COMMISSION DELEGATED REGULATION (EU) 2025/382
of 18 September 2024
amending Delegated Regulation (EU) 2018/273 as regards the certification of imported wine products and the import of wine originating in New Zealand
THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EU) No 1308/2013 of the European Parliament and of the Council of 17 December 2013 establishing a common organisation of the markets in agricultural products and repealing Council Regulations (EEC) No 922/72, (EEC) No 234/79, (EC) No 1037/2001 and (EC) No 1234/2007 (1), and in particular Article 89(a) and Article 147(3), first subparagraph, point (a), thereof,
Whereas:

Commission Delegated Regulation (EU) 2018/273 (2) supplements Regulation (EU) No 1308/2013 as regards the accompanying documents for release of imported wine products into free circulation in the Union. |

In accordance with Commission Delegated Regulation (EU) 2023/1606 (3), for imported wine products produced as from 8 December 2023, the list of ingredients is a compulsory particular that forms an integral part of the ‘description of the product’ in the accompanying documents referred to in Article 10 of Delegated Regulation (EU) 2018/273. Section A of Annex V to Delegated Regulation (EU) 2018/273 requires that the accompanying documents contain a description of the product. That requirement to include the list of ingredients applies to both wine transported in bulk and to labelled bottled wine products. Given that the list of ingredients is to appear on the individual packaging of labelled bottled wine products, it should not be necessary, for reasons of simplification, to require that this list be included in the accompanying document. Therefore, it is appropriate to amend the requirements regarding the description of the imported product set out in Annex VII to Delegated Regulation (EU) 2018/273 so that the list of ingredients is to be included in the accompanying documents only for imported wine products which are not bottled and labelled. |

According to Article 12(2) of Annex 9-E to the Free Trade Agreement between the European Union and New Zealand (4) (‘the Agreement’), wine produced in New Zealand can be imported into the Union with the simplified VI-1 document. |

In order to implement Article 12(2) of Annex 9-E to the Agreement, Delegated Regulation (EU) 2018/273 should be amended to include a provision allowing the use of the exemption laid down in Article 21, point (b), of that Delegated Regulation for the import of wines originating in New Zealand into the Union. |

Delegated Regulation (EU) 2018/273 should therefore be amended accordingly, |
HAS ADOPTED THIS REGULATION:

Amendments to Delegated Regulation (EU) 2018/273
Annex VII to Delegated Regulation (EU) 2018/273 is amended as follows:

Article 2
Entry into force
This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.
This Regulation shall be binding in its entirety and directly applicable in all Member States.
