and lawful GENERAL ATTORNEY, for us, in our name and on our behalf to do
and cause to be done all or any of the following acts, deeds, things and matters
in respect of PROPERTY / RESIDENTIAL HOUSE NO. A/234, BLOCK “L”
SITUATED AT IN IMPROVEMENT SCHEME NO 02, NORTH NAZIMABAD,
KARACHI, (hereinafter referred to as the subject property / said property) was in
the name of Ghulam ahmed syed s/o syed mustafa having cnic no
Who died on DATED at Holland by virtue of Lease Deed Registered at
No. 8529, Pages 172 to 175, Volume No. 1659 of Book No. I-Addl. By the Sub
Registrar, Karachi on 17.8.1966, in favor of MR. GHULAM AHMED SYED
(LATE) S/o SYED MUSTAFA, holded CNIC No. 91208-0105586-9 who died in
Karachi, Pakistan on _____________.
1. To gain Mutation Certificate (By way of Inheritance) in his name only from
Karachi Development Authority and any other document from any other
Department i.e. Sub-Registrars, SBCA or any other department.
2. To possess, manage, control, supervise and look after the said PROPERTY
as per his sole discretion and to pay all taxes, cesses, dues, demands, fees,
charges, installments, outstanding liabilities, encumbrances etc. directly to
the concerned Departments, Authorities, Bodies, Parties, Tribunals,
Corporation and obtain receipts thereof for records.
3. To sell, Mortgage, Charge, encumber and transfer the said PROPERTY by
way of sale or otherwise dispose off in any manner whatsoever at such time
in such manner and for such consideration and to such person as our said
Attorney may in his sole, absolute and unfettered discretion, deem proper and
desirable and for the purpose aforesaid to execute the necessary Lease
Deed, Deeds, Instruments of Sale, Conveyance, Mortgage, Gift Declaration or
Oral Gift and transfer etc., to appear before any Registrar / Sub-Registrar, or
any other competent authority and to present such documents for
registration / transfer of the said PROPERTY, to admit the execution of the
same on my behalf and in my name, to receive sale consideration and to
acknowledge receipt thereof, to deliver the physical possession of the said
PROPERTY to the Vendee in all respects to effect mutation / transfer and
change of name in all the relevant records of the Government in favour of
the Vendee.
4. To sign, execute, submit or withdraw all sorts of applications, affidavits,
statements before the Authorities concerned and to file, institute, defend or
oppose all suits, petitions, Memorandum, Plaints, Complaints or Claims etc.,
in any Court of Law and to execute and sign all documents, including Sale
Deed, Transfer Deed, Declaration of Oral Gift (Gift Deed), Deed of
Rectification, Redemption Deed and/or any other deeds / documents, which
may be required for the purpose of signing and executing the same and get
the same registered and admit the executions of the same before the
competent Sub-Registrar or Authority.
5. To represent me in all matters and affairs relating to the said property before
the concerned authorities, Sub District & District Registration and any
Government Department, Authorities or Court or the Town Committee, Union
Committee, Union Council, Telephone Department, Gas Company, K-Electric
and any other concerned department / office of the builder, to make any
application, petition and representation before the aforesaid authorities, in
respect of any matter concerning; KDA Wing / KMC in the said property to
make payment, on my behalf and in my name and to lodge claim for refund of
any excess payment, made to any organization, to pay the dues, taxes, etc.,
pertaining to the said property to the Government Authorities concerned and
obtain proper receipts of the same, to represent me before the Income Tax
Authorities and Taxation Department or any other Authority concerned.
6. To let out the said property to any person(s) on any rent for any period, on
any terms as she may desire, think proper and to receive the amount of Rent,
Advance Rent, Security Deposit and give valid receipt for the same and sign,
execute the Rent Agreement and to appear before the Rent Controller,
Registrar, Sub-Registrar for verification, attestation or registration and to hand
over and to take back the physical possession of the said PROPERTY
from the tenant.
7. To file suit or suits or any other proceeding for proceedings against any
person, Firm, Corporation or any other body whatsoever in respect of the Said
PROPERTY, to compromise, compound or settle any action, claim, suit,
proceeding or withdraw any case without any effect/liability of the / to the
Executant and to appear and act in all court, civil, criminal, original or
appellate in the Registration Office and other Government office and semi
Government office and Departments and in any other office and to sign, verify
and file plaints written statements, petition, appeals, revisions and also
present himself in any court of law and appear on my behalf without any
effect / liability of / to the Executant.
7. To appoint and constitute any pleader, advocate, Sub-Attorney or Special
Attorney, whenever my said Attorney thinks proper to do so.
8. To obtain loan from H.B.F.C., or any other loan giving agency, to sign and
execute all receipts, deeds and documents as may be required by the House
Building Finance Corporation or any other loan giving agency to be
signed and executed, and purchase stamp paper or pay stamp duty and get
the same registered and to admit the execution and signature before the
competent Sub-Registrar or Authority.
9. To open and operate Bank Account in all respects, whether in credit or debit
and to draw, accept, endorsement, negotiate retire pay any bills of exchange
promissory notes, cheques, or other negotiable instruments which the
Attorney may deem necessary and proper and to repay the investment in
House Building Finance Corporation or any other loan giving agency, required
under the Deed of Assignment and Partnership to the corporation.
And generally to act in relation to the Said Land fully and effectually in
all respects as I myself could do, whereby declare that my said Attorney shall
have the power to appoint substitute or substitutes for himself and that
whatever my said Attorney for the time being acting under or by virtue of
these presents shall lawfully do or cause to be done as Imyself could have
done.
