AFFIDAVID OF ARREST

I, Andrei Pol J. Pestaño of legal age, bona fide member of the


Philippine National Police presently assigned at the Cabanatuan City Police
District, after having been duly sworn to in accordance with law, do hereby
state the following to wit, that:

1. I am among the members of Cabanatuan Police Station who is the


first responder/ Investigator on a follow-up operation located at JUGS COFFEE
SHOP BRGy CONCEPTION, Cabanatuan City, Nueva Ecija.

2. The said operation is stemmed from a radio/Intercom message of


SG SERGE PAROCHA requesting for Police Assistance for an alleged homicide
case noted by our Tactical Communication Officer.

3. On the call dated March 31, 2025, for an alleged homicide case.

4. Upon receiving the call, our office sends us to conduct an


investigation and follow up operation for the possible apprehension of the
suspect

5. Upon reaching the Area, the suspect was personaly identified


pointed by witnessed and Victim who was then in the area.

7. That on the arrest of the Suspect; we notified him of his rights Under
the Miranda Doctrine and immediately conducted the body search wherein
we recovered from his Possesion (1) 1 small kitchen knife with traces of
blood and herewith atttached as ANNEX D.

8. Suspect was brought to the Police Station of Cabanatuan City,


Nueva Ecija for booking and proper disposition. Likewise, the arrested person
was apprised for his rights as provided for under the Constitution of the
Philippines.
ANNEX C
9. I executed this affidavit to attest the truthfulness of the forgoing
facts and to support the filling of the Criminal Case against MR. DOUBLE XX
for violation of Article 249 of the Revised Penal Code of the Philippines
(ATTEMPTED HOMICIDE).
