The decision on appeal of an administrative instance does not lend itself to the analysis of willful criminal conduct for which there is a penalty. Nor does res judicata, since the demands arising from the administrative route can still be taken to the Judiciary. Even so, the acts of the administration, especially considering the large number of infralegal regulations, must reflect the principle of legal certainty as much as possible, so that the process itself does not become the offender's punishment. It was sought, in the economic analysis of the law, the analytical ways to better equate the decisions rendered in the Chamber of Complementary Pension Appeals and the expectation of the defendants in relation to the regular course of the process.
