of 20 February 2025
laying down rules for the implementation of Article 6a of Regulation (EU) 2020/2220 of the European Parliament and of the Council as regards checks and penalties
THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EU) 2020/2220 of the European Parliament and of the Council of 23 December 2020 laying down certain transitional provisions for support from the European Agricultural Fund for Rural Development (EAFRD) and from the European Agricultural Guarantee Fund (EAGF) in the years 2021 and 2022 and amending Regulations (EU) No 1305/2013, (EU) No 1306/2013 and (EU) No 1307/2013 as regards resources and application in the years 2021 and 2022 and Regulation (EU) No 1308/2013 as regards resources and the distribution of such support in respect of the years 2021 and 2022 (1), and in particular Article 6d(1), point (d), thereof,

Article 6a of Regulation (EU) 2020/2220 introduced a new measure providing exceptional temporary support in response to the impact of natural disasters, to be funded under the European Agricultural Fund for Rural Development (EAFRD) within the legal framework applicable in the EAFRD programming period 2014-2020, as extended by that Regulation. |

Commission Implementing Regulation (EU) No 809/2014 (2) lays down rules for the application of Regulation (EU) No 1306/2013 of the European Parliament and of the Council (3) as regards the integrated administration and control system, rural development measures and cross compliance and it is therefore to apply to the new measure. It is nevertheless necessary to lay down certain additional rules to ensure that the new measure is implemented uniformly within the applicable legal framework. |

For the purpose of implementation of checks and penalties, the new measure referred to in Article 6a of Regulation (EU) 2020/2220 should be considered as non-area-related and non-animal-related rural development measure under Title IV of Implementing Regulation (EU) No 809/2014. |

Given the urgency related to the impact of natural disasters, this Regulation should enter into force on the day of its publication in the Official Journal of the European Union. In view of the devasting effects of the current natural disasters and the urgency of addressing and mitigating their impact on the Union agri-food and forestry sectors, the Member States should have a possibility to start implementing the measure referred to in Article 6a of Regulation (EU) 2020/2220 as soon as the modifications introduced by Regulation (EU) 2024/3242 of the European Parliament and of the Council (4) enter into force. It is thus appropriate that this Implementing Regulation applies as of the date of publication of Regulation (EU) 2024/3242 in the Official Journal of the European Union. |

The measure provided for in this Regulation is in accordance with the opinion of the Committee on the Agricultural Funds, |
HAS ADOPTED THIS REGULATION:
Article 1
For the purpose of the implementation of checks and penalties, the measure referred to in Article 6a of Regulation (EU) 2020/2220 shall be considered as non-area-related and non-animal-related rural development measure under Title IV of Implementing Regulation (EU) No 809/2014.
Article 2
This Regulation shall enter into force on the day of its publication in the Official Journal of the European Union.
It shall apply from 23 December 2024.
This Regulation shall be binding in its entirety and directly applicable in all Member States.
