Apple just settled a $250M class action over how it marketed Apple Intelligence. Not over the model. Over the marketing copy. The claim was simple: Siri couldn't actually deliver the “personal AI assistant” capabilities the campaigns promised. Buyers get $25 to $95 each. Apple admits no wrongdoing and writes the check. Two things every marketing leader should sit with: 1. The most expensive AI mistake of the quarter wasn't a hallucination. It was a headline. 2. The team holding that risk is marketing, not legal. Legal reviews copy. Marketing ships it, owns the calendar, and signs off on the claim. For years, AI substantiation has been treated as a model problem. It is not. It is a claims problem with an audit trail problem stapled to it: → which version of the claim shipped → which capability list it was based on → who approved that mapping → whether the underlying capability ever changed after approval If you can't reconstruct that for every active AI claim in your campaigns, you are running an Apple-shaped risk on a much smaller balance sheet. The next 12 months will separate marketing teams who treat AI claims like financial statements from the ones still treating them like creative.
