The Philippines is a republic with a presidential form of government. Thus, the


power is equally divided among its three branches: executive, legislative, and judicial.
Each branch has a set of specific functions and responsibilities and their interactions are
governed by the principles of separation of powers and checks and balances.
The executive branch is often the most visible face of the government in our
everyday lives as citizens. The President and his officials are the “frontliners” in
addressing the many problems of our country.

As Filipino citizens, it is important for us to know and


understand the role of the executive branch for us to get
an idea on how national laws and agenda are applied to
our local communities. This will help us identify our roles in taking part in the
various programs of the government and in complying with the state policies.
As we are familiarized with the roles and powers of the executive branch, we
help ourselves determine effective and good governance which can serve as
our basis in making responsible decisions when choosing the leaders of our
country.

This module will help you gain a deeper understanding of the roles and
responsibilities of the executive branch of our government. It also gives discussions on
the powers vested in the executive branch, as well as the scope and limits of Presidential
authority. There are various guided and enrichment activities that will help you deepen
your knowledge and understanding of the key concepts and ideas that you will gain from
the module.

The problems brought about by the COVID-19 pandemic in the country


affected every Filipino. According to Article II, Sec. 4 of the 1987 Constitution, the prime
duty of the Government is to serve and protect the people. Thus, to address the challenges
brought by the pandemic, the government, led by our president enacted programs and
measures to help the people in these difficult times. During these times, we witnessed how the
executive department oversaw the formulation and execution of programs for the country and
the people.

The executive branch, which includes the President of the Republic, the Vice
President, the Cabinet, and related agencies and offices, is tasked with the execution of the
laws of the state, as well as creating and implementing government policies and programs.
The President, as the head of the executive branch and the highest official in the country, is
assisted by his Cabinet in ensuring that government policies and projects respond to the needs
of the citizens.
The President serves as both the head of the state and the head of the government. As
head of state, he or she is recognized as the representative of the country in international
affairs and is respected and recognized as a leader of the state. As head of the government,
the president takes on the main responsibilities of governance and perform several functions.

The President is tasked with the responsibility of leading the country and overseeing
the local government units. He also acts as the Commander-in-Chief of the Armed Forces of
the Philippines. In addition, the President is also tasked with the approval or rejection of the
bills legislated by the Congress. He is also responsible in the appointment of the Chief
Justices of the Supreme Court. Other tasks of the President provided by the law include the
approval and awarding of National Artists and National Scientists, and the inauguration of
businesses which may affect the local economy.

POWERS OF THE PRESIDENT

The President is also entitled to a large set of powers


outlined in the Constitution and in Executive Order No. 292 or the
Administrative Code of 1987. These includes:

of six years. But unlike the President, he/she may run for reelection once.
The Cabinet of the Philippines is another important part of the Executive Branch. It
is composed of executive departments that deal with the various aspects of governance and
address specific national issues. These various departments are headed by cabinet secretaries
who are appointed by the president, subject to the approval of the Congress. The number of
cabinet secretaries varies from time to time depending on the need of an administration.
According to the Administrative Code of 1987, the President of the Philippines may create or
dissolve any department as he sees fit.

The various powers of the President are subject to limitations prescribed by the
Constitution. For example, the President’s term is limited to six years, without any
reelection. Also, the other government branches ensure a system of checks and balances on
the powers and action of the executive branch. For instance, the President is mandated to
obtain consent from Congress before approving international treaties, granting pardons and
amnesties and appointing Cabinet Members and other officials. Although the President has
the power to declare Martial Law, the Constitution states that this must be
done only during extreme circumstances such as war or other threats to national
safety. The President may also be removed from office through impeachment when he is
found guilty of violation of the Constitution and high crimes such as bribery, treason, graft
and corruption.

PRRD gives gov’t agencies one week to send OFWs in MM back home

President Rodrigo Roa Duterte has ordered the Overseas Workers Welfare Administration
(OWWA), the Department of Labor and Employment and the Department of Health to ensure
that some 24,000 repatriated overseas Filipino workers (OFWs), who are currently awaiting
results of their RT-PCR tests for coronavirus disease 2019 (COVID-19), would be sent home
within the week.

Presidential Spokesperson Secretary Harry Roque Jr., on Monday, May 25, underscored the
President’s directive to fast-track the process of sending the repatriated OFWs to their home
provinces and to their families as soon as they test negative for COVID-19.

“Sang-ayon po sa Presidente, binibigyan nya ng awtoridad ang lahat ng mga opisyales ng


mga departamentong ito na gamitin po ang lahat ng resources ng ating gobyerno para
masiguradong makauwi ngayong linggo ang ating mga kababayan,” said Secretary Roque.

The Palace official added that if private or commercial buses, ships and airplanes would not
be enough to bring home the OFWs, the President has ordered the use of the ships and
airplanes of the Armed Forces of the Philippines for this purpose.
