The SIOC Community Development Trust has made available funds to provide bursaries to students
residing in (Northern Cape and Limpopo). Accordingly, the Trust awards the Bursary to the Bursar
who accepts the award subject to the provisions contained hereinafter.
1. The Bursar:
1.1 undertakes:
1.1.1 to register for the full-time qualifying courses prescribed 2025 curriculum
requirements as per cover page.
1.1.2 to apply himself / herself diligently and conscientiously in pursuit of his / her
studies for the aforesaid qualification;
1.1.3 to observe and comply with all relevant and applicable regulations of the
Institution;
1.1.4 not to accept any other bursary, grant, loan or other form of financial
assistance without the prior written approval of the Trust;
1.1.5 to be obligated to serve in their communities as requested by the Trust during
school holidays and upon completion of their studies, failure to do so will lead
to suspension of the bursary;
1.1.6 to notify the Trust should their contact details change at any time during the
course of the year, and to submit academic records at the end of each exam
period failure to do so will result suspension of bursary.
1.1.7 to notify the Trust forthwith should he / she at any time cease be a South
African citizen or permanent resident in terms of the South African Citizenship
Act, No 88 of 1995;
1.1.8 to grant the Trust and service provider DUX (powered by People Dynamics)
the right to access his/her academic record for the institution;
2. The Bursary is granted for an initial period of one academic year (university) or one academic
semester (university of technology) and shall thereafter be renewable at the sole and absolute
discretion of the Trust.

3. The Trust;
3.1 Subject to 2 above and to compliance by the Bursar with the provisions of 1.1, the Trust
undertakes:
3.1.1 To pay to the Institution on the Bursar's behalf:
3.1.1.1 Registration and tuition fees for the year/semester of the curriculum for the
qualification specified in 1.1.1 to the extent that is accrued and outstanding;
3.1.1.2 The fee for accommodation (as per budget 2025 academic year) in a
students' residence administered by the Institution, provided that the Bursar
does not obtain accommodation in a students' residence, the student shall
enter into a lease agreement with a Private accommodation provider whereby
the Trust will pay the lessor directly on a quarterly basis.
3.1.2 to pay for the Bursar in quarterly instalments a stipend, as determined by the Trust in
its sole discretion, towards:
3.2.1 Meals, travel and Incidental personal expenses.
3.1.3 to pay directly to the institution (in cases study material is provided by the institution)
Protea or Van Schaik bookshops for purchase of the Bursar’s study material as per
invoices provided to the Trust.
4. If the Institution does not permit the Bursar to register for any qualifying course or courses of
study prescribed for the year/semester immediately succeeding the year/semester for which
the Bursary was awarded or renewed, as the case may be:
4.1 the Bursary shall be suspended and shall not be renewed for such succeeding
year/semester;
4.2 the Bursar shall at his / her own expense repeat whatever course of study he is
required by the Institution to repeat before it will permit him / her to register for all the
necessary qualifying courses prescribed for the succeeding year/semester of study.
4.3 in the event that the Bursar is made to repeat modules which are part of a course
covered in the Bursary but is allowed to proceed to the next study level of that course
this Bursary shall not cover the costs of repeating those modules.

5. If the Bursar repeats and successfully completes the courses of study referred to in 4.2 and
the Institution permits him / her to register for all the qualifying courses required to be
completed for the succeeding year/semester of study, he / she shall be entitled to apply to the
Trust for renewal of the Bursary and the Trust shall be entitled in its discretion to renew the
Bursary for such year on such terms and conditions as the Trust may deem fit.
6. The Trust shall be entitled to terminate the Bursary forthwith:
6.1 if the Bursar:
6.1.1 either ceases to pursue or repeats but fails to complete successfully the
courses of study referred to in 4.2 and does not register or is not permitted by
the Institution to register for all the qualifying courses required to complete the
succeeding year/semester of study; or
6.1.2 ceases to be a South African citizen or permanent resident in terms of 1.1.7;
6.1.3 fails to timeously submit change in contact details and academic record as
mentioned in section 1;
6.2 if the Trust is not satisfied with the Bursar's examination results or with any report
from the Institution authorities on the Bursar's progress and ethical conduct; or
6.3 if the Trust has good reason to believe that the Bursar intends to discontinue or to
interrupt the pursuit of his / her studies for the qualification referred to in 1.1.1.
6.4 is convicted of a criminal act.
6.5 if the bursar fails to attend 80% of the psycho-social support offered by the chosen
service provider DUX (powered by People Dynamics).
7. The parties agree in terms of Section 45(1) of the Magistrate's Court Act, No. 32 of 1994, that
any magistrate's court having jurisdiction over the person of the defendant shall have
jurisdiction to entertain any action or proceedings that may arise out of this agreement, even if
the amount claimed in such action or proceedings exceeds the ordinary jurisdiction of such
court, provided that notwithstanding such consent as aforesaid, either party may, if the
amount claimed exceeds the ordinary jurisdiction of the magistrate's court, institute any action
or proceedings in the relevant Supreme Court, in which event such party shall, if the action or
proceedings are successful, be entitled to recover costs on the Supreme Court scale.

8. The parties agree that, in the event of any amount being claimed from the Bursar by the Trust
in terms of this Agreement, a certificate signed by any one Director or Secretary of the Trust
(it shall not be necessary to prove the appointment, qualification of authority of the person
signing the certificate) as to the amount due and payable by the Bursar under clause 7 as the
case may be, of the Agreement shall be sufficient proof thereof to enable the Trust to obtain
summary judgement or judgement against the Bursar under this Agreement.
9. This Agreement constitutes the entire agreement between the parties and supersedes all prior
representations, negotiations, memoranda and agreements. No modification or alteration of
this Agreement shall be of any force or effect unless reduced to writing and signed by both
parties.
10. No act of relaxation, indulgence or grace on the part of the Trust shall in any way operate as
or be deemed to be a waiver by the Trust of any of its rights under this Agreement or a
novation thereof.
11. All letters sent under this Agreement shall be in writing and shall be deemed to have been
duly given or sent if despatched by prepaid registered post to or delivered at the address set
out below of the party for whom such communication or notice is intended and shall be
deemed to have been received by such party on the day of delivery or 10 days after posting,
as the case may be.
