Distinguish Nationality and Citizenship?

Nationality is simply the country where you came from, it can be inherited by both parents
whether u born from foreigner country but have a filipino parents you will obtain a filipino
nationality. Whereas citizenship is a legal status of an individual that has the right to live, right
to work, right to vote and pay taxes to a certain country, but even another nationality could still
hold citizenship of another country by grants of dual citizenship.
Enumerate and describe at least four (4) ways of acquiring citizenship.
By birth- this rule is determined by the place of birth of a child. If you were born with a filipino
parents in the Philippines, then you are a natural born filipino citizen.
Jus Sanguinis a latin term which means law of the blood this is determined through
bloodrelations.
Naturalization- Aliens or foreigners can become a filipino citizen through naturalization the
process of allowing a foreigner who lives from other country to become a citizen of another
country however they must renounce their original citizenship before they become a citizen of
the country.
Administrative naturalization applies to native born aliens who lived in the Philippines all their
lives, but they must have all the qualifications to become a filipino citizen.

Enumerate and describe at least four (4) voluntary and two (2) involuntary ways of
losing citizenship. 

Expatriation a process where leaving your country and living to a new one.

Naturalization in another country this will depends upon the law of the country their qualifications and
requirements.

Renunciation of citizenship first they must renounce their original citizenship before granted citizenship
of another country.

Subscribing to an oath of allegiance this means that you have to support the constitution and laws of a
foreign country.

Cancellation of certificate of naturalization by the court this means that the court can order the
cancellation due acts of unconstitutional that affects the country.

A deserter of the Philippine armed forces if you are a member of AFP and you are a deserter the
government can dismissed your citizenship due to insubordination.

Enumerate and describe at least three (3) ways of reacquiring lost Philippine
citizenship.

1. Repatriation recovery of original citizenship by making an allegiance to the republic of the


Philippines
2. Naturalization a process of it can be through administrative must have the following
qualifications in order to reacquired the citizenship of a country
3. Direct act of the congress this can be granted or/ applied to individual or aliens that have made
an outstanding contribution of the country.

Differentiate: Jus-Soli vs. Jus Sanguinis

Jus-Soli is a latin term means “Law of the soil” a rule that let the citizenship of a child
to be determined by the place of birth.

Jus Sanguinis is latin term means “law of the blood” a rule that let the citizenship be
determined by blood relation. An example of a filipino mother and alien since you are
blood related then you are a natural born filipino citizen

Enumerate and describe the kinds of citizens of the Philippines?

1. Those who are citizens of the Philippines at the of the adoption of this constitution
this means a citizen of PH without having to perform any act.
2. Natural born citizens if you are born with both filipino parents then you’ll
automatically a natural born filipino citizen of a country.
3. Citizens through election this means that people born before January 17, 1973 of
filipino mothers, who elect Philippine citizenship upon reaching the age of majority.
Ex. Paul’s mother married a foreigner was born an alien it will still remain an alien
unless he elects Philippine citizenship upon reaching the majority age.
4. Naturalized citizens foreigners or aliens can become a citizen of a the Philippines
through the process of naturalization it could be administrative, judicial and direct
act of the congress.

How statelessness is brought about? Describe extensively.


Stateless is impossible to prove when you are born from home and has no hospital records to
clarify your citizenship, but this will apply the jus sanguinis and be determined by blood. But if
you are an alien then you are born in a country without knowing your father’s or mother’s
nationality it is hard for you to apply for citizenship since it could be denied from the court due
to lack of papers to proved. On the other hand, Jus soli is not applicable to every country it
depends upon the laws of the country.
What is the citizenship of a Filipino woman who marries a foreigner? Provide
explanation to support your answer. 

The effects of marrying a foreigner is their citizenship will be retain unless they will renounce their
citizenship. A filipino will be granted a dual citizenship since he marries a foreigner and it will not affect
her citizenship or/loss under the 1987 constitution.

What is the citizenship of a foreign woman who marries a Filipino? Provide explanation
to support your answer.
A foreigner woman will not affect her citizenship by marrying a filipino, but she can apply for a
dual citizenship if they are living in the Philippines. It is a judicial naturalization whereas a
filipino can adopt a foreigner and have a legal papers to be presented to the court to proved
that they are married.
What is the citizenship of an alien woman married to an alien who is subsequently
naturalized in the Philippines? Provide explanation to support your answer. 
Their citizenship will be a filipino since they already apply for naturalization, however its up to
the court if they will grant a naturalization from the foreigners to be a filipino since there are
qualifications that will be needed to present and also they will renounce their original
citizenship before they become a filipino citizen of the country.
What is the citizenship of children of naturalized Filipino fathers? Qualify and
substantiate your answer.
A citizenship of a child of filipino father will be determined by “Jus Sanguinis” which means
blood relations. A child can acquire citizenship this rule.
What are the steps in the naturalization proceedings?
There are 3 ways of naturalization proceedings
1. Administrative Naturalization
2. Judicial Naturalization
3. Direct Act of the Congress
