accountability in everything we do.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In accordance with the Law of 16 May 2023, which transposes Directive (EU) 2019\/1937 on the protection of persons who report breaches of European Union law, LIH provides a secure framework for reporting concerns about misconduct, illegal activities, or unethical behaviour.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Anyone who reports concerns in good faith can do so safely, confidentially, and without fear of retaliation.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Who can report?<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The Law of 16 May 2023 protects individuals who obtain information about breaches in a work-related or professional context, including:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>LIH employees;<\/li>\n\n\n\n<li>Self-employed persons working with LIH;<\/li>\n\n\n\n<li>Shareholders and members of administrative, management, or supervisory bodies, including non-executive members;<\/li>\n\n\n\n<li>Volunteers;<\/li>\n\n\n\n<li>Paid and unpaid trainees;<\/li>\n\n\n\n<li>Individuals working under the supervision or direction of LIH contractors, subcontractors, or suppliers.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Protection before, during, and after employment<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Protection applies not only to current employees but also to individuals who:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Obtained information during a previous employment relationship with LIH;<\/li>\n\n\n\n<li>Learned about potential breaches during the recruitment process or pre-contractual negotiations, even if the employment relationship never began.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Additional protected persons<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The law also protects:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Facilitators: individuals who assist a reporting person in a confidential manner;<\/li>\n\n\n\n<li>Third parties connected to the reporting person who may face retaliation in a professional context, such as colleagues or relatives;<\/li>\n\n\n\n<li>Legal entities owned by, employing, or otherwise professionally connected to the reporting person;<\/li>\n\n\n\n<li>Individuals who report breaches directly to relevant bodies, offices, or agencies of the European Union.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>What is not covered?<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The legal protection does not apply to reports concerning:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>National security matters;<\/li>\n\n\n\n<li>Information protected by:\n<ul class=\"wp-block-list\">\n<li>Medical professional secrecy;<\/li>\n\n\n\n<li>Legal professional privilege between a lawyer and client;<\/li>\n\n\n\n<li>Professional secrecy applicable to notaries and bailiffs;<\/li>\n\n\n\n<li>The secrecy of judicial deliberations;<\/li>\n\n\n\n<li>Rules governing criminal proceedings.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>What can be reported?<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">You are encouraged to report any suspected misconduct, unethical behavior, or unlawful activity.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Examples include (non-exhaustive list):<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Breaches of public procurement or state aid rules;<\/li>\n\n\n\n<li>Bribery, fraud, corruption, or other financial misconduct;<\/li>\n\n\n\n<li>Cybersecurity incidents and data protection breaches;<\/li>\n\n\n\n<li>Environmental, health, and safety concerns;<\/li>\n\n\n\n<li>Conflicts of interest;<\/li>\n\n\n\n<li>Any breach of applicable EU or Luxembourg laws relevant to LIH&#8217;s activities.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>How to report<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Confidential and available 24\/7<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">To ensure confidentiality and security, LIH has partnered with <strong>Whistlelink<\/strong>, an independent third-party provider of whistleblowing services.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"https:\/\/blue-sea-697d.quartiers047.workers.dev:443\/https\/lih.whistlelink.com\/\"><strong>Access the Whistlelink Reporting Platform here<\/strong><\/a>&nbsp;(available 24\/7 in English, French and German).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Through the platform, you can:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Submit a written report securely;<\/li>\n\n\n\n<li>Attach supporting documents, images, or other evidence;<\/li>\n\n\n\n<li>Submit voice recordings, which are anonymized upon submission and processed in accordance with applicable legal requirements.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>What happens after you submit a report?<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>1. Acknowledgement of receipt<\/strong><br>You will receive confirmation that your report has been received within <strong>seven (7) days<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>2. Assessment and investigation<\/strong><br>The report will be reviewed by LIH&#8217;s <strong>Compliance Committee<\/strong>, which may seek support from external experts when necessary.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>3. Feedback<\/strong><br>You will receive feedback on the outcome or follow-up measures taken within a reasonable timeframe and <strong>no later than three (3) months<\/strong> after acknowledgment of receipt.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>4. Protection against retaliation<\/strong><br>LIH strictly prohibits any form of retaliation against individuals who report concerns in good faith.
