While a lot of policymakers and experts across the world may have a lot to say about the impact of Trump 2.0 tariffs, particularly on a large economy like India, it is important for all of us to think about strategies to convert this challenge into an opportunity. This warrants thinking in terms of specific sectors, not just macro. Here's our article, with Prof M. Spoke to Aashish Aryan on US President's threat to raise tariff and export restrictions if countries restrict market access to US tech companies. A few points to consider: 1. India’s tech regulations are not designed with the intention to target technology companies from any specific jurisdiction, but to protect consumers, support innovation and to create a fair and competitive marketplace that nurtures both foreign and domestic players. 2. India has pursued light-touch frameworks that safeguard user rights, encourage innovation, and maintain open market access. 3. American tech companies have thrived in India. India remains one of their fastest-growing markets, with significant investments in data centers, AI research hubs, and cloud infrastructure. 4. Unlike Europe, India has not adopted heavy-handed digital services legislation that fragments markets. 5. Beyond CAFE Norms: The Ministry of Power's New Framework for Vehicle Efficiency Enforcement The Ministry of Power has released a draft notification for the Energy Conservation (Compliance Enforcement) Rules, 2025. For India's automotive industry, these rules are not a minor update; they represent the formalization of a new compliance and penalty regime. Key points: 1. Unambiguous Inclusion of the Automotive Sector- Any ambiguity regarding the enforcement scope has been removed. Rule 6(1) in Table-1 explicitly places 'vehicles specified under clause (b) of section 14' under the jurisdiction of the State Commission's Adjudicating Officer. This directly links vehicle manufacturers to the new adjudication process, making compliance with energy consumption standards a non-negotiable operational reality. 2. The Bureau of Energy Efficiency (BEE) as the Central Enforcement Authority- The rules formally empower the BEE to be the engine of enforcement. As per Rule 3 and Rule 7, the Bureau is now responsible for not only monitoring but also for verifying compliance, issuing notices to non-compliant entities and authorising legal representation to prosecute cases of failure before the Adjudicating Officer. This moves the BEE’s role from advisory to executory. 3. A Structured Framework for Adjudication and Penalties- The notification lays out a clear, multi-stage process for enforcement - Reporting: Manufacturers must periodically submit compliance data to the BEE (Rule 4). - Verification: The BEE will verify this data (Rule 5). - Adjudication: In case of 'underachievement', the case is brought before an Adjudicating Officer where the manufacturer's head office is located (Rule 6). - Penalty: The officer will impose penalties as per the provisions of the Energy Conservation Act, 2001 (Rule 7). 4. The Financial Implications of Non-Compliance Rule 6(2) details the financial flow of penalties- While credited to a central fund, 90% of the amount is transferred to the Consolidated Fund of each State, in proportion to the sales share of the non-compliant vehicle in that state. This creates a direct financial incentive for state-level bodies to ensure robust compliance within their jurisdictions. 5. The Enforcement 'Teeth' for CAFE Norms- While the term "CAFE Norms" is not used, these rules provide the exact enforcement framework that gives those standards their power. The energy consumption standards for vehicles, enabled by Section 14(b) of the original Act, are what we know as the CAFE norms. These new rules create the procedural mechanism to penalize non-adherence to those very norms. The road ahead for the industry is now more clearly paved with regulatory certainty.
