Stay extended in the Terri Schiavo case

A Florida judge has extended a stay preventing the demonic husband of brain-damaged Terri Schiavo from removing the feeding tube keeping her alive.

For only two more days.

This coming Friday, when the 48 hour stay expires, will coincide with the 15th year anniversary of Michael Shiavo's attempt to murder his wife, which is how Terri ended up in the poor condition she is in today. Yet he is free, breathing, and having sex with his live-in girlfriend with whom he has two children.

If Terri's feedng tube is removed, Terri will suffer a slow, painful death.

If you ever have a feeding tube, this court decision will set a precedent for one of YOUR relatives to kill you as well.

Attorney: Terri cried at the news

An attorney for Terri Schiavo said the severely brain-injured woman cried and yelled out that she wants to live after being told today her life-sustaining feeding tube was about to be removed by court order.

Barbara Weller was in Terri Schiavo's room at the Woodside Hospice in Pinellas Park, Fla., when the encounter took place, according to activist Randall Terry, who spoke with WorldNetDaily from outside the building as demonstrators continued a vigil.

If true, the report apparently refutes the court's finding that Terri Schiavo is in a "persistant vegetative state" and cannot currently express her wishes. Her husband, Michael Schiavo, contends she had indicated she would not want to live in such a condition, but parents Robert and Mary Schindler dispute that and suspect he is responsible for the 1990 incident in which oxygen to her brain was temporarily cut off, causing severe brain damage.

Weller essentially told Terri Schiavo, "You had better say you want to live or they will kill you. Just say you want to live."

Schiavo responded with a drawn out, "IIIIII," then screamed out "waaaaaaaa" so loudly that a police officer stationed outside the room came in.

The officer then ordered Weller removed from the room, according to Terry.

The event was witnessed by Terri Schiavo's sister Suzanne Vitadamo and Suzanne's husband Michael.

"I talked to Suzy and Michael, and they both said it was unbelievable," Terry said. "It was very articulate, for Terri, but they also say this is normal [for her to communicate]."

Terry explained the family says Schiavo often is talkative, though similar to a 10-month-old.

"The words usually are not discernable, but she's responsive to commands, uses slow diction and her voice lilts to show emotion and context," he said.

Weller teared up after hearing Schiavo respond today, Terry said, and indicated Schiavo was crying.

Terry has established a website, helpterri.com with information about how to get involved, including phone numbers of lawmakers and details of a rally and lobby-training sessions to be held next week in the Florida capital, Tallahassee, beginning Monday.

"We need people there Monday night, people who have never lobbied before, to come, and we're going to be begging the [Florida] Senate to get its act together," Terry said.

Doctors removed Terri Schiavo's feeding tube today to carry out her estranged husband's requested court order.

Barring an intervention, she is expected to live another week to 10 days.

The tube removal came after a Florida judge blocked an eleventh-hour end-run waged by members of House and Senate panels, ruling the device can be removed immediately.

Early this morning, the House Government Reform Committee decided to launch an investigation into the case and issued subpoenas that order doctors and the administrator at the hospice facility not to remove her feeding tube and keep her alive until the investigation is complete.

At the same time, the Senate Health Committee also requested Terri and Michael Schiavo appear at an official committee hearing March 28.

As a result, minutes before the 1 p.m. EST deadline for the tube removal passed Pinellas Circuit Court Judge David Demers ordered the feeding tube remain in place while presiding Judge George Greer addresses the matter of the congressional subpoenas in a court hearing.

But an hour later, Greer disregarded the subpoenas and again ordered the feeding tube pulled.

Florida House votes to save Terri Schiavo
Six days after Terri Schindler-Schiavo's feeding tube was removed on court order – sentencing her to a slow and painful death – the Florida House of Representatives, influenced by a massive and sustained outpouring of support for the 39-year-old brain-disabled woman, voted yesterday to give Gov. Jeb Bush the power to order Terri's feeding tube re-inserted.

Legislation H35-E, known as Terri's Bill, passed House on a 68-23 vote at approximately 10:15 p.m. Eastern.

However, the Senate version, S 0012-E, will be debated by the state Senate at 8 a.m today...

In the meantime, poor Terri is feeling pain from the starvation and dehydration, and people who have seen her say she is beginning to fade, and they fear she can't hold out much longer. She is reported to be alert still and vocalizing, but her face is thinner and her skin is becoming drawn, showing the effects of five days of dehydration.

March 18, 2005 is the death date set by Judge Greer to kill Terri Schiavo

Folks, as of this writing, the web site counter statistics at Terri's Fight, shows 1,649,496, and increasing exponentially every minute. That says a lot about how many people care about Terri Schiavo.

But that's not of any comfort to Terri's family. Imagine, folks. Imagine being Terri's mom, having given birth to a beautiful daughter and - suddenly - every single second of the clock, as it counts down to Friday, March 18, 2005 at 1:00pm, churns Terri's mom's stomach into a tighter and tighter knot of anxiety, fear, despondency, utter disbelief, chaotic tumultuous, torturous thoughts that Terri only has less than four days to live.

Less than four days. Imagine YOUR beloved child. Imagine the Christmases past. The Birthday parties. Her first words. Watching her take her first stumbling steps. Watching her as she pulls herself up for the first time in her painted crib. Imagine YOUR daughter being slaughtered by right-to-death activists. For money.

Imagine watching your daughter starve to death by a court-sanctioned order to remove a feeding tube, simply because Terri Schiavo can not swallow on her own.

Folks, being unable to swallow is not a crime. It should not be punishable by death. Yet death is what Judge Greer, George Felos and Michael Schiavo, Terri's adulterous husband, have cast down upon Terri Schiavo.

It seems logical that Michael Schiavo, who is married to Terri, a disabled woman, should lose legal guardianship if he marries another woman (common law or otherwise). To allow this guardianship to continue is tantamount to endorsing polygamy. Yet, Michael Schiavo is living with another woman AND has two children with her and noone questions this living arrangement nor Michael Schiavo's ulterior motives.

This coming Friday will coincide with the 15th year anniversary of Michael Shiavo's *alleged* attempt to murder his wife, which is how Terri ended up in the poor condition she is in today. Terri collapsed in her home under questionable circumstances in Feb, 1990. Yet Michael is free, breathing, and having sex with his live-in girlfriend.

Folks, read the words that Judge Greer dictated three weeks ago:

ORDERED AND ADJUDGED that absent a stay from the appellate courts, the guardian, MICHAEL SCHIAVO, shall cure the removal of nutrition and hydration from the ward, THERESA SCHIAVO, at 1:00 p.m. on Friday, March 18, 2005.

Folks, I watched my father die from Alzheimers. He could no longer swallow. He couldn't be fed ice cubes, because he would choke on the melted ice in his mouth. It took him three days to die of dehydration and he was 80.

Terri Schiavo died of murder today

Folks, it is with much anguish that I write that Terri Schiavo died of murder today, after being starved to death by the State of Florida.

It's important that you all remember that Terri Schiavo was not dying before they killed her 13 days ago. She was alive. She only started dying after the State of Florida removed her feeding tube.

May Terri rest in peace, may her family be comforted, may the guilty pay, and may our nation recover its moral compass in the wake of this terrific tragedy.

Thou Shalt Not Kill

Terri Schiavo's feeding tube was removed today in a fiercely cruel act of judicial tyranny.

Deafening is the only word for the silence from the left and the Hollywood elite yet the moment an al Qaeda terrorist is rumored to have been sent to bed without supper, everyone writes a letter and lights a candle.

Folks, in this country, if you're a muslim and you kill or try to kill enough Americans, you can be certain our government will feed you three halal meals a day.

But if you're a disabled American, you can be sure that our government will kill you.

There will be no more meals for Terri. No more meals because the tyrannical Judge George W. Greer of the Sixth Judicial Circuit has just sanctioned murder in the state of Florida. He has ordered Terri Schiavo to die slowly by dehydration by having her feeding tube removed when all that Judge Greer had to do was permit Terri's mom to take her home and feed her there.

Agency Had 89 Abuse Reports on Michael Schiavo

Folks, according to an article on NewsMax, Florida's Department of Children and Families had received nearly 90 allegations that Michael Schiavo had abused his wife in recent years - but a Florida judge ruled yesterday that DCF summaries of those allegations must remain secret.

The St. Petersburg Times and the Tampa Tribune had filed suit for the release of the abuse summaries, which covered 89 reports - the Times said Friday.

But state Judge George Greer ruled Friday the records belong to DCF, and although Terri Schiavo's husband can have access to the abuse files, the records cannot be made public, The Associated Press reported. During a hearing Thursday, just hours after Terri Schiavo died, DCF attorney Jennifer Lima-Smith asked Greer to keep its records sealed, saying, "It's time to end this case."

Just a few weeks ago, however, the agency was pressing for a full-blown abuse probe.

In the petition filed with Greer's court in early March, the DCF asked him not to remove Schiavo's feeding tube until the agency could investigate 34 pages of materials documenting allegations of abuse, the Orlando Sentinel reported at the time.

The DCF petition said the materials were sent to its abuse hotline on Feb. 18 and Feb. 21, and by law, the agency had to conduct an investigation.

"The allegations in the abuse reports go to the heart of whether abuse, neglect and/or exploitation has been perpetrated by the guardian [Michael Schiavo]," the DCF's 10-page petition said, according to the Sentinel.

The allegations were based partly on bone scans showing Terri Schiavo suffered fractures, as well as statements she made to family and friends that she was unhappy in her marriage, the AP reported Friday.

Folks, maybe we can get Sandy Berger to steal those secret records for us, whaddyathink?

Death by fiat

Folks, a gruesome crime was committed in the middle of the night of March 13, 1964, in Kew Gardens, Queens. Catherine "Kitty" Genovese, a young 28-year-old, was murdered just 20 feet from her apartment door before she could get from her parked car and into the safety of her apartment building. Winston Moseley was running after Kitty and had a knife in his hand. Kitty ran, but Moseley, her murderer, was faster. Kitty ran towards a police call box, but it was too late. Moseley caught up with Kitty, who was 5’1” and 105 pounds, near a street light at the end of a parking lot. Apartment lights went on in nearby buildings. Some slid open their windows and observed the struggle below. One called out to Moseley to leave her alone and he then shut his window and the lights in the apartments went out again.

As Kitty sobbed, bleeding badly, she stumbled towards a locked doorway, trying to stay conscious.

Within five minutes, the murderer returned. He stabbed her again.

“I’m dying! I’m dying!” she cried. Several people in her building heard her screams. Lights went on once again and some windows opened. Tenants tried to see what was happening from the safety of their apartments.

Eyewitnesses saw Moseley walk along the row of doors, searching for his victim. He followed the trail of blood to the doorway where Catherine lay bleeding on the tiled floor. And there, while Kitty lay semiconscious, incoherent from pain and loss of blood, he cut off her bra and underwear and sexually assaulted her.

According to courtroom testimony, 38 eyewitnesses to her murder did nothing. Her public slaying in Queens became a symbol of America's failure to get involved.

Now, nearly half a century later, Terri Schiavo stands out, also as a metaphor for human depravity, and to the kind of apathy and cowardice that in a broader sense has so easily led to Nazi Germany and fundamental Islam.

Terri Schiavo will die in what is almost incomprehensible apathy, and, almost inescapably, cowardice, analogous to the apathy that led dozens of Kitty Genovese's awakened neighbors to do nothing to stop, or even summon help, in time to prevent her killer to return three times to the scene in order to finish what he had begun.

Terri Schiavo's death is a brazen act of judicial fiat. The courts and judges who have condemned her to death succeeded with their arbitrary order.

To be sure, Congress among others, made a last ditch effort to derail the death machine, however, too little, too late is hardly enough to save face.

As for those who supported the judicial opinion that Terri should be allowed to starve to death, they stand in the dock right along with Michael Schiavo and George Greer, as accomplices to her murder.

No one will investigate the specious circumstances with which she suffered her brain damage 15 years ago, and online news services will continue to report that she suffered from an "eating disorder" and like FoxNews wrote today, of her "chemical imbalance".

No one will condemn the hypocrisy of the ACLU who defends Muslim terrorist's rights to three halal meals a day, no one will question why the National Organization for Women is so silent, nor will ethicists start an enquiry into Michael Schiavo's adultery and the definition of "husband".

We are all eyewitnesses to murder. Congratulations, America. We have sunk to a new low as it becomes apparent, with Terri Schiavo's death, that we are no better than our enemies overseas.

The "Right-to-Death" Advocates win another one

Folks, sadly, just as we suspected, this Whittemore judge has denied Terri Schiavo's parents request to re-insert her feeding tube, citing that Terri already had her day in court. And yes, Whittemore was a Clinton appointee.

But the family must be devastated. May HaShem have mercy on this family. Just think folks. In the future, when we all get sick one day, just pray that you don't have a family member who hates your guts, because all they will have to do is fabricate a story that you once stated that you don't want to live via artificial means - and poof - the Jack Kervorkian judges will be right there to help you get murdered.

I don't know what will happen next although the Schindler's have a right to an immediate appeal.

It must be re-stated, folks:

The "husband's" only concern is for the death of the "witness", the only living witness that knows what happened to her, 15 years ago.

Michael Schiavo has a new family. The parents are begging to take care of Terri, so it would be no trouble to him to release her. The point here, folks, is that the "husband" won't divorce Terri because then, he loses control of the "witness". The only reason to want her dead is to kill a witness to murder. This case should be tried in a Criminal courtroom. That's the sin here.

And let me ask you all another question; she lost consciousness 15 years ago under questionable circumstances due to an "eating disorder". What is the name of this unnamed eating disorder? What is the diagnostic code? What evidence exists that she had an eating disorder?

Barbarity in America

Rabbi Shmuley Boteach writes:

I never believed that I would live in a country that would, in effect, execute a brain-damaged woman who never hurt anyone in her life. The story of Terri Schiavo should outrage every decent American. While our soldiers valiantly fight and die across the sea so complete strangers can enjoy human rights, here at home an American woman who suffered severe brain damage 15 years ago is being subjected to death by dehydration and starvation by order of a judge. Today, her feeding tube was removed.

The humanity of every society is determined first and foremost by how it treats its most helpless citizens, and a nation that is prepared to murder a feeble and vulnerable woman who can breathe but not eat on her own must take a deeper look at the source of its ethics.

Before Hitler came for the Jews and the gypsies, he first came after the mentally handicapped. He offered this rationale for euthanasia: "In nature, there is no pity for the lesser creatures when they are destroyed so that the fittest may survive. Going against nature brings ruin to man. It is only Jewish impudence to demand that we overcome nature." Hitler, who was a committed evolutionist and applied the ruthless principals of natural selection to the human species, opposed "artificial" means of keeping the infirm alive. The species was strengthened when its weakest constituents perished, just as nature decreed.

Charles Darwin expressed his own belief in stronger and more feeble parts of the human family when he famously wrote, "The more civilized so-called Caucasian races have beaten the Turkish hollow in the struggle for existence. Looking to the world at no very distant date, what an endless number of the lower races will have been eliminated by the higher civilized races throughout the world."

Thankfully, the United States does not derive its ethics from Darwin, but from Sinai. We do not believe in the quality of life, but in its sanctity. Since Hitler was the enemy of life, he despised not just Judaism, but Christianity, which in turn embraced the biblical idea of the infinite value of every human life and how each individual, regardless of the degree of brain cognition, was possessed of the divine.

Hitler famously said, "The heaviest blow that ever struck humanity was the coming of Christianity. ... The deliberate lie in the matter of religion was introduced into the world by Christianity." Hitler spent much of his table talk, faithfully recorded by Martin Bormann, attacking Judeo-Christian ethics: "This filthy reptile raises its head whenever there is a sign of weakness in the state, and therefore it must be stamped on. We have no sort of use for a fairy story invented by the Jews."

How the United States could today devalue the life of the infirm by removing a brain-damaged woman's feeding tube, and unwittingly ally itself with the euthanasia program of the history's foremost monster, should send shivers down the spine of every American.

But biblical ethics aside, there is also common sense and logic. Should we really take what might have been a throw-away comment from a wife to her husband about not wanting to live in a vegetative state as the rationale to murder a human being? Apparently, Terri and her husband were watching some film about a person in a coma when Terri told her husband she would never want to live like that. But people make comments like that during movies all the time without really meaning them.

And even if Terri Schiavo expressly wanted to die, does that mean we should kill her? Dr. Kevorkian is sitting in prison for the rest of his life precisely because he killed people who wished to die. How is this different?

And what jurisdiction should Terri's husband, Michael, have here? He maintains that he is fighting to remove his wife's feeding tube to keep his pledge to her that she be allowed to die with dignity.

Now this is curious. The husband has taken other pledges to his wife, which apparently are far less meaningful to him. For example, in marrying her, he pledged to stand by her "in sickness and in health." Yet, many years ago he abandoned Terri, moved in with his girlfriend and had children with this other woman. Apparently, his pledge of sexual fidelity did not mean much to him, either.

Now, I'm not suggesting that Michael Schiavo should have remained celibate for the last 15 years, and I understand the need for human companionship. But he could easily have divorced Terri and left her in her parents' care rather than cheating on her and having children out of wedlock. But staying married to your wife just to ensure that she dies sounds a lot to me like wanting to inherit her estate. But honestly, which sane judge, in this case Pinellas Circuit Court Judge George Greer, would allow a man who is living with, and has children with, another woman, to make life-and-death decisions concerning his wife? This is a shocking affront to basic decency.

Furthermore, Judge Greer accepted the opinion of doctors who said Ms. Schiavo, 41, is in a "persistent vegetative state," the definition of which, according to the New York Times, is "damage to her cerebral cortex [that] has made her incapable of emotion, memory or thought."

But woe to a nation that determines that the sanctity of life is determined by a capacity to feel emotion, memory or thought. Before he died, Ronald Reagan was so ravaged by Alzheimer's that he had lost all memory and all capacity for cognitive thought. But could one only imagine a sane individual arguing that Reagan should have been denied food years before his 2004 death because he had become worthless? The same applies to millions of the elderly who inhabit our homes for the aged. A great many do nothing but sit in a chair or lie in bed with scarcely movement or memory. How far are we from a time when calls will go forth to deny them all food as well?

What comes to mind in the story of Terri Schiavo is the famous quotation of Pastor Martin Niemöller concerning moral failure in the face of the Nazis: "First they came for the Communists, but I was not a Communist, so I said nothing. Then they came for the Social Democrats, but I was not a Social Democrat, so I did nothing. Then came the trade unionists, but I was not a trade unionist. And then they came for the Jews, but I was not a Jew, so I did little. Then when they came for me, there was no one left to stand up for me." Terry Schiavo has no voice, so we must become her voice.

I shudder for my country to think that such acts of barbarity can take place in the world's foremost democracy and humanity's guarantor of liberty and freedom.

For Smooth Stone's new readers, we'll tell you that there are few things that impassion us more than Israel. Israel beckons our heart, calls to us, breathes inside us. We are passionate about defending innocent victims including Israel's Jews who are being terrorized and murdered by Muslim racists, the Diaspora Jews who are being victimized and beaten in Vichy France and elsewhere in Europe, and American men and women who are defending their nation and other nations against Muslim atrocities in Iraq, Kuwait, Saudi Arabia, Syria, the Sudan, Indonesia, Egypt, and other Muslim dictatorships and theocracies around the globe.

We feel the pain of victims who have no voice, like the aborted and like Terri Schiavo.

Although this blog is devoted to Israel, the Smooth Stone team feels that the inhumane treatment of Terri Schiavo by her husband, Michael Schiavo, should not continue without proper monitoring and advocacy, so although Israel is our first concern, this post is devoted to Terri and her battle to live.

Terri Schiavo, the brain-disabled Florida woman whose right to live is at the center of an ongoing euthanasia battle in the Florida courts.

Terri Schiavo suffered major brain injury in 1990 when she collapsed under questionable circumstances in the St. Petersburg apartment where she lived with her husband, Michael Schiavo. For reasons never satisfactorily explained, oxygen to her brain was cut off for several minutes, leaving her severely disabled, unable to talk and dependent on a feeding tube for food and hydration at the age of 26.

Whether she still requires a feeding tube is one of many unanswered questions. Micahel Schiavo adamantly refuses to allow a "swallowing test" to determine if she could be spoon fed.

Terri left no written instructions detailing what she would want if she were ever incapacitated, and is unable to communicate whether she would prefer being fed through a feeding tube or starved to death. But since 1998 Michael Schiavo has insisted that his wife, whom he refuses to divorce, told him before her collapse that she would never want to live "by artificial means."

During the trial in Jan. 2000, Michael Schiavo persuaded probate Judge Greer that Terri is in a "persistent vegetative state," or PVS, one of several physical conditions which in Florida law allows a feeding tube to be removed from a non-terminally ill person who has not left a written directive. A neurologist testified that Terri is essentially unconscious – not comatose or brain-dead, but not really conscious. He said there is no therapy is available to help her.

Florida law also allows simple oral statements, recalled by friends and family members years after they're allegedly made, to be accepted as "clear and convincing" evidence of a person's wishes. Drawing upon his own recollections, bolstered by a couple of similar statements by a brother and a sister-in-law, Michael Schiavo convinced Greer that his account of Terri's wishes was accurate.

Greer accepted as valid all evidence presented by Michael Schiavo and his witnesses – from recollections about her end-of-life wishes to opinions about her chances for improvement, and in Feb. 2000 ordered her feeding tube disconnected.

Terri's parents and her siblings dispute Michael Schiavo's contentions. They say Terri is alert, has a strong will to live, and could be significantly rehabilitated with agressive therapy. More than a dozen physicians, therapists and speech pathologists have stepped forward to state agreement with the parents.

Yesterday, the U.S. Supreme Court met behind closed doors to discuss whether to take up Terri's case. In a 27-page brief filed early last month, attorneys for Gov. Jeb Bush asked the nation’s nine top justices to review and eventually reverse the Florida Supreme Court's Sept. 23 ruling that struck down "Terri’s Law" as unconstitutional, arguing that the lower courts had denied the governor’s and Schiavo's federally protected rights to due process and equal protection. Florida Gov. Jeb Bush had the authority and the legal obligation to use his executive powers to halt the death of Terri-Schindler-Schiavo and to launch a criminal investigation into the case.

Eventually the Florida Supreme Court ruled against Jeb Bush and "Terri's Law". Jeb Bush's attorneys contend the governor was never allowed a "day in court" to defend his 11th-hour rescue of Schiavo or the law the Legislature had passed authorizing his actions. The emergency statute passed by the legislature Oct. 21, 2003, gave the governor authority to order the reinsertion of the incapacitated woman's feeding tube that had been removed six days earlier in compliance with a court order obtained by her estranged husband Michael Schiavo, who is also her legal guardian.

Michael Schiavo, represented by "right-to-die" advocate George Felos, challenged the constitutionality of the law and the governor's action, naming Bush as a defendant. The American Civil Liberties Union weighed in as co-plaintiff.

For those of you who don't know Terri Schiavo's history, here is an article which re-introduces the possibility that Terri's collapse 12 years ago might have been caused by a physical beating from someone, and not from the extremely unlikely reason that has been substituted by her husband's defense team, a potassium imbalance.

The reintroduction of the idea that Terri did suffer a head injury as a result of a physical beating is being frontiered by the foremost forensic pathologist, Michael Baden.
