Victory in the Fourth Circuit! Today the U.S. Court of Appeals for the Fourth Circuit reversed and remanded the district court’s dismissal in Ortez Reyes v. USCIS. The Court held that federal courts do have jurisdiction to review agency decisions that rest on statutory interpretation, even where the immigration benefit itself is discretionary. Because USCIS denied the I-730 petition based solely on its interpretation of the Immigration and Nationality Act, the Fourth Circuit ruled the district court should have reviewed the merits.
