Excellent order out of the Eastern District of Virginia granting the petition for habeas corpus and immediate release for our client, granted by Judge Anthony Trenga. Our client is a Nicaraguan national who was previously paroled into the United States, applied for asylum, and now detained in Virginia. The government argued our client was now “dragged back to his previous status” and subject to mandatory detention under 8 U.S.C. § 1225(b)(2)) as an applicant for admission to the US because his parole had expired. The Court disagreed, adopting our arguments that “upon the termination of Petitioner’s parole, Petitioner returned to the Government’s ‘custody’ under Section 1226 as an individual ‘already present in the United States’ and, therefore, entitled the statutory protections of a bond hearing under 8 U.S.C. § 1226(a) as a matter of due process. Moreover, as a remedy, the Court ordered our client’s immediate release pending a bond hearing. 👀 We're hiring! > Title: Legal Assistant  > Department: Legal Support  > Reports To: Supervising Attorney  > Status: Full-Time, Exempt 📌 Position Purpose:  The Legal Assistant plays a vital role in supporting the firm’s attorneys and clients throughout the immigration process. This role involves gathering, organizing, and entering data and evidence, completing forms compiling case documents, creating formatted and paginated PDF files with tables of contents; and maintaining updated records. The Legal Assistant serves as a liaison between clients and attorneys, ensuring smooth communication and document flow while contributing to positive client outcomes. A strong candidate will have experience working in a legal setting, a proven track record of being detail oriented, be proactive in managing and following up on various tasks to meet deadlines on time, be able to draft documents with few mistakes and receive and implement edits towards a final draft in a timely fashion, and excellent customer service tone and etiquette.     📌 Primary Responsibilities:  - Document Management: Receive a list of evidence from the assigned team and create a corresponding list in Spanish. Communicate with clients via call, text and email to request necessary documents, ensuring contact information is current and accurate.  - Data Entry Forms: Completing forms with an eye to accuracy and reviewing the data imported into the forms comparing the information received from the client to ensure accuracy.  - Client Communication: Maintain regular follow-up with clients until all required evidence is received.  - Compilation: Organize evidence into sections such as biographic information, proof of residence, proof of tax payment, etc. (categories will be provided for each case).  - Document Preparation: Create inserts to separate each document, compile all documents, and paginate the final PDF.  - Table of Contents Creation: Develop a detailed table of contents, listing each piece of evidence and corresponding page numbers by category.     📌 Basic Job Requirements:  - Language Proficiency: Fluent in English and Spanish.  - Organizational Skills: Highly organized, detail-oriented, and capable of prioritizing tasks.  - Technical Skills: Proficient in Microsoft Office, SharePoint, Google Docs, and Adobe Acrobat.  - Professionalism: Positive, welcoming, and professional demeanor.  - Commitment: Passionate about supporting immigrants' rights in the United States.  - Reliability: Prompt attendance, able to follow directions and adhere to training guidelines, with a reliable internet connection.  - Availability: Available Monday – Friday, 8:30 a.m. to 5:30 p.m. EST.     📌 Preferred Qualifications:  - Experience: Previous experience as a paralegal.  - Language Skills: Fluency in both Spanish and English.  - Familiarity: Experience with Docketwise, INS Zoom or any case management software.   

Victory in the Fourth Circuit! Today the U.S. Court of Appeals for the Fourth Circuit reversed and remanded the district court’s dismissal in Ortez Reyes v. USCIS. The Court held that federal courts do have jurisdiction to review agency decisions that rest on statutory interpretation, even where the immigration benefit itself is discretionary. Because USCIS denied the I-730 petition based solely on its interpretation of the Immigration and Nationality Act, the Fourth Circuit ruled the district court should have reviewed the merits. Congratulations to attorney Joseph Moravec, who argued the case, and to the entire Blessinger Legal team. We’re proud to advocate for fairness and judicial oversight in immigration law.
