I was privileged to have facilitated a 1-day Interpersonal Communication Skills webinar for a large learner group of S.A managers on 23 October 2025, hosted by SA Labour Guide. Thanks to Vaden Shiplee Pietersen & Tshifhiwa Makungo and their fellow learners for being such an engaging, learning-receptive group, who were so transparent and generous with their experience and knowledge sharing - much appreciated. Throwing in the Towel in Tolerable Circumstances When resignation may only be the calm before the storm. Receiving an employee’s resignation may appear to signal the end of an employment relationship; however, this may only be the calm before the storm – a case later referred as a constructive dismissal. In a conventional dismissal, it is the employer who puts an end to the contract of employment by dismissing the employee. Conversely, in a constructive dismissal, it is the employee who terminates the employment relationship by resigning due to the conduct of the employer. The employee bears the onus of proving that resignation was not voluntary and that the employee never intended to terminate the employment relationship, showing instead that the employer made the relationship intolerable. The Courts have identified this enquiry to be whether the conduct of the employer rendered continued employment “intolerable” for the employee. The truth and a competent verdict – A fair dismissal for refusing to submit to truth verification testing Between 2020 and 2022, SAB’s Isando Depot suffered repeated robberies, resulting in stock losses of approximately ZAR 14.7 million. Despite upgrading its security features after each incident, the thefts continued, prompting suspicion that certain individuals with insider access were involved or had shared critical information with the perpetrators. Reinstatement, Back Pay, and Employer Obligations Mr Mavundla was dismissed by Gotcha Security Services on 6 March 2019. The CCMA reinstated him with effect from 1 August 2019, ordering payment of R52,200 for the period from dismissal to reinstatement. When Mavundla reported for duty on 1 August 2019, Gotcha Security refused to accept his services, citing a potential review application.
