On December 17, 2025, the European Commission issued guidance on implementing Commission Regulation (EU) 2024/3190, which restricts the use of bisphenol A (BPA) and other hazardous bisphenols in food contact materials (FCMs). The guidance addresses and clarifies aspects related to the scope of the Regulation, compliance requirements such as declarations, testing, migration limits, and manufacturer obligations. It also explains transitional provisions, timelines, and conditions for derogations or authorizations for restricted substances. Finally, the guidance indicates a list of bisphenols and bisphenol derivatives currently considered as hazardous and falling within the scope. On December 18, 2025, MERCOSUR published Technical Regulation on Silicones for the Manufacture of Materials, Packaging, Coatings and Equipment Intended to Come into Contact with Food (GMC Res. No. 34 / 2025). This Regulation introduces a new positive list-based technical regulation specific to silicone materials intended for food contact, covering oils, resins, elastomers, additives, fillers, and monomers. This also modifies and excludes silicone-related provisions from previous GMC resolutions: • Silicones removed from: o Part V of Annex to GMC Res. 02/12 (plastics) o GMC Res. 28/99 (elastomers), including: Silicone elastomers Additives used exclusively for silicone elastomers Related notes • Amendment to GMC Res. 27/99 (Adhesives): o New wording for point 2.1: Adhesives may use substances from positive lists for: Plastics Plastic additives Cellulosic materials Elastomeric materials Silicones All Mercosur member states must incorporate this resolution into their national laws by June 16, 2026. On December 30, 2025, France enacted the Order of 28 December 2025, amending the 2021 regulation on maximum permitted plastic content in single-use cups. The measure extends the deadline for eliminating plastic from these cups from January 1, 2026, to January 1, 2030, following the 2025 progress report that assessed technical feasibility. A new review will be conducted in 2028 to monitor substitution progress. From the revised 2030 deadline, a period is provided for the disposal of stocks of manufactured or imported cups, ensuring a gradual transition toward eliminating plastic in single-use cups while addressing practical implementation challenges. On December 12, 2025, the European Commission (EC) published Regulation (EU) 2025/2509 on the safety of toys and repealing Directive 2009/48/EC. This Regulation lays down rules on the safety of toys in order to ensure a high level of protection of the health and safety of children and other persons, taking due account of the precautionary principle, and rules on the free movement of toys in the Union. This Regulation enters into force on January 1, 2026 and becomes applicable from August 1, 2030. Until then, products may be placed on the market under the existing Toy Safety Directive. However, Articles 28 to 44 and Articles 49 to 55 shall apply from January 1, 2026.
