COMMISSION IMPLEMENTING REGULATION (EU) 2025/339
of 19 February 2025
laying down rules for the implementation of Article 6a of Regulation (EU) 2020/2220 of the European Parliament and of the Council as regards monitoring and evaluation, presentation of the rural development programmes and the presentation of annual implementation reports
THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EU) 2020/2220 of the European Parliament and of the Council of 23 December 2020 laying down certain transitional provisions for support from the European Agricultural Fund for Rural Development (EAFRD) and from the European Agricultural Guarantee Fund (EAGF) in the years 2021 and 2022 and amending Regulations (EU) No 1305/2013, (EU) No 1306/2013 and (EU) No 1307/2013 as regards resources and application in the years 2021 and 2022 and Regulation (EU) No 1308/2013 as regards resources and the distribution of such support in respect of the years 2021 and 2022 (1), and in particular Article 6d(1), points (a), (b) and (c), thereof,
Whereas:

Article 6a of Regulation (EU) 2020/2220 introduced a new measure providing exceptional temporary support in response to the impact of natural disasters to be funded under the European Agricultural Fund for Rural Development (EAFRD) within the legal framework applicable in the programming period 2014-2020, as extended by that Regulation. |

Commission Implementing Regulation (EU) No 808/2014 (2) lays down rules for the application of Regulation (EU) No 1305/2013 of the European Parliament and of the Council (3) as regards the presentation, monitoring and reporting related to the rural development programmes and it is therefore to apply to the new measure. It is nevertheless necessary to lay down certain additional rules to ensure that the new measure is implemented uniformly within the applicable legal framework. |

For the new measure introduced by Article 6a of Regulation (EU) 2020/2220 to be implemented through the rural development programmes, a measure code and the appropriate output indicator for that new measure should be provided. |

To be able to benefit from the derogation from the non-regression principle as provided for in Article 1(2) of Regulation (EU) 2020/2220, Member States should submit the information about the total Union contribution reallocated to the relevant measure referred to in Article 18(1), point (b), of Regulation (EU) No 1305/2013. |

Given the urgency related to the impact of natural disasters, this Regulation should enter into force on the day of its publication in the Official Journal of the European Union. In view of the devasting effects of the current natural disasters and the urgency of addressing and mitigating their impact on the Union agri-food and forestry sectors, the Member States should have a possibility to start implementing the measure referred to in Article 6a of Regulation (EU) 2020/2220 as soon as the modifications introduced by Regulation (EU) 2024/3242 of the European Parliament and of the Council (4) enter into force. It is thus appropriate that this Implementing Regulation applies as of the date of publication of Regulation (EU) 2024/3242 in the Official Journal of the European Union. |

The measures provided for in this Regulation are in accordance with the opinion of the Rural Development Committee, |
HAS ADOPTED THIS REGULATION:
Article 1
For the purpose of the implementation of the measure referred to in Article 6a of Regulation (EU) 2020/2220, and in particular its inclusion in the rural development programmes for the EAFRD programming period 2014-2020, as extended by that Regulation, its measure and sub-measure code referred to in Part 5 of Annex I to Implementing Regulation (EU) No 808/2014 shall be 23 (M23).
Article 2
For the purpose of the implementation of the derogation referred to in Article 1(2) of Regulation (EU) 2020/2220, information on the total Union contribution reallocated to the measure referred to in Article 18(1), point (b), of Regulation (EU) No 1305/2013 shall be provided for in point (c) of the financing plan referred to in Part I, point 10, of Annex I to Implementing Regulation (EU) No 808/2014.
Article 3
For the purpose of the implementation of the measure referred to in Article 6a of Regulation (EU) 2020/2220, RD Output indicator O.4, as established in point 3 of Annex IV to Implementing Regulation (EU) No 808/2014, shall be used.
Article 4
The annual implementation report referred to in Article 50 of Regulation (EU) No 1303/2013 of the European Parliament and of the Council (5) and in Article 75 of Regulation (EU) No 1305/2013 shall also include a breakdown as referred to in Table C of Annex VII to Implementing Regulation (EU) No 808/2014 in relation to the measure referred to in Article 6a of Regulation (EU) 2020/2220.
Article 5
This Regulation shall enter into force on the day of its publication in the Official Journal of the European Union.
It shall apply from 23 December 2024.
This Regulation shall be binding in its entirety and directly applicable in all Member States.
