  • From January 1 2027, zero-hour contracts (𝘯𝘶𝘭𝘶𝘳𝘦𝘯𝘤𝘰𝘯𝘵𝘳𝘢𝘤𝘵𝘦𝘯) in the Netherlands will no longer be allowed. A zero-hour contract is an agreement where employers don’t guarantee any set number of working hours. Staff can be called in to work only when needed and are paid for the hours they actually do. They are free to accept or decline the work offered without penalty and can also work for other employers at the same time. While this contract offers flexibility, it also means income can create some uncertainty for workers. What do you think about this change in ruling? How are you going to prepare for it?

    A situation that is close to impossible in the EU, unless the candidate gives explicit consent.  Under the EU GDPR and the new EU Artificial Intelligence Act, people can refuse decisions made exclusively by automated systems (like AI) if those decisions have serious or legal effects, such as hiring, promotion or dismissal. Keep in mind:   • Fully automated decisions that have a major impact on people, such as in employment matters, are not allowed if no real human involvement is included.  • Anyone subject to an automated decision has the right to request human review and to contest the decision. Some rare exceptions:   • If AI tools are used to support (not replace) human judgment, this does not count as "solely automated," and the strict GDPR rule does not apply.  • Solely automated decisions are only allowed if they are necessary for a contract, expressly permitted by law, or when the person has given explicit consent. We encourage HR teams and employers using AI in hiring to ensure there is always real human oversight in their processes, and just like Blue Lynx, to continue staying 𝘩𝘶𝘮𝘢𝘯 in Human Resources.

    Misclassification is one of the pressing compliance issues in the Dutch labour market right now, and it’s about to get stricter. Both freelancers (ZZP'ers) and businesses are at risk of penalties, especially as full enforcement of the DBA Act is coming in 2026.
