Context: Directive (EU) 2018/957 amending Directive 96/71/EC concerning the posting of workers in the framework of the provision of services introduced new paragraphs 1(a) and 1(b) on long term posting as referred to in Article 3 of Directive 96/71/EC.
A period of 12 months was introduced, with the possibility of extension up to 18 months where the service provider submits a motivated notification to the control authorities in the host country, during which period the terms and conditions of employment pursuant to Article 3 of Directive 96/71/EC shall apply.
After that, the labour law of the host country shall apply, with the exception of the provisions relating to:
