54% of consumers say getting an actual, OTD price and payment remain a top unmet need in their online car-buying experience. That stat was one of the key points discussed during Informativ’s recent National Automobile Dealers Association (NADA) webinar, “First Pencil Matters: Payment Transparency in a New Era of FTC Scrutiny.” And it points to a bigger issue for dealerships: As regulatory scrutiny around pricing transparency increases, dealerships are being pushed to think beyond the advertised price. The real customer experience often begins when that price turns into a payment conversation. Payments can change for legitimate reasons: credit tier, trade value, payoff, incentives, lender programs, taxes, title, fees, term, mileage, or deal structure. Price transparency answers: What does the vehicle cost? Payment transparency answers: What can this customer realistically afford based on the actual buying scenario? For many stores, the first pencil still depends heavily on manual logic, assumptions, legacy tools, or the experience level of whoever is working the desk. That gap can create inconsistent payments, late-stage rewrites, customer confusion, and a harder-to-defend process. The first pencil sets the tone for the transaction. If the number feels credible, the deal moves forward with more confidence. If it changes later without a clear explanation, trust can erode quickly. As most of us are aware, on March 13, the FTC sent warning letters to 97 dealer groups. The letters didn't cite a new rule. They cited Section 5 of the FTC Act, the same general unfair-and-deceptive-practices authority that has been on the books since 1914. That choice of weapon is the story. When the Fifth Circuit vacated the CARS Rule in January 2025, a lot of the industry read it as a reprieve. It wasn't. The FTC went back to Section 5, which has two qualities the CARS Rule didn't. It applies in every state. And it carries civil penalties that, under the most recent inflation adjustment, run roughly $16,000 to $17,000 per violation, per day, per party. The math compounds quickly when an advertised price has been live on a VDP for 90 days across a multi-rooftop group. Two details from the March letters matter more than the letters themselves. First, the FTC's focus is on the gap between advertised price and the price at which a real buyer can actually transact. Mandatory fees excluded from the ad. Incentives stacked that the buyer doesn't qualify for. Lender terms in the ad that the lender's program rules won't honor. Each of those (among others) is a Section 5 exposure. Second, and this is the part most software vendors have not internalized yet, the agency is explicitly holding dealers responsible for third-party advertising they don't directly control. If a dealer's website provider, digital marketing agency, or marketplace listing shows a price the dealership can't honor, that's still the dealership's Section 5 problem. Which means it is now the vendor's commercial problem. California is not the cautionary tale anymore. California is the preview. SB 766 takes effect October 1 and codifies most of what the CARS Rule attempted. State AGs in other markets are not waiting. The practical implication for software platforms serving auto retail is straightforward. Any system that touches advertised price, monthly payment, fees, or incentives needs to render numbers that survive a Section 5 review at the desk and on the contract. That requires lender-specific program math, real-time incentive eligibility, and fee transparency at the VIN level. Those are also the same capabilities that surface gross a desk manager may otherwise miss. Compliance and profit are produced by the same engine. Vendors who treat them as separate problems are about to learn that the regulator does not.
