Introduction
Transgender: A person whose gender identity differs from the sex that was
assigned at birth. A transgender male is someone with a male gender identity
and a female birth-assigned sex. A transgender female is someone with a
woman gender identity and a male birth-assigned sex. The South Asian
transgender people have another collective identity known as the “Hijra”
community. And it is assumed that they are the community, don’t get proper
rights in their own country.

Equal Employment Opportunity

One of the most essential aspects of recognizing the

rights of the third-gender community in Bangladesh is
providing equal employment opportunities. Gainful
employment is essential for personal independence and
financial stability. However, the third-gender community
often faces discrimination in the job market, leading to
high unemployment rates and poverty within their
community. Enacting politics that prohibit employment
discrimination and promoting affirmative action
measures can help rectify this injustice, allowing them to
fully participate in the workforce.
Access To Healthcare

Access to healthcare is a fundamental human right, and

it should be accessible to all without discrimination.
Unfortunately, the transgender community in
Bangladesh often encounters discrimination and
insensitivity within the healthcare system. This can
result in inadequate healthcare services and reluctance to
seek medical attention when needed. Ensuring that
healthcare providers are trained to treat all patients with
respect and sensitivity is crucial for the overall well-
being of the third-gender community.

Protection from Violence

• Protection from violence is a basic human right that every individual deserves. Regrettably, the third-
gender community in Bangladesh is particularly vulnerable to discrimination and violence. Hate
crimes, harassment, and physical violence are all too common, and perpetrators often act with
impunity. Implementing and enforcing laws that protect the third-gender community from
discrimination and violence is essential to creating a safer and more just society.

Counterargument

The government of Bangladesh declared

“Hijra” as the third gender in 2013 to
recognize the trans community. They were
brought under the government’s safety net
program and in 2019 they gained their voting
rights. To be more inclusive of the
community, the current finance minister of
Bangladesh, AHM Mustafa Kamal
proposed a special tax incentive for
companies that will ensure that 10% of their
hires are from the third-gender community
for the 2021-22 fiscal year budget.

All these initiatives have remarkably

increased the visibility of the community. Yet
the people from the community still face
systematic discrimination when availing
fundamental human rights as citizens, like the
right to education, health, or property .

Conclusion

Making different laws will not make any difference if

they aren’t properly useful for the trans community. As
there are many laws but the trans community still has to
suffer, we must say that the rights of the transgender
community are not being properly addressed in
Bangladesh.
