THIS AGREEMENT OF LEASE made on this 25TH day of April, 2022, at Gurgaon.

J - 503, AWHO , Dara Enclave ,Near Shani Mandir, Sector -09 , Nerul East , : 400706,
Navi Mumbai, Thane , Maharashtra : 4400615(Hereinafter called the “LESSOR” which
expression shall include his legal heirs, legal representatives, successors and
assigns) of the ONE PART.

AND

Ms. Lincy Scaria, W/O Mr. Anish Rajan, R/O D-3/801, Uttamtown Scape, Near Serene
Hospital, Pratik Nagar, Pune City, Pune, Maharashtra : 411006. .(Hereinafter called the
“LESSEE”, which expression shall include his successors, executors, administrators
and assignees) as party of the OTHER PART.

WHEREAS:

I. The LESSOR is the absolute owner, seized and possessed of the residential property
being Coral Tower, Flat No - 1203, TDI Ourania, Sector - 53, Gurgaon , Haryana.
appurtenances thereto together with the fixtures and fittings described in the Schedule
hereto (hereinafter referred to as “the said property”);

III. The LESSEE requested the LESSOR to grant a lease of the said property.

IV. The LESSOR agreed to grant lease of the said property to the LESSEE.

V. The LESSOR and LESSEE are, therefore, desirous of formally recording their under-
standing, being these presents.

NOW THIS AGREEMENT WITNESSETH AS FOLLOWS:

A. Term of the Lease

The Lease will commence from 01ST May, 2022 and end on 31ST March, 2023 and will
be valid for 11 (Eleven) months. (Lock-in of SIX Months).

On expiry of the lease period, the lease can be renewed for another period of 11 (Eleven)
months. If either party does not wish to renew the lease for another period, it should be
communicated to the other party 1 (One) month prior to the completion of the lease.

B. Rent, Electricity and Maintenance Charges

LESSEE will pay to the LESSOR rent of Rs. 40,000/-, (Rupees Forty Thousand only/-)
Exclusive of maintenance charges as applicable per month in advance by the 10Th of
each English calendar month for which it becomes due and payable. Lessee will pay
Electricity, Gas and all other allied charges as applicable as per the Meter Reading at the
premises to the authorities concerned. LESSEE will pay maintenance charges directly
to the TDI Ourania Maintenance Authority. For any delayed payment of rent, LESSEE shall
pay Rs.1000/- per day in addition to the rent for entire delayed period. Rent (every month) is to
be deposited in the bank account number provided by the Lessor.

C. Advance Rent

The LESSEE will pay to the LESSOR advance rent of 30 days as on signing of this lease
agreement.

D. Security Deposit

The LESSEE will pay to the LESSOR an interest free refundable Security Deposit
equivalent to 2 (Two) month’s rent amounting to Rs 80,000/- ( Rupees Eighty Eight
Thousand Only) on signing of this lease agreement. This security deposit will be re-
funded at the time of termination of Lease.

The security amount to be deducted/adjusted for any dues, breakages, damage


which will be decided during the joint inspection prior to handing over the
possession of the property.

The security deposit amount will then be refunded one day after handing over the

property to LESSOR or his representative. (subject to the deductions agreed


upon).

Other Obligations of the LESSEE

1. To keep the interior of the said property and doors & windows thereof clean and in
good tenable order and condition. Normal wear and tear, damage by act of God,
storm, tempest, earthquake, civil commotion, war, air-raid, accidental fire not negli-
gently caused or irresistible force, will be accepted.

2. Not to make any permanent additions/alterations, changes or construction in the said


property without the prior permission of the LESSOR.

3. Not to assign, underlet, sublet or part with the possession of the said property or any
part thereof to any other person or firm.

4. To vacate and makeover vacant, quiet and peaceful possession of the said property to
the LESSOR on the expiry of the Lease without demur, reservation and/or protest.

5. To permit the LESSOR or her representative at all reasonable times to enter the said
property or any portion thereof for the purpose of inspection and repair on receiving
48 hours prior notice ( Prior Appointment) on behalf of the LESSOR.

6. In case of damage to the Fixtures and Fittings fixed in the said property, the LESSEE
shall be liable to compensate for the same, normal wear and tear excepted. The
charges for repair of these damages will be adjusted from the security deposit paid by
the LESSEE for the said property.

7. The ongoing minor electrical, mechanical, carpentry and plumbing replacements or


repairs will be carried out by the LESSEE at his own cost and expense. In case of
any major replacement or repair, the LESSEE will need to inform the LESSOR in
advance and carry on the same only after receiving the permission of the LESSOR.
Any cost sharing for major replacement or repair will have to be pre-agreed with the
LESSOR.

8. All minor day to day maintenance/repairs will be carried out/borne by LESSEE. Any
major maintenance/repairs will borne by LESSOR. (Except due to any misuse or
negligence).

9. That the LESSEE has assured the LESSOR that the premises will be used only for
residential purpose and no illegal or Unprofessional activity shall be done here. That
the lessee shall solely be responsible for any illegal or Unprofessional activity if found
operational then this Lease Deed stands terminated with immediate effect and entire
security amount will be forfeited in such event.

10. That after the expiry of 11 months i.e. 31ST March, 2023 the parties may agree by mutual
consent to extend the lease by executing a fresh lease agreement. In case of
extension of lease the rent shall be revised with 10% or with a mutually agreed
amount.

11. That the LESSOR has provided the following utilities at the time of handing over the
premises to the LESSEE; and the LESSEE shall be liable to replace/ bear the cost of

replacement of the said utility in case of breakage/ spoilage of any of the following
items mentioned in the Annexure.

12. In case of any dispute arising out of the lease agreement only Gurgaon Court will
have the Jurisdiction.

13. Maintenance Payment Copy to be shared with LESSOR every month after making
payment.

E. Termination

1. The LESSOR or the LESSEE as the case may be, at any time terminate the lease
by giving a notice to the other not less than 1 (one) month prior to such
termination. (After completion of Lock-in Period )

2. That If any breach is committed by the LESSE in making payment and in due
performance or observance of any of the provisions of this agreement, the
LESSOR shall be at liberty to terminate this lease by giving 30 days notice in
writing.

3. If Lessee is unable to Handover the property in case of non extension of


agreement then Lessee has to pay Rs.2000/- per day as penalty.

4. After termination of the lease, Deposit will be refunded within 24 hours after
inspection of the property and clearance from Society regarding all utility and
maintenance bills (Electricity, Internet, Piped Cooking Gas, Society Maintenance
etc.).
