  ARE WOMEN SAFEIN INDIA? • Are women safe in India? The truth is that women are safe nowhere and they are safe everywhere. It does not depend on country. India is a democratic country which gives equal rights to men and women. India is one of "some" countries which has given equal freedom to its women in most of the aspects. • So what makes this country "unsafe" for women. It's the people and their mentality which makes this country unsafe. These kind of people are present all over the world which makes this world unsafe for people. • In our country it's our tradition to worship a female as Goddess . Then why are rapes, acid attacks, domestic abuse happening in such a high rate? • Main reason is patriarchy and politics merging in culture and religion is a reason. Delayed justice and ignorance of law is a reason.

  CURRENT SITUATION • Accordingto the 2018 report by Thomson Reuters Foundation, which comprised of 550 experts, says that India is the most dangerous country for women. • Even we beat war-torn countries like Afghanistan and Syria in terms of women safety. They ranked 2nd and 3rd respectively. This is really a very shameful achievement! And unfortunately, the Indian media never take such issues seriously. • The report says: finding India to be the most dangerous nation for sexual violence against women, as well as human trafficking for domestic work, forced labor, forced marriage and sexual slavery, among other reasons.

  • It wasalso the most dangerous country in the world for cultural traditions that impact women, the survey found, citing acid attacks, female genital mutilation, child marriage and physical abuse. India was the fourth most dangerous country for women in the same survey seven years ago. • And according to a CNN report, Around 100 sexual assaults are reported to police in India every day, according to the National Crime Records Bureau. There were nearly 39,000 alleged attacks in 2016, an increase of 12% from the previous year.

  • India isa country where rapes are not taken very seriously. No politicians are interested in ensuring women safety. They only want more and more restrictions on women. They have no idea why rapes happen, they only like to blame women for rapes. They still have narrow-minded and mediaeval thinking that rapes occur due to short clothes! They don't want women to be independent and want them to live under males. • The mindset of politicians actually reflects the mindset of our society. And the truth is, our society is very misogynist, racist, communal, tribalist, religious fanatic and pro-male supremacy

  LAWS AGAINST RAPEIN INDIA: • Section 376: Imprisonment for 10 to 20 years for Punishment for rape. • Section 376A: Imprisonment for life or for 20 years in Punishment for causing death or resulting in persistent vegetative state of victim. • Section 376B: 2 to 7 years imprisonment for Sexual intercourse by husband upon his wife during separation. • Section 376C: Rigorous imprisonment for 5 to 10 years for Sexual intercourse by person in authority.

  • Section 376D:Rigorous Imprisonment for 20 years to Imprisonment for Natural-Life + Fine paid to the victim in case of Gang rape. • Section 376E: Imprisonment for Natural-Life or Death for Punishment for repeat offenders. • Section 376AB: Rigorous Imprisonment for 20 years to Imprisonment for Natural-Life + Fine or Death in case of Person committing an offence of rape on a woman less than twelve years of age. • Section 376DA: imprisonment for life in cases of Gang rape of women under 16 years

  DOMESTIC ABUSE LAWSIN INDIA • Domestic violence” is defined under the Protection of Women against Domestic Violence Act, 2005 (‘DV Act) • Section 498-A of the Indian Penal Code covers dowry-related harassment. • Section 304-B: If a woman dies of "unnatural causes" within seven years of marriage and has been harassed for dowry before her death, the Courts will assume that it is a case of dowry death. Punishment: 7 years. • Section 306: when a woman commits suicide because of dowry-related harassment. Punishment: 7 years376-A: Marital Rape Punishment: Upto 4 years

  • The practiceof dowry itself is outlawed under the dowry prohibition act, 1961. Despite this, if dowry has been given to and taken by anyone other than the woman ( which is considered as her street dhan), she is entitled to that money/property as the case may be under this act. • Section 125 of ipc: a woman subject to domestic abuse does not have to necessarily file for a divorce to have a right to receive maintenance from her husband. She can simply file a petition. • The hindu succession act, after its 2005 amendment recognizes that women have an equal right in ancestral properties of their families: this is their legal right which is to get the same share as their brothers.

  LAWS AGAINST ACID ATTACKS •Section 326 A of IPC: Deals with acid attacks. Minimum punishment: 10 years of imprisonment which can extend up to life imprisonment with or without fine. • There is a separate law to punish offenders in extreme cases of acid attacks with amendment of law on sexual offences. • Sections 326A and 326B, of Amendment Act, 2013 inserted an additional clause under Section 100 which provided an exception from criminal liability by granting a right of private defense extending to cause death of a person who has committed an act of throwing or administering acid or an attempt to throw or administer acid. • It also proposed the insertion of Section 114B - Presumption as to Acid Attack in favour of the victim of acid attacks under Indian Evidence Act, 1972.

  LAWS AGAINST SEXUAL HARASSMENTAND EVE TEASING • There is no uniform law in India which can curb eve-teasing effectively. Many cases go unreported and some of them are ignored even after being reported. Consequences of not curbing such a menace, at times are disastrous. Complaints against eve teasing are registered under Section 294 or Section 509 IPC with punishment of 3 months or fine or both.

  • Stalking andits impacts on the Society : Stalking is a part of Eve teasing which is also under Indian Law has not looked as a serious issue. This crime has more pitiable condition than eve teasing. • Stalking can be described as repeated harassing or threatening behaviour by an individual. Like following, repeatedly calling, messaging, etc. • A Stalker according to law imprisoned for a period up to seven years as per Sexual Assault Prevention Bill proposed by the National Commission. • Section 294 of the Indian Penal Code (hereinafter referred as the IPC) says that “Whoever, to the annoyance of others- (a) does any obscene act in any public place.(b) sings, recites or utters any obscene song; ballad or words, in or near any public place, shall be punished with imprisonment. • .Section 509 of the IPC says, “Whoever intending to insult the modesty of any woman can be imprisoned for an year or more along with fine.

  CONCLUSION • News andnewspapers are all over covered with news of rapes, acid attacks, domestic abuse, women burnt alive and this list never ends. Still today in 21st century there are people who think women should sit at home and work for their husbands and live according to them. People are still jealous of a modern independent women. Though we have laws against these crimes but these laws cannot change the mentality of a women. Often a women rejecting man's proposal or those not working according to them are attacked with acid which is sold freely in market. A political figure or elite often considers women as his property and thinks he can do whatever he wants. So is this a problem of our country India or its laws. The answer is NO, laws in India are with its women, women in India do get their freedom but people ignore the laws, politics here stand bigger than law.

  • This isthe main reason becau6 of which most women never gets justice. When a crime is happened politician starts blaming other political parties, religions are being blamed, justice gets delayed or doesn't happens in case of elites public figures. We need to strengthen our judicial system and stop blaming our country. Though there are multiple of views on the issues of such a heinous crime, RAPE but still I feel that it should be much more analyzed to find its deep root causes and consequences and how to eradicate it from our country. Also I feel that Indian law should provide equal room to male harassment also and cases of Pseudo feminism are also increasing. • We the citizen of our country need to work on our mentality, perspectives and our judicial system. We need not to include politics or religions in a crime but we need to see a crime as a crime and a criminal as a criminal regardless of his religion or position.
