Complaints to LinkedIn under global online safety regulations

Last updated: 2 years ago

LinkedIn is currently subject to certain regulations that require it to offer its users in Australia, the EU and the UK a channel through which to complain about LinkedIn’s compliance with these laws.

LinkedIn users in Australia

LinkedIn users in Australia can make complaints to LinkedIn Corporation about:

  • LinkedIn’s handling of reports of class 1A material or class 1B material; and
  • LinkedIn’s compliance with any other applicable aspect of the Australian Online Safety Act 2021.

LinkedIn users in the EU

Under Ireland’s Online Safety Code, users in the EU can make complaints to LinkedIn Ireland Unlimited Company (LinkedIn Ireland) about LinkedIn’s implementation of the Online Safety Code’s measures relating to:

  • age assurance;
  • content rating;
  • parental controls; and
  • user reporting mechanisms for content referred to in Article 28b(1)(a)-(c) of the Audiovisual Media Services Directive, or the systems that LinkedIn Ireland uses to explain the effect given to such reporting. This does not include appeals or complaints about content moderation decisions.

LinkedIn users in the UK

Under the Illegal Content Codes of Practice for user-to-user services issued under the UK Online Safety Act 2023 (OSA), individuals in the UK can submit to LinkedIn Corporation:

  • a) Complaints about LinkedIn’s compliance with any one of the following duties under the OSA:

    • i) the illegal content safety duties under OSA Section 10;
    • ii) the illegal content reporting duty under OSA Section 20;
    • iii) the freedom of expression and privacy duties under OSA Section 22.
  • b) Complaints by a UK user alleging that LinkedIn has used proactive technology (as defined in section 231(1) of the OSA) to remove, restrict access to, or reduce the visibility of such member’s content on LinkedIn in a way not contemplated by, or in breach of, LinkedIn’s terms of service.

If you would like to submit a type of complaint referred to above, please click here to complete the submission form (only available to users in Australia, the EU, and UK). Please note, LinkedIn will only consider complaints submitted through this process if they are of the types detailed above from users in the relevant jurisdiction.
