Proposed rulemakings
Proposed regulation changes to 6 CCR 1007-2 Part 1.7.4.
The Remediation Program is proposing changes to Section 1.7.4 of the Regulations Pertaining to Solid Waste Sites and Facilities, 6 CCR 1007-2 Part 1. The proposed changes will take place over three phases starting January 1, 2026. The proposal increases the fee from $0.25 to $0.31 starting January 1, 2026 with a second increase to $0.38 starting July 1, 2026 and a third increase to $0.46 starting July 1, 2027.
We will hold two virtual stakeholder meetings:
- Meeting #1 - June 30, 2025 at 2:00 p.m.
- Meeting #2 - July 29, 2026 at 2:00 p.m.
- The meeting will provide Spanish interpretation (Se ofrecerá interpretación al español).

Proposed producer responsibility primary regulations
The Solid Waste and Materials Management Program is proposing changes to Section 18.9 of the Regulations Pertaining to Solid Waste Sites and Facilities, 6 CCR 1007-2 Part 1.
The Producer Responsibility Program for Statewide Recycling Act was signed into law in June 2022. By January 1, 2026 and each year thereafter, the Executive Director shall develop an eco-modulation bonus schedule that is designed to reduce producer responsibility dues of producers that meet certain benchmarks established by the Executive Director. The department is also required to establish rules for the administration, operation, and enforcement of the program.
The department held a series of stakeholder meetings to discuss the proposed changes and receive feedback. The recordings of those meetings are linked below.

The public comment period for the eco-modulation rulemaking session has ended. The public comment period was open for 45 days, from Thursday, August 14 to Sunday, September 28. The department will consider all public comments received before presenting the Solid and Hazardous Waste Commission with our proposed amendments on November 18.
Public comment can now be sent directly to the Solid & Hazardous Waste Commission at [email protected] on the proposed rule. The Commission strongly encourages comments be submitted by 11:59 p.m. on November 7th.
