It was a privilege today for the Dallas office of Dykema to host the judicial interns working for the Honorable Martin Hoffman this summer. My law partners Eric White, Tiffany Eggers, Tara Kern, Scott Hogan, and I shared some war stories, some insights about law firm life, some things we wish we had known when we were young lawyers, and a few practice pointers with the impressive group of interns assembled by Judge Hoffman. Today was particularly special for me since my daughter Cate Kratovil attended in preparation for her own judicial internship this summer with Presiding Judge David Schenck of the Texas Court of Criminal Appeals.

🎶 “Here we go again on our own…” 🎶 Michigan cannabis growers may feel like they’ve heard this song before. In the latest post from our Cannabis Law Blog, Lance Boldrey and John Fraser examine newly introduced Michigan legislation that could significantly increase the tax burden on cannabis cultivators. Looking particularly forward to taking a deep dive into AI-related risk-transfer strategies at next week’s NetDiligence® Cyber Risk Summit in San Diego with my Dykema partners Dante Stella and Kimberly Holmes. I am working on a lot of AI-related contracts with my clients, and AI is quickly being embedded in mission-critical operations, deliverable production, service optimization, and decision-making. It creates nuanced risk-allocation issues not just about who should be responsible for AI-related risk, but also about whether the allocation is commercially reasonable, operationally realistic, and supported by available insurance coverage. Some risk stays with the client, some is pushed to vendors or customers through contract terms, and some is expected to land in an insurance policy. That last piece is what I am especially interested in exploring at the Summit, because how carriers and underwriters are evaluating and absorbing AI risk has direct implications for how the rest of the allocation should be structured upstream to best protect our clients. ⚖️ The U.S. Department of Labor has formally restored the pre-2024 FLSA overtime exemption framework following a federal court decision vacating the 2024 overtime rule. For employers, this means: • The planned January 2025 salary threshold increase will not take effect • The 2019 white-collar exemption salary thresholds remain in place • Automatic future increases under the 2024 rule have been eliminated 📋 The DOL’s “technical amendment” has immediate compliance implications, particularly for employers managing exempt classifications across multiple states with differing wage-and-hour requirements.
