On Tuesday 28 October, more than 370 Class 1 strata managing agents and sector leaders came together for the NSW Fair Trading Strata Agent Business Leaders Forum – a full day dedicated to future-focused conversations and industry collaboration. Hosted by Strata and Property Services Commissioner Angus Abadee, the forum provided a space to share perspectives, strengthen industry standards and look ahead at the challenges and opportunities facing the strata services sector. Thank you to all presenters and attendees who contributed to making the event such a success.     NSW Fair Trading has taken disciplinary action against tow truck licence holders, Mitchell Silvestro (TTDRI08017644), and SILVS Enterprises Pty Ltd (MVRL60844). Mr Silvestro was convicted and fined for knowingly providing false or misleading information to NSW Police. He has been found to be no longer fit and proper to hold a Tow Truck Driver Certificate, and disqualified from holding a tow truck licence for a period of 15 months. As Mr Silvestro is the sole director of SILVS Enterprises Pty Ltd, we have also cancelled the Motor Vehicle Repairer's licence for the business. Always check that a business is properly licensed before you do business with them.     New laws passed in NSW will strengthen rental protections for victim-survivors of domestic violence. These reforms aim to make it easier and safer for renters to leave a tenancy, protect their privacy, and recover financially. Key changes include: 🔹 More professionals able to declare that a tenant is a victim of domestic violence 🔹 Stronger protection from liability for property damage for a victim-survivor 🔹 Safer rules for changing locks and protecting personal info 🔹 Ban on tenancy database listings for victim-survivors 🔹 Easier bond recovery from co-tenants The laws will commence on a date set by the NSW Government.     The owner of wedding photography company Andres & Co was convicted of 15 charges of Australian Consumer Law, and ordered to pay $100,000. This includes $48,000 in fines and $52,000 in compensation to the couples. The sentencing outcome reinforces that NSW Fair Trading will take strong action against businesses that exploit consumers.     Since February 2025, NSW Fair Trading’s Rental Taskforce has recovered more than $166,000 in unlawful fees for more than 2,000 renters. It has also issued more than 200 penalty notices of just under $240,000, and conducted 300 property inspections to check compliance with minimum standards. The Taskforce is also now using an automated compliance monitoring tool which detects unlawful re-letting in near real time. The system uses advanced data-matching to track more than 950,000 rental properties across NSW, cross-referencing landlord reports, rental listings, bond lodgements and tenant complaints. NSW Fair Trading is committed to protecting renters and ensuring a fair, transparent rental market through strong enforcement and education.     Buying or selling a property? Know the underquoting laws. Underquoting happens when a property is advertised for less than the agent’s genuine estimate of the sale price. To keep things fair, there are some important rules agents must follow including: • Agents must provide an estimated selling price in writing to the seller. • Agents cannot advertise a property sale price that is less than their estimated selling price. • Agents cannot use “offers over” or “$XXX,000+” in property sale advertisements. • Agents must update their estimated selling price if it becomes unreasonable and let the seller know why. We have received over 40 complaints from consumers who say they: - never received the goods they ordered - were sent the wrong or incomplete items - received low-value substitute products such as masks or stress balls - were denied refunds. The company is no longer responding to consumer requests, its listed addresses are vacant, and the sole director has left Australia.
