norms. Every new norm becomes an equal part of system of norms. It is only its interpretation and application to given conditions of life that may be disputable, however, this refers to all norms without exception. Cohesive inter-pretation of norms and applications is necessary and sufficient for the acquisition of just law. New norms have to be interpreted in the light of others, correspondingly, the other norms require reinterpretation in the light of the new ones. Contradiction in interpretation of a norm does not form a basis for questioning norms but may serve only to question the manner of their interpretation (understanding). Therefore, no grounds exist to assume any legal norm as criminal or unjust, and in consequence, to question any consistently realised system based on formally, properly established norms, as "legal lawlessness". As law and a "person" do not exist without the process of realisation of law, the role of legal safety becomes crucial as the condition for the possibility of the occurrence of the process of realisation of law. Denying legal safety would be tantamount to negation of law in general (also of moral law) as negation of safety takes away, at the same time, the basis for occurrence of the process of realisation of law. Moreover, any lack of legal safety would also mean lack of a basis for the existence of man as a "person". Kaufmann's thesis, that civil disobedience is legalized only when it has a chance to lead to success, consistent with his concept of the foundations of law, seems to point directly to conclusions which deny the facts taken under consideration and doubtlessly Kaufmann's own intentions, since it would have to be assumed that accordingly there are no grounds to question a legal system in force based on violence which secures its operation. Force finally seems to determine which one of the mutually irreconcilable normative systems constitute law and which does not. A legitimate position is one which leads to success, it is the weaker system which is negated. If so, then basically violent imposition of law is not an act directed against the law in force but, to the contrary, realisation of law. In the context of the new system the former system of law may be talked about as unjust solely in the sense of being incapable of being consistently united with the new. However, at the base, ultimately, lies force which reaffirms differences and excludes from the process of realisation of law certain norms and their interpretations. Kaufmann was aiming at grounding of that which is "non-dispositive" in a certain given framework of interpretation. Nevertheless, he does not provide foundations for the understanding of phenomena, which he undertakes to explain at a point of departure. Instead of explaining them the theory negates the possibility of their existence. The reality postulated in regard to "non-dispositive" moments of the reconstructed process of acquiring law consist of a specifically understood "person", which appears in Kaufmann's conceptions as a condition of the possibility of the realisation of law. According to this approach understanding of a "person" may be only a function of law. To understand "legal lawlessness" and foundations of justice it is necessary to look for such theory of law in which understanding of man as a "person" and being is not a function of understanding of law (in which a "person" is not only a condition for possibility of reconstructed process of realisation of law; for possibility of cognition processes). It seems necessary to start from theory of being and a "person" based on broader experience than the one assumed by Kaufmann and reconstruct the ontological foundations of the process of realisation of law only in such perspective. Kaufmann points out that that to which law refers is ipsa res iusta a concrete relation of man to other people and things. This relation, in his theory, appears to be basically only just constituted by law (normative senses "applied" to conditions of life). Therefore, understanding the relation between a given man and other people and things which constitute the aim of his actions, that is understanding of good, is enacted against the background of constitution of senses; constitution which is a result of a process aiming towards consistent understanding of particular contents (of nor¬mative and non-normative senses). "Being" is secondary towards constructed senses it is only their correlate. The primary relation consists of relation of a man to law (system of norms), while the secondary relation is one of man to something which is the aim of his action (relation between man and good). Considering such approach it is difficult to envision a satisfying answer to the fundamental question: why does law put concrete man under any obligation to obey it? The source of this problem can be seen in reduction of the base for understanding good to content of obligation formulated in auto-reflection. Such reduction seems to be a consequence of Kaufmann's adoption of "convergent concept of truth" and in con¬sequence his recognition of indirect, essentialistic grasp of reality formulated in concepts as the basic and only foundation of theory of being and of law. In view of such an approach, analogy of law, concepts and being is the condition for the possibility of the process of transformation of senses which aims at consistent interpretation of all law. Existence is postulated with respect to the possibility of unity of experience and cognition. However, also a different approach to understanding of the problem of being and good is possible. In spontaneous cognition being is affirmed, first of all, not as a certain, non-contradictory, determined content, but as something existing. Together with a cer¬tain content (passed indirectly through notions) existence of being is co-given. The basis for unity of being is not formed by the consistence of content, as it is in the case of the theories departing from the analysis of cognition processes, but by an act of existence realising content (essence). Such an approach makes it also possible to go beyond the convergent concept of truth. It is worth mentioning that allocation of an agent to good is realised not only by the content of duty. A statement that something is good is primary with respect to determination of this good in content. The recognised good always bears some content, however, there are no reasons to base the concept of good exclusively on indirect, formulated in concepts cognition. As primary, can be adopted the relation of man to good and not of man to law. Determination in content appears to be only an articulation of aspectual cognition of being, as an object of action. In such a case the basis for relative unity of norm and conditions of life is not the "nature of things" understood as correlate of sense but it is relation to good based on internal constitution of man as potential, not self-sufficient being. It does not mean, that the moments of the process of realisation of law singled out by Kaufmann are not important to determination of what is just. He, quite rightly, points to significant role played by norms in the evaluation of concrete situations, in man's search for closer specification in content of good innate to him. The structure of process of determining law for a concrete situation, to a great degree corresponds to the processes of determining law which take place not only in the legal sciences. Kaufmann's analyses of the process of realisation of law show the complexity of the structure of these processes and point towards important moments allowing a better understanding of law and man. Nevertheless, these analyses cannot be a basis for construction of philosophical theory of law, theory which hopes to point out the ultimate, ontological foundations for understanding law. Kaufmann's results may become fully valid only in a more general perspective including broader experience at the point of departure. (shrink)

This paper underlines a few aspects of interactions between consciousness, light, energy and matter. I hypothesize that photons are condensed form of conscious ness like many other energy forms such as heat. The density of consciousness determine whether a certain density can interact with it or not. For example, a density as light as consciousness can interact with a content of similar density. That means thoughts which are of almost similar density to consciousness can actually interact with thoughts and consciousness. (...) It is true about physically assumed boundary only. In reality, the entire existence is continuum and there is no boundary. Boundary is an ignorance and in that ignorance, the rules mentioned above hold. But in continuum existence, the interaction is cascade based on varying density of consciousness. That means in continuum existence, the interaction is through cascade of continuum density of consciousness, i.e. thoughts can not interact directly with material, it interact with thoughts and then thoughts interact with next density level entity at sub-quantum levels fol lowed by quantum level transactions. Photons can interact with photon level density followed by inter-scale cascade transactions. This cascade is stamped well by quantum physics also. We also hypothesize that science is able to view the existence from unidirectional point, with a certain limited aspects of obser vation and thinking. Uniform multifaceted existence has to be looked at with far wider perspective in order to come close to reality of existence and truths related to it. Rules of thermodynamics such as monotonous increase in entropy hold only if observation is done from within the cosmos, at a time scale of our widest observation. But this will not be true from a time scale of singularity bursts. There net zero energy and net zero entry facts prevail. (shrink)

This paper examines the liberal society that Popper lauds, that aims to be truly open, and discusses why another, more communitarian kind of society, particularly societies in Africa, may also reflect the quest for intellectual openness that is Popper’s ideal. Moreover, this paper avers reasons why Popper should be comfortable with such a liberal-communitarian mix. The inter-subjectivity in his critical rationalism is a balance of an explicit individualism, and an implicit social element (Afisi, 2016a). Popper is indeed an author (...) of such a balance. For a society to be truly open requires the careful recognition and protection of individual freedom. However, the extent to which individuals are free to perform actions that they desire without external constraints, and the level of their individuality in relation to others when performing such actions, remain a contentious issue between liberals and more communitarian thinkers. Popper’s critical rationalism provides the necessary impetus to this contention through his view of freedom that I contend can best be viewed as carefully balanced, a view which combines individuality with a social element that upholds community values necessary for openness of society. With this combination, Popper’s politics of liberalism provides an effective model of how a truly open society can be achieved. The values inherent to Popper’s liberalism including those concerning intellectual openness, individual freedom, mutual respect, measured self-respect, welfarism, humanitarianism, accountability, critical debates and feedback from the citizens, together concern the conditions for a society to be truly open. There are many competing thoughts as to what openness might be in Popper’s philosophy. The present study of Popper does not presume to address them all. The focus here is specifically on using Popper’s idea of critical rationalism to balance relations between liberal politics of individual rights and freedom, and communitarian politics of the common good, as it relates to situations about how socio-economic and political conditions in Africa societies should be structured. While I contend that Popper’s works in political philosophy focused centrally on Western political tradition, and not about Africa in its strict sense, significant lessons can be distilled from Popper that can offer suggestions on social reforms in Africa. This paper explores Popper’s project of the open society across the plurality and differences of societies, so that his liberal ideas of individual freedom are not undermined, and the progress of the communitarian idea of the common good, that Africa societies are built upon, is also well enhanced. Liberal individualism and community values inherent to communitarianism are both well accommodated within Popper’s critical rationalism. (shrink)

● Sergio Cremaschi, The non-existing Island. The chapter discusses how the cleavage between the Continental and the Anglo-American philosophies originated, the (self-)images of both philosophical worlds, the converging rediscoveries from the Seventies, and recent ecumenic or anti-ecumenic strategies. I argue that pragmatism provides an important counter-instance to the familiar self-images and the fashionable ecumenic or anti-ecumenic strategies. The conclusions are: (i) the only place where Continental philosophy exists (as Euro-Communism one decade ago) is America; (ii) less obviously, also analytic philosophy (...) does not exist, or does no more exist as a current or a paradigm; what does exist is, on the one hand, philosophy of language and, on the other, philosophy of mind, that is, two disciplines; (iii) the dissolution of analytic philosophy as a school has been highly fruitful, precisely in so far as it has left room for disciplines and research programmes; (iv) what is left, of the Anglo-American/Continental cleavage is primarily differences in styles, depending partly on intellectual traditions, partly owing to sociology, history, institutional frameworks; these differences should not be blurred by rash ecumenism; besides, theoretical differences are alive as ever, but within both camps; finally, there is indeed a lag (not a difference) in the appropriation of intellectual techniques by most schools of 'Continental' philosophy, and this should be overcome through appropriation of what the best 'analytic' philosophers have produced. ● Michael Strauss, Language and sense-perception: an aspect of analytic philosophy. To test an assertion about one fact by comparing it with perceived reality seems quite unproblematic. But the very possibility of such a procedure is incompatible with the intellectualistic basis of logical positivism and atomism (as it is for example to be found in Russell's Analysis of Mind). According to the intellectualistic approach pure sensation is meaningless. Sensation receives its meaning and order from the intellect through interpretation, which is performed with the help of linguistic tools, i.e. words and sentences. Before being interpreted, sensation is not a picture or a representation, it is neither true nor false, neither an illusion nor knowledge; it does not tell us anything; it is a lifeless and order-less matter. But how can a thought (or a proposition) be compared with such a lifeless matter? This difficulty confronts the intellectualist, if on the one hand he admits the necessity of comparing thought with sense-perception, and on the other hand presupposes that we possess only intellectual and no immediate perceptual understanding of what we see and hear. In this paper I give a critical exposition of three attempts, made by Russell, Neurath and Wittgenstein, to solve this problem. The first attempt adheres to strict conventionalism, the second tends to naturalism and the third leads to an amended, very moderate version of conventionalism. This amended conventionalism looks at sense impressions as being a peculiar language, which includes primary symbols, i.e. symbols not founded on convention and not being in need of interpretation. ● Ernst Tugendhat, Phenomenology and language analysis. The paper, first published in German in 1970, by which Tugendhat gave a start to the German rediscovery of analytic philosophy. The author stages a confrontation between phenomenology and language analysis. He argues that language analysis does not differ from phenomenology as far as the topics dealt with are concerned; instead, both currents are quite different in method. The author argues that language-analytic philosophy does not simply lay out of the mainstream of transcendental philosophy, but that instead it challenges this tradition on the very level of foundations. The author criticizes the linguistic-analytic approach centred on the subject as well as any object-centred approach, while proposing inter-subjective understanding through language as the new universal framework. This is, when construed in so general terms, the same program of hermeneutics, though in a more basic version. ● Jürgen Habermas, Language game, intention and meaning. On a few suggestions by Sellars and Wittgenstein. The paper, first published in German in 1975, in which Habermas announces his own linguistic turn through a discovery of speech acts. In this essay the author wants to work out a categorical framework for a communicative theory of society; he takes Wittgenstein's concept of language game as a Leitfade and, besides, he takes advantage also of Wilfried Sellars's quasi-transcendental account of the genesis of intentionality. His goal is to single out the problems connected with a theory of consciousness oriented in a logical-linguistic sense. ● Zvie Bar-On, Isomorphism of speech acts and intentional states. This essay presents the problem of the formal relationship between speech acts and intentional states as an essential part of the perennial philosophical question of the relation between language and thought. I attempt to show how this problem had been dealt with by two prominent philosophers of different camps in our century, Edmund Husserl and John Searle. Both of them wrote extensively about the theory of intentionality. I point out an interesting, as it were unintended, continuity of their work on that theory. Searle started where Husserl left off 80 years earlier. Their meeting point could be used as the first clue in our search. They both adopted in effect the same distinction between two basic aspects of the intentional experience: its content or matter, and its quality or mode. Husserl did not yet have the concept of a speech act as contradistinguished from an intentional state. The working hypothesis, however, which he suggested, could be used as a second clue for the further elaboration of the theory. The relationship of the two levels, the mental and the linguistic, which remained for Husserl in the background only, became the cornerstone of Searle' s inquiry. He employed the speech act as the model and analysed the intentional experience by means of the conceptual apparatus of his own theory of speech acts. This procedure enabled him to mark out a number of parallelisms and correlations between the two levels. This procedure explains the phenomenon of the partial isomorphism of speech acts and intentional states. ● Roberta de Monticelli, Ontology. A dialogue among the linguistic philosopher, the naturalist, and the phenomenological philosopher. This paper proposes a comparison between two main ways of conceiving the role and scope of that fundamental part of philosophy (or of "first" philosophy) which is traditionally called "ontology". One way, originated within the analytic tradition, consists of two main streams, namely philosophy of language and (contemporary) philosophy of mind, the former yielding "reduced ontology" and the latter "neo-Aristotelian ontology". The other way of conceiving ontology is exemplified by "phenomenological ontology" (more precisely, the Husserlian, not the Heideggerian version). Ontology as a theory of reference ("reduced" ontology, or ontology as depending on semantics) is presented and justified on the basis of some classical thesis of traditional philosophy of language (from Frege to Quine). "Reduced ontology" is shown to be identifiable with one level of a traditional, Aristotelian ontology, namely the one which corresponds to one of the four "senses of being" listed in Aristotle's Metaphysics: "being" as "being true". This identification is justified on the basis of Franz Brentano's "rules for translation" of the Aristotelian table of judgements in terms of (positive and negative) existential judgments such as are easily translatable into sentences of first order predicate logic. The second part of the paper is concerned with "neo-Aristotelian ontology", i.e. with naturalism and physicalism as the main ontological options underlying most of contemporary discussion in the philosophy of mind. The qualification of such options as "neo-Aristotelian" is justified; the relationships between "neo-Aristotelian ontology" and "reduced ontology" are discussed. In the third part the fundamental tenet of "phenomenological ontology" is identified by the thesis that a logical theory of existence and being does capture a sense of "existing" and "being" which, even though not the basic one, is grounded in the basic one. An attempt is done of further clarifying this "more basic" sense of "being". An argument making use of this supposedly "more basic" sense is advanced in favour of a "phenomenological ontology". ● Kuno Lorenz, Analytic Roots in Dialogic Constructivism. Both in the Vienna Circle ad in Russell's early philosophy the division of knowledge into two kinds (or two levels), perceptual and conceptual, plays a vital role. Constructivism in philosophy, in trying to provide a pragmatic foundation - a knowing-how - to perceptual as well as conceptual competences, discovered that this is dependent on semiotic tools. Therefore, the "principle of method" had to be amended by the "principle of dialogue". Analytic philosophy being an heir of classical empiricism, conceptually grasping the "given", and constructive philosophy being an heir of classical rationalism, perceptually providing the "constructed", merge into dialogical constructivism, a contemporary development of ideas derived especially from the works of Charles S. Peirce (his pragmatic maxim as a means of giving meaning to signs) and of Ludwig Wittgenstein (his language games as tools of comparison for understanding ways of life). 7. Albrecht Wellmer, "Autonomy of meaning" and "principle of charity" from the viewpoint of the pragmatics of language. In this essay I present an interpretation of the principle of the autonomy of meaning and of the principle of charity, the two main principles of Davidson's semantic view of truth, showing how both principles may fit in a perspective dictated by the pragmatics of language. I argue that (I) the principle of the autonomy of meaning may be thoroughly reformulated in terms of the pragmatics of language, (ii) the principle of charity needs a supplement in terms of pragmatics of language in order to become really enlightening as a principle of interpretation. Besides, I argue that: (i) on the one hand, the fundamental thesis of Habermas on the pragmatic theory of meaning ("we understand a speech act when we know what makes it admissible") is correlated with the seemingly intentionalist thesis according to which we understand a speech act when we know what a speaker means; (ii) on the other hand, to say that the meaning competence of a competent speaker is basically a competence about a potential of reasons (or also of possible justifications) which is inherently connected with the meaning of statements, or with their use in utterances. ● Rüdiger Bubner, The convergence of analytic and hermeneutic philosophy This paper argues that the analytic philosophy does not exist, at least as understood by its original programs. Differences in the analytic camp have always been bigger than they were believed to be. Now these differences are coming to the fore thanks to a process of dissolution of dogmatism. Philosophical analysis is led by its own inner logic towards questions that may be fairly qualified as hermeneutic. Recent developments in analytic philosophy, e.g. Davidson, seem to indicate a growing convergence of themes between philosophical analysis and hermeneutics; thus, the familiar opposition of Anglo-Saxon and Continental philosophy might soon belong to history. The fact of an ongoing appropriation of analytical techniques by present-day German philosophers may provide a basis for a powerful argument for the unity of philosophizing, beyond its strained images privileging one technique of thinking and rejecting the remainder. Actual philosophical practice should take the dialogue between the two camps more seriously; in fact, the processes described so far are no danger to philosophical work. They may be a danger for parochial approaches to philosophizing; indeed, contrary to what happens in the natural sciences, Thomas Kuhn's "normal science" developing within the framework of one fixed paradigm is not typical for philosophical thinking. And in philosophy innovating revolutions are symptoms more of vitality than of crisis. ● Karl-Otto Apel, The impact of analytic philosophy on my intellectual biography. In my paper I try to reconstruct the history of my Auseinandersetzung mit - as I called it - "language-analytical" philosophy (including even Peircean semiotics) since the late Fifties. The heuristics of my study was predetermined by two main motives of my beginnings: the hermeneutic turn of phenomenology and the transformation of "transcendental philosophy" in the light of the "language a priori". Thus, I took issue with the early and the later Wittgenstein, logical positivism, and post-Wittgensteinian and post-empiricist philosophy of science (i.e. G.H. von Wright and the renewal of the "explanation vs understanding controversy" as well as the debate between Th. Kuhn and Popper/Lakatos); besides, with speech act theory and the debate about "transcendental arguments" since Strawson. The "pragmatic turn", started already by C.L. Morris and the later Carnap, led me to study also the relationship between Wittgensteinian "use" theory of meaning and of truth. This resulted on my side in something like a program of "transcendental semiotics", i.e. "transcendental pragmatics" and "transcendental hermeneutics". ● Ben-Ami Scharfstein, A doubt on both their houses: the blindness to non-western philosophies. The burden of my criticism is that contemporary European philosophers of all kinds have continued to think as if there were no true philosophy but that of the West. For the most part, the existentialists have been oblivious of their Eastern congeners; the hermeneuticians have yet to stretch their horizons beyond the most familiar ones; and the analysts remain unaware of the analyses and linguistic sensitivities of the ancient non-European philosophers. Briefly, ignorance still blinds almost all contemporary Western philosophers to the rich, variegated philosophical traditions outside of their familiar orbit. Both Continental and Anglo-Americans have lost the breadth of view that once characterized such thinkers as Herder and the Humboldts. The blindness that has resulted is not simply that of individual Western philosophers but of our whole, still parochial philosophical culture. (shrink)

Catriona Mackenzie in a recent essay, Relational Equality and the Debate Between Externalists and Internalist Theories of Relational Autonomy (2022), takes a look back at an intractable debate within the relational autonomy literature that she attempts to resolve. Mackenzie’s innovative insight is that rather than try to resolve the rift by arguing that one side or the other is correct, her account is ecumenical and preserves what is attractive about both internalism and externalism. Her essay serves as a retrospective on (...) the concept she and Natalie Stoljar helped popularize. Their edited volume Relational Autonomy established the framework for this entire debate. In the twenty-five years since this famous collection came out, this divide has only further entrenched. It is my aim with this paper to heal this rift between internalists and externalists by recasting the central conceptual tool of relational autonomy to affordances. I will be using a conceptual schema connected to affordances which in total make up what I call the “meso-level” of phenomena. My secondary purpose in this paper then is to have this particular problem in relational autonomy be a stalking horse to show the conceptual power and usefulness of this meso-level in helping us think through ethical and political problems. Inspired by the 4EA (extended, embodied, embedded, enactive, affective) movement I call this shift in conceptual focus extended relational autonomy. -/- In Section 1 I explain what relational autonomy is and how it was shaped by criticisms that we are inextricably dependent creatures and that normatively this is not a bad thing. I also explain the two main positions of the debate, internalism and externalism. In Section 2 I lay out four problems within relational autonomy that remain intractable. In Section 3 I explain Mackenzie’s multi-dimensional account of relational autonomy and her replies to the four problems I laid out in Section 2. In Section 4 I define what affordances are and distinguish my preferred “relational ontology” account from mainstream psychology’s “dispositional ontology” account. I then introduce a schema of other concepts that connect to affordances such as the landscape and field of affordances, skills, capacities, habits, and ontogenesis. Together with affordances these concepts form what I call the “meso-level” of phenomena. In this section I initiate my main criticism that internalism is descriptively wrong and that relational autonomy needs an external criteria. At the same time, I contend that externalism is also descriptively wrong in that it presumes that structural political phenomena exhaust the external and neglects the meso-level. This leads to Section 5, where I show the power of affordances and the meso-level as a tool in reconnecting internalism and externalism. Finally, I conclude by looking at work on affordances that show the concept’ s usefulness as a tool. (shrink)

The article explores the historical foundations and specific features of partnership pedagogy in the context of current educational transformations. The purpose of the article is to summarise theoretical approaches and practical models of partnership pedagogy in the context of current transformations in the educational landscape, to analyse its forms and levels of implementation in national and international educational practice, as well as to identify potential barriers and prospects for the further integration of partnership strategies into Ukraine’s education system. The research (...) employed a range of interrelated methods: theoretical analysis of scholarly literature and regulatory documents to clarify the concept of “partnership pedagogy” and its interpretations in both domestic and international discourses; comparative analysis of foreign and national experiences in implementing partnership-based approaches in education; interpretive and reflective methods to explore the typology, levels, and content dimensions of educational partnership; and methods of systematisation and generalisation to identify barriers to implementation and outline prospects for its further development. It is established that partnership pedagogy is an educational concept grounded in the principles of equitable interaction, mutual responsibility, trust, and cooperation among all participants in the educational process. It serves as a relevant methodological basis for educational practice across all levels of education. Within educational discourse, partnership encompasses not only formal collaboration among stakeholders but also phenomena such as co-participation, mutual accountability, trust, subject–subject relations, dialogic engagement, and cooperation. In the context of education governance, partnership is interpreted as coordination of actions, joint decision-making, and the involvement of all stakeholders in planning, implementing, and evaluating educational policy. It is emphasised that educational partnership represents not only a pedagogical practice but also a vital component of educational policy in many countries in response to global challenges. It is outlined that the transformation of partnership pedagogy from a humanistic pedagogical concept into an interdisciplinary approach integrating pedagogical, managerial, and sociocultural practices of interaction among educational actors and stakeholders is evident. A comparative analysis of Ukrainian and international models of educational partnership is conducted, with particular attention to the New Ukrainian School Concept. The article also examines the institutionalisation of partnership practices in the EU, the United Kingdom, Finland, the USA, Canada, and Australia. Innovative methods, forms, and technologies for implementing partnership interaction in higher education institutions are identified. Examples of successful educational practices based on co-creation, dialogue, and shared responsibility – particularly in the context of Students as Partners initiatives, eportfolios, design thinking, dual education, and project-based learning – are synthesised. The article substantiates the stages of partnership development in higher education: from the modelling of practices, expansion and institutional consolidation, and critical reflection to external institutional integration. It outlines the key barriers to the implementation of partnership strategies in Ukraine and suggests possible directions for their adaptation to the national educational context. It is concluded that particularly relevant for adaptation to the Ukrainian context are models for establishing educational and production clusters, virtual universities, scientific-educational hubs, and projectoriented educational networks. However, the meaningful adaptation of relevant international practices is only possible when the national context is duly taken into account – specifically, the characteristics of educational culture, regulatory frameworks, and the willingness of educational stakeholders to broaden their scope of responsibility within partnership-based interaction. This study focused on evaluating the agribusiness students’ negative experiences in learning Calculus. The study employed 121 agribusiness students in the first semester of the school year 2019-2020 at Visayas State University, Baybay City, Leyte, Philippines. Selected secondary data from the study of Casinillo and Casinillo (2020a) was utilized in this study. With the aid of a correlational research approach, this study stresses to explain the nature and characteristics of negative effects of learning calculus which is very helpful for improving (...) the level of achievement of students and modifying the strategy of mathematics teachers. Results showed that most of the agribusiness students don’t have enough background in pre-calculus topics since there are only 9% of them took a STEM strand during senior high school. Seemingly, it is revealed that students are experiencing extreme stress, natural emotional exhaustion and frustration, and average absenteeism, somatic burden, and laziness in learning Calculus. It is found out that the negative experiences of these agribusiness students are significantly related to each other. This suggests that these negative experiences are inter-correlated and dependent on each other which is wearisome to their studies and leads to poor academic performance. However, these students are driven to pursue studying calculus since it's part of their requirements in their degree program. Hence, by proper motivation and appropriate teaching strategy in Calculus, these students can progress their level of achievement. (shrink)

We all agree that our human minds are results of primate evolution. We humans are self conscious. The separation of our human lineage from the chimpanzee one began about 7MY ago (pan homo split). Specificities of human self consciousness have been created during that time. Besides interesting approaches differing from the one proposed here [1], little is known about how these specificities came up [2, 3]. We propose here to address that subject with an evolutionary scenario using meaningful representations, identifications (...) with conspecifics and anxiety management. Taking the beginning of the pan-homo split as a starting point we look at how an evolutionary scenario could have led to our present human self consciousness as object and as subject. An evolutionary anxiety is highlighted as having been a key contributor to the evolutionary scenario with perspectives on a possible future of self consciousness. Human self consciousness is defined here as the meaningful representation of one’s own entity, with the capability to think and talk about it. The evolutionary scenario proposed here is an extension of a previous version [11] that uses an evolution of meaningful representations introduced in previous works [8]. The scenario starts with two types of meaningful representations carried by our non self-conscious pre-human ancestors: representations of parts of themselves (seen hands, heard shouting, actions, …) and representations of conspecifics as entities existing in the environment. The next step uses elementary versions of inter-subjectivity and of identifications with conspecifics that our primate ancestors were capable of. It is proposed that these performances have brought the two types of representations to merge and bring our ancestors to progressively represent their own entity as existing in the environment like conspecifics were represented. We consider such evolutionary approach as introducing an elementary form of self consciousness as object and a s subject, both coming in together. We group them into an “ancestral self consciousness” which was to evolve into our human self consciousness [4]. Such approach avoids the need of a pre-reflective self consciousness [7]. The scenario considers that such identifications took place also with suffering or dying conspecifics. These identifications were sources of specific new fears and anxieties that the scenario groups in an “evolutionary anxiety”, source of important mental sufferings that our ancestors had to limit. Different possibilities were available for that. The scenario proposes that the chimpanzee lineage may have limited what was an unbearable mental suffering by stopping the development of identifications with conspecifics, and by this also stopping a possible evolution toward self-consciousness. This would have led to today chimpanzees. On the other side, our human lineage may have developed anxiety limitation tools like caring, pleasure, anticipation, communication and imitation; such tools also favoring the evolution of our lineage toward human minds. This is illustrated in the scenario by the introduction of an ”evolutionary engine”. In addition, the capacity for anticipation attached to self consciousness has amplified the evolutionary anxiety, leading it to become an overall “ancestral anxiety” which is still present and active in our human minds (with anxiety limitations as a key constraints to satisfy). The many anxiety limitation processes introduced in our lineage during the pan homo split were interrelated. Many came up in addition to the few ones listed here above. Most remain in our human minds at an unconscious level and are active in our everyday lives, much more than assumed so far. Considering a possible future of human self consciousness, nothing tells that human evolution is terminated. Also, the evolutionary scenario introduces the possibility for some anxiety limitation processes to be sources of evil behaviors, more precisely related to a possible pleasure procured by the suffering of others [9]. That (disturbing) background could introduce a better understanding of human mind, and so be an entry point to its future in terms of potential improvements of human nature. The scenario also introduces an evolutionary nature of reflectivity [10] which can question the philosophical need for a pre-reflective self consciousness. Such perspective can also introduce a naturalization of introspection, and then allow to consciously question the nature and content of our mental states. This could open a path for a tentative naturalization of the “what it is like” question for humans and make available an evolutionary link between self consciousness and phenomenal consciousness. A last point to highlight is that the proposed evolutionary scenario uses performances of life like intersubjectivity. This brings to note that a full understanding of the proposed scenario needs an understanding about the nature of life which is not available today. A lot remains to be done on these subjects. In this paper, I embark on diving deep into the specific training model of the systematic approach to training for probing more perspectives of its governance that should connect and link its phases together. Actually this training model is applied by many organizations all around the world that require a high level of professional trained staff with a minimal standard deviation of processes. I am here concerned with those organizations seeking a better training system, while ending up being superficially (...) satisfied with reverberating and bragging with having the SAT onboard without full awareness of the possibilities of its implementation. It is not about the system, it is about the mindsets that are flexible enough to fully grasp the ins and outs of the model they are about to use and how to harness its tools for their organizational benefit; otherwise it’s a waste of time, effort and money. In order to operate training in a systematic manner, it has to not only cover the inter related stages and processes, but also set a solid bridge that keeps and maintains the smooth landing from one stage to another along with securing the prospected outputs which conforms to both form and content. Based on my experience on the best practices of the systematic approach to training, I will here contribute my insight of the system quality control technique that may help in a well-knitted flow of processes. The genealogy-based classificatory programs of Kant and Darwin are briefly discussed for context. It is detailed how in biology there is no unambiguous term to reference infraspecific-level descent-based divisions. The term lineage population is introduced and defined for analytic purposes as one of a set of inter-fertile divisions of organisms into which members are arranged by propinquity of descent. It is argued that the lineage population concept avoids the ambiguities associated with related biological and anthropological concepts and polysemes (...) such as population, ethnicity, and race. Other terms and concepts, such as form, cline, cluster, geographic population, breeding population, genetic population, breed, species, subspecies, ancestry, geographic ancestry, biogeographic ancestry, ancestral population, ancestry population, natural division, and population lineage, are discussed in relation to this concept. It is concluded that the lineage population concept is a useful analytic tool which describes, in line with the Kantian/Darwinian perspective, an interesting class of biological variation. (shrink)

The aim of this study is to proof the argument – i.e. ‘there are significant linkages amongst tolerance, hybrid identities and migration.’ These linkages can be comprehended by means of conceptualising extensions of hybrid identities in aggregate trans/inter-migration processes. It can be put forward that arising hybrid identities are embedded in a blurring structure of thoughts, beliefs, states of affairs, facts, belongings and so forth. From multiculturalism and cosmopolitanism viewpoints, it is argued that tolerance and migration ought to be (...) analysed in frame of sociology of law, human rights, international migration law, and of course the European Union law. So far, normative arguments and soft law approaches are very much well integrated with social aspects of migration, tolerance, identity and culture. In this context, the study examines to what extent cultural and human components are protected by law in multiple levels from an interdisciplinary perspective. In this framework, it is crucial to raise the research enquiries: What are possible criteria for the limits of tolerance? To what extent tolerance is related to human rights and morality? What ought to be the limit of tolerance towards hybrid identities in multicultural and cosmopolitan societies? In a consistent manner, the criteria and standards developed by some leading scholars were reconstructed and discussed throughout this paper. These criteria and standards are both moral (part of a universal system of morality) and legal (international, supranational, or national – i.e. constitutional). In order to apply such standards their validity was discussed (i.e. the respective normative power has the norms at the various levels). In the case of morals, their difference to particular ethnic systems was established (i.e. criteria by which the two can be distinguished). Then the research argument was elaborated on whether and how the legal standards comply with the moral standards, how national standards comply with supranational or international standards. Likewise, the study highlights the crucial contributions of “World Society and World System Paradigms” that are associated with social space, global civil society, cosmopolitanism, ethnic diversity, cultural hybridity, human rights activism and public sphere. Recent debates in Refugee Studies (e.g. Syrian Refugee Crisis, Dual and Multiple Citizenship Issues and so forth) highlight the fact that the European Union needs to consider new aspects of tolerance for hybrid identities and tolerate cultural rights of hybrid identities, create cohesion in communities and establish intercultural dialogue amongst home-states and host-states. Sanguinely, the efforts of hybrid identities are strengthening the relations between home-host states and these ought to attract some considerable attention. It is pretty obvious that language and human consciousness entertain tight relations. We could not really be conscious of ourselves without the possibility to say “I” or “me”. And language is a key contributor in our capability to identify ourselves as conscious entities existing in the environment. But the relations linking language and consciousness are complex and difficult to analyze. Evolutionary origins of language are unknown as no fossil traces have been left by our ancestors. Sciences of consciousness (...) however begin to make available some possible evolutionary scenarios about the nature of human consciousness. We want here to propose a link between language and consciousness by using such an evolutionary scenario and also introduce the usage of a systemic approach to meaning generation. In the first part of the presentation we will use an existing scenario about the evolutionary nature of self-consciousness where the development of language has a role (1). We will highlight this role in order to identify language and self-consciousness as inter-dependant in their nature through a possible common evolutionary origin. Self-consciousness and language could then be considered as tightly inter-dependant through a common build up of human nature during evolution. The scenario presents an evolutionary nature of self-consciousness as resulting of the capability for pre-human primates to identify with their conspecifics (1, 2). The conspecifics are represented as existing in the environment, and such identification brought our pre-human ancestors to consider themselves as also existing in the environment. The scenario takes this event as being a first step for a conscious self-representation within pre-human primates, which progressively evolved toward our today human consciousness (3). But such identification with conspecifics was not for free at times of survival of the fittest. Identifying with conspecifics meant for our pre-human ancestor to also identify with their sufferings or encountered dangers. These came in addition to the dangers or sufferings naturally encountered and created a significant anxiety increase (1). The resulting level of anxiety had to be limited. One possibility for that was to develop psychological or physical tools that could have reduced the risks of occurrences and developments of such dangers and sufferings. Among these tools is the performance of language which can induce significant evolutionary advantages. We will propose a first scheme about how these evolutionary advantages could have reduced the dangers and sufferings encountered by our pre-human ancestors. We will also show how the development of language produced by itself a positive feedback on the development of inter-subjectivity in the evolutionary scenario, and so participated directly to the development of human consciousness. Other evolutionary advantages have existed like the development of imitation and synergy through experience (4). Language played a role there also, and has to be taken into account. The second part of the presentation will propose the usage of an existing systemic approach to meaning generation in terms of constraints satisfaction (5, 6). Constraints for pre-human primates, ranging from a basic “stay alive” to highly elaborated “limit anxiety”, were source of multiple meaning generations in which language has played (and still plays) a key role. The Report presents insights which illuminates the intertwinements of European regulatory policies and global governance arrangements. By pinning down the exact nature of the interaction between these two levels, the EU’s dilemma becomes obvious: On the one hand, stronger global governance can be a chance, through which the EU can clarify its own raison d’être of increased integration to the wider world. On the other hand, the design of the European project is being challenged by more assertive global structures. This (...) is especially the case in relation to the WTO regime, which is constraining the decisional autonomy of the EU, regarding the appropriateness of its content and its external effects. Thus, the regulation of services in the EU and the WTO are discussed in the first section of this report. Section two focuses on labour standards, which are analysed from different angles in order to clarify the functions of the WTO and the ILO, multinational companies as well as other private actors within this specific field. Self-consciousness is a product of evolution. Few people today disagree with the evolutionary history of humans. But the nature of self-consciousness is still to be explained, and the story of evolution has rarely been used as a framework for studies on consciousness during the 20th century. This last point may be due to the fact that modern study of consciousness came up at a time where dominant philosophical movements were not in favor of evolutionist theories (Cunningham 1996). Research on consciousness (...) based on Phenomenology or on Analytic Philosophy has been mostly taking the characteristics of humans as starting points. Relatively little has been done with bottom-up approaches, using performances of animals as a simpler starting point to understand the generation of consciousness through evolution. But this status may be changing, thanks to new tools coming from recent discoveries in neurology. The discovery of mirror neurons about ten years ago (Gallese et al. 1996, Rizzolatti et al. 1996) has allowed the built up of new conceptual tools for the understanding of intersubjectivity within humans and non human primates (Gallese 2001, Hurley 2005). Studies in these fields are still in progress, with discussions on the level of applicability of this natural intersubjectivity to non human primates (Decety and Chaminade 2003). We think that these subject/conspecific mental relations made possible by mirror neurons can open new paths for the understanding of the nature of self-consciousness via an evolutionist bottom-up approach. We propose here a scenario for the build up of self-consciousness through evolution by a specific analysis of two steps of evolution: first step from simple living elements to non human primates comparable to chimpanzees, and second step from these non human primates to humans. We identify these two steps as representing the evolution from basic animal awareness to body self-awareness, and from body self-awareness to self-consciousness. (we consider that today non human primates are comparable to what were pre-human primates). We position body self-awareness as corresponding to the performance of mirror self recognition as identified with chimpanzees and orangutans (Gallup). We propose to detail and understand the content of this body self-awareness through a specific evolutionist build up process using the performances of mirror neurons and group life. We address the evolutionary step from body self-awareness to self-consciousness by complementing the recently proposed approach where self-consciousness is presented as a by-product of body self-awareness amplification via a positive feedback loop resulting of anxiety limitation (Menant 2004). The scenario introduced here for the build up of self-consciousness through evolution leaves open the question about the nature of phenomenal-consciousness (Block 2002). Relational egalitarians endorse the positive thesis that achieving equality of social relations is fundamentally important, and sometimes also the negative thesis that distribution has no non-relational importance. This article rejects both theses of relational egalitarianism. Contrary to the negative thesis, there are strong reasons supporting the non-relational importance of distribution, as is brought out by considering a country with huge distributive disparities and pervasive poverty but no relational inequality. Two objections to the positive thesis are presented. First, relational equality (...) is consistent with a levelling down of social relations.
