ORDER:

The following Notification will be published in the Tamil Nadu Government


Gazette:-

NOTIFICATION

In exercise of the powers conferred by the proviso to Article 309, read with Article
313 of the Constitution of India and of all other powers hereunto enabling, the
Governor of Tamil Nadu hereby makes the following amendment to the Fundamental
Rules.

2. The amendment hereby made shall be deemed to have come into force on the 13th
November, 1987.

AMENDMENT

In the said Fundamental Rules, for rule 18, the following rule shall be substituted,
namely:-

“18.(1) Except leave on medical certificate or study leave under rule 84, no
Government servant (Permanent or Approved Probationer), who has not completed
five years of service, shall be granted leave of any kind for continuous period
exceeding six months at any one time.
(2) Except on medical certificate or study leave under rule 84 no Government
servant (Permanent or Approved Probationer), who has completed five years of
service, shall be granted leave of any kind for a continuous period exceeding one year
at any one time.

(3) When a Government servant (Permanent or approved Probationer) does


not resume duty after remaining, on leave for a continuous period of six months or
one year, as the case may be under sub-rules (1) and (2) or remain absent from duty
after the expiry of his leave otherwise than on foreign service or an account of
suspension, for any period which, together with the period of leave granted to him,
exceeds the limit, he shall, unless the Governor in view of the exceptional
circumstances of the case otherwise determines, be removed from service, following
the procedure laid down in the Tamil Nadu Civil Services (Classification, Control and
Appeal) Rules.

Provided that the period of absence which exceeds the limit of eligible leave shall be
treated as “non-duty” only in cases where exceptional circumstances exist that rule
out the possibility of relaxation of this rule or removal from service as provided
thereunder.

(4) There shall be an interval of a period of three years between two spells of the
maximum leave so granted.
