ORDER

In today’s arraignment, the defense counsel manifested that accused


Batman Bin y Superman is willing to plead guilty to a lesser offense of violation
of Section 12 of Republic Act (R.A.) No. 9165. The public prosecutor gave his
consent to the proposed plea bargain. Accordingly, the manifestation to allow
plea bargain was GRANTED.

When arraigned, accused Batman Bin y Superman, duly assisted by his


counsel-de-officio, voluntarily entered a plea of GUILTY consistent with the plea
bargain as granted.

WHEREFORE, considering the voluntary plea of guilty, accused Batman


Bin y Superman is found GUILTY of violation of Section 12 of R.A. 9165 and
hereby sentences him to suffer the straight penalty of two (2) years
imprisonment and to pay a fine of P10,000.00, without subsidiary
imprisonment in case of insolvency.

Also, pursuant to the Supreme Court Guidelines, accused Batman Bin y


Superman is directed to undergo a drug test. If found positive, he shall undergo
six (6) months rehabilitation. If negative, he shall undergo counselling program
for a period of six (6) months. Accused Batman Bin y Superman is directed to
submit himself for a drug test and submit the result thereof within five (5) days
from the drug test.

The manifestation of the defense counsel that he will file a petition for
probation in behalf of the accused is noted. Likewise, the motion of the defense
counsel to allow the temporary liberty of the accused under his present bond is
granted.

The drug specimen subject of this case shall be turned over to the
Philippine Drug Enforcement Agency (PDEA) for proper disposal in accordance
with the law.

SO ORDERED.
