1. COURSE DESCRIPTION:
The Labour Law 1 course covers Trade Union Law and the Employment
Contract. These two sub-themes include an overview of Labour law generally
and Uganda in particular; a historical introduction to trade unionism and trade
union law; an analysis of trade unions and trade union law in Uganda. A
coverage of employment contract including common law positions, statutory
modifications, terms and conditions of employment and termination/dismissal.

2. OBJECTIVES OF THE COURSE


Labour Law, I introduces major concepts in labour law and industrial relations;
outlines the historical origins in the UK and elsewhere of trade union law and
trade unionism and its influence on Ugandan trade union law; ensures students
are conversant with Uganda’s trade union structure and organization and union
relationship with the state stemming from the colonial times with focus on
colonial and post-colonial legislation; they are also introduced to international
trade union relations; covers major trade union law concepts under several
statutes and case law.

Part Two explores the contract of employment in both the private and public
sectors; the essential ingredients of a contract of employment vis-à-vis the
independent contractor; looks at terms and conditions of service and their
various sources; the forms of termination of the contract of employment
(including dismissal) and remedies available in the event of breach of the
contract, notably wrongful, unfair, and unlawful termination; and constructive
dismissals. On this component, focus will be had on judicial precedents from
the Industrial Court and the appellate courts particularly, the Court of Appeal
on topical issues arising from interpretation of the Employment Act, 2006. The
concept of economic dismissal arising from external pressures such as
pandemics (Covid -19 in recent past), market failures, re-organizations,

restructure and potential claims arising from the same are also explored.
Finally, the students shall be pointed to best practices and emerging
trends in comparable jurisdictions and the challenges they pose to the
employment contract and industrial relations.
