Since its entry into force on 1 July 2019, the Supplementary Protection Certificate (SPC) manufacturing waiver has continued to shape the regulatory and commercial landscape for generics and biosimilars in the European Union (EU). Introduced via Regulation (EU) 2019/933, the waiver aims to improve competitiveness of EU-based generics and biosimilar manufacturers, while still respecting the incentive framework underpinning SPCs. In this article, Beth Ormrod and Nick Bassil explore the manufacturing waiver’s practical implementation and the contrasting conclusions reached in national courts in relation to the notification requirements. https://lnkd.in/eYCVRFQD

In high value chemical areas where competition is rife, establishing a strong priority claim and carefully crafting the subsequent priority claiming application can be crucial to protecting a commercial chemical product. This key takeaways article follows a recent webinar where our experts Jessica Smart, Andrea Coles and Kathryn Bradley shared practical tips on how to draft a patent application to protect a chemical product in Europe. Pre-empting potential issues in this way allows the best chance of a European patent being granted with broad coverage and being robust enough to enforce and survive post-grant challenges. https://lnkd.in/e4AS_-SM
