Review of the market surveillance regulation
In “A new plan for Europe's sustainable prosperity and competitiveness”
In its 2026 Work Programme, the Commission has announced an update of the market surveillance regulation. The foreseen adoption date for the legislative proposal is Q3. It is included as part of a package which the Commission calls the "European Product Act".
The 2026 Work Programme also announces an evaluation of the market surveillance regulation. The foreseen date for the evaluation is Q4.
In order to gather views for both the evaluation and the review, the Commission ran a call for evidence and a public consultation back-to-back from 12 November 2025 to 4 February 2026. 97 responses were received to the call for evidence and 154 to the public consultation.
In the 2030 Consumer Agenda, adopted on 19 November 2025, the Commission again promises an update of the rules on market surveillance and compliance of products for Q3 2026. It states that the review will focus in particular on products imported from outside the EU, including through online purchases.
In the "One Europe, One Market" roadmap, signed by the Presidents of Parliament and the Commission and the Council Presidency on 24 April 2026, the date of Q3 2026 for the presentation of the Commission proposal or proposals for the European Product Act is reiterated. The date for conclusion of negotiations is set at Q4 2027.
