Recent updates to the Federal Wetland Regulation could significantly impact permitting timelines, project siting, and regulatory strategies. Here are three critical developments from the US Army Corps of Engineers (USACE) reshaping the wetland regulatory landscape: 1. Fewer Waters Under Federal Jurisdiction The US Environmental Protection Agency (EPA) is developing the "CLEAR WOTUS" rule, which could potentially reduce the number of jurisdictional wetlands. Aligned with the Supreme Court’s Sackett v. EPA decision, the rule is set to be finalized by the end of 2025. Wetlands must now meet a two-part test: 💧Surface water presence during the “wet season” 💧Direct connection to a flowing waterbody This could streamline permitting in states lacking local wetland regulations, but may result in inconsistent applications across USACE districts. New “No Permit Required” Tool from USACE The USACE has launched a Regulatory Request System (RRS) module to help determine if a project requires a permit. Last Saturday, we volunteered at the 4th annual Branch G.I.R.L. Construction Experience event. Hosted at the Branch Group headquarters in Roanoke, VA, Girls In Real Life (G.I.R.L.) is a free event for girls aged 5-18, offering hands-on experience in STEM and construction topics. During the event, our professionals, James Patton, Erich Mills, Matt Sutphin, and Logan Seibert, demonstrated surveying techniques through activities such as "Pace Your Path" and "Guess the Distance," teaching participants how to estimate distances using simple tools and their own footsteps. These activities emphasized the importance of precision and estimation in surveying for building roads, skyscrapers, and more. It was fun inspiring future generations in STEM!
