The ICJ is a start in innovating global accountability for politicians and stakeholders. But it's blatantly obvious that it's an uphill struggle. As big regimes do not comply with internal law etc The United States' response to the ICC's pursuit of arrest warrants for Israeli leaders reflects its longstanding doctrine of selective engagement with international law. While not directly threatening judges, the U.S. mounted intense political pressure, with members of Congress explicitly threatening the Court with "severe sanctions" and Secretary Blinken collaborating on a bipartisan response. This mirrors its historical pattern: participating in international courts when advantageous, but defying them when core interests are challenged. This was starkly demonstrated in the 1980s when the U.S. ignored an ICJ ruling and vetoed enforcement after being found guilty of illegal acts against Nicaragua. This consistent approach—from Nicaragua to the ICC—reveals a policy of American exceptionalism, where international legal accountability is applied to others but not to itself or its closest allies.

1wThe ICJ’s judgments are binding and final (with no appeals) on parties involved in a dispute, but the Court has no enforcement mechanism; it relies on States’ willingness to comply and the UN Security Council for enforcement. The UNSC resolutions are typically vetoed by one or more members of the the P5 on important matters, and the U.S., Israel, Russia, and China have withdrawn or never accepted the ICJ’s compulsory jurisdiction. Despite these nations thinking that they are above international law, we must recognize the inherent lawfulness and humanity of the ICJ’s decisions.
