Introduction: There is currently no binding, internationally accepted and successful approach to ensure global equitable access to healthcare during a pandemic. The aim of this ethical analysis is to bring into the discussion a legally regulated vaccine allocation as a possible strategy for equitable global access to vaccines. We focus our analysis on COVAX (COVID-19 Vaccines Global Access) and an existing EU regulation that, after adjustment, could promote global vaccine allocation. -/- Methods: The main documents discussing the two strategies are (...) examined with a qualitative content analysis. The ethical values reasonableness, openness and transparency, inclusiveness, responsiveness and accountability serve as categories for our ethical analysis. -/- Results: We observed that the decision-making processes in a legal solution to expand access to vaccines would be more transparent than in COVAX initiative, would be more inclusive, especially of nation states, and the values responsiveness and accountability could be easily incorporated in the development of a new regulation. -/- Discussion: A legal strategy that offers incentives to the pharmaceutical industry in return for global distribution of vaccines according to the Fair Priority Model is an innovative way to achieve global and equitable access to vaccines. However, in the long term, achieving the Sustainable Development Goals will require from all nations to work in solidarity to find durable solutions for global vaccine research and development. Interim solutions, such as our proposed legal strategy for equitable access to vaccines, and efforts to find long-term solutions must be advanced in parallel. (shrink)

This paper aims to analyze the ethical challenges in experimental drug use during the early stage of the COVID-19 pandemic, using Germany as a case study. In Germany uniform ethical guidelines were available early on nationwide, which was considered as desirable by other states to reduce uncertainties and convey a message of unity. The purpose of this ethical analysis is to assist the preparation of future guidelines on the use of medicines during public health emergencies. The use of hydroxychloroquine, remdesivir (...) and COVID-19 convalescent plasma in clinical settings was analyzed from the perspective of the ethical principles of beneficence, non-maleficence, justice and autonomy. We observed that drug safety and drug distribution during the pandemic affects all four ethical principles. We therefore recommend to establish ethical guidelines (i) to discuss experimental treatment options with patients from all population groups who are in urgent need, (ii) to facilitate the recording of patient reactions to drugs in off-label use, (iii) to expand inclusion criteria for clinical studies to avoid missing potentially negative effects on excluded groups, and (iv) to maintain sufficient access to repurposed drugs for patients with prior conditions. Although religious belief is often claimed to help with physical ailments including pain, it is unclear what psychological and neural mechanisms underlie the influence of religious belief on pain. By analogy to other top-down processes of pain modulation we hypothesized that religious belief helps believers reinterpret the emotional significance of pain, leading to emotional detachment from it. Recent findings on emotion regulation support a role for the right ventrolateral prefrontal cortex, a region also important for driving top-down pain inhibitory circuits. (...) Using functional magnetic resonance imaging in practicing Catholics and avowed atheists and agnostics during painful stimulation, here we show the existence of a context-dependent form of analgesia that was triggered by the presentation of an image with a religious content but not by the presentation of a non-religious image. As confirmed by behavioral data, contemplation of the religious image eneabled the religious group to detach themselves from the experience of pain. Critically, this context-dependent modulation of pain specifically engaged the right VLPFC, whereas group-specific preferential liking of one of the pictures was associated with activation in the ventral midbrain. We suggest that religious belief might provide a framework that allows individuals to engage known pain-regulatory brain processes. (shrink)

We assess the state of thinking about gender identities in computer vision through an analysis of how research papers in gender and facial recognition are designed, what claims they make about trans and non-binary people, what values they espouse, and what they describe as ongoing challenges for the field. In our corpus of 50 research papers, the seven papers that consider trans and non-binary identities use questionable assumptions about medicalization as a measure of transness, about gender transition as a linear (...) and bounded process, and about the concept of gender deception. Otherwise, non-normative gender identities are absent and their consideration is in fact hindered by prevailing research values, particularly deeply embedded ones such as performance and accuracy. We point out how the use of shared datasets calcifies binary conceptions of gender. In the way that the field of computer vision conceives of ongoing challenges for its research, it does not yet face questions that trans and non-binary user experiences pose and often falls back on biologically essentialist notions of sex classification. We make two recommendations: that computer vision researchers undertake interdisciplinary work with researchers who study gender as a socio-cultural phenomenon, and that journal editors and conference organizers do the same in peer review and conference acceptance processes. The paper focuses on the particular structure of the content of so-called generic memories, specifically of those of recurring events from one's past. This way of remembering has two central features that are in tension to each other: what is mentally represented is both rather specific as one is typically simulating a scene and sufficiently abstract as the represented scene stands for a series of similar former events. It will be argued that the phenomenon can be adequately described as a (...) mental state representing personal event prototypes. This description further allows to account for the dynamic process of remembering, in which, depending on the context, different forms of personal remembering may come to the fore. (shrink)

Occlusion is most commonly presented as an aspect of certain genres: occluded genres. Here, occlusion is proposed as a property of the processes by which genres are taken up. While routine use of genres creates expectations around when the genre’s uptake is commonly occluded, such expected practice can be subverted by deliberate disclosure. Occlusion and disclosure in the process of genre uptake thus become argumentative and powerful moves in communicative interaction. We advocate for the inclusion of Indigenous studies within first-year writing and academic English courses, particularly those taught to multilingual, international students. We argue that asking international students to learn about local and international Indigenous issues productively intersects with coursework in academic English. Our pedagogical approach emphasizes metalanguage and allows Indigenous studies and explicit language instruction to work in tandem, thereby recognizing the agency of Indigenous scholars and guiding non-Indigenous students in relation to it.

This article offers a way of using the theory of audience design—how speakers position different audience groups as main addressees, overhearers, or bystanders—for written discourse. It focuses on main addressees, that is, those audience members who are expected to participate in and respond to a speaker's utterances. The text samples are articles, letters, and editorials on women's suffrage that were published between 1909 and 1912 in Canadian periodicals. In particular, the author analyzes noun phrases with which suffrage-skeptical women are addressed, (...) relying on the theory of constitutive rhetoric to highlight the interpellative force with which the audience design of this public political debate operates. This article uses rhetorical genre theory to discuss methods for writing studies research in light of increasing participation of Indigenous scholars and students in disciplines throughout the academy. Like genres, research methods are embedded in systems of interaction that create subject positions and social relations. Using rhetorical genre theory to understand methods as the cultural tools of research communities, we argue that methods can be enacted as flexible resources in the interest of advancing ethical knowledge. Trans rights advocacy is a social justice movement that is transforming language practices relating to gender. Research has highlighted the fact that language which constructs gender as binary harms trans people, and some trans studies researchers have developed guidelines for honouring trans people’s names and pronouns. The language of academic writing is an area of discussion where questions of trans rights and trans experiences have not yet been addressed. This paper draws on two data sources to explore the citation experiences (...) and practices of trans scholars and activists: a web-based archive of writers’ perspectives built between 2015 and 2016; and a corpus-based study of 14 research articles published in TSQ: Transgender Studies Quarterly. Our analysis highlights the sensitivity that is required of colleagues who work with transgender authors’ writing, furthering our understanding of citation as a collaborative and potentially intimate and caring practice. Practices of referring to work by trans scholars pose ethical questions about the social relations expressed in citation in general, enabling applied language scholars to develop a new and different awareness of the sociality of citation. From 1909 onward, the Canadian suffrage debate was heavily influenced by reports on suffrage militancy from Great Britain and the United States. Militancy played an influential role in Canadian suffrage history not through its practice–there was no Canadian militant campaign–but through an ongoing discussion of its meaning. Using Anne Freadman's notions of genre and uptake, this paper analyzes the discursive uptake of suffrage militancy—from news reports on front pages, to commentary on women's pages, to reviews of Emmeline Pankhurst's Canadian speaking (...) engagements. The Canadian debate about militancy is a fertile site for drawing out the roles of genre and uptake in the political positioning of both suffragists and suffrage sceptics. Talk about militancy serves as a way to regulate the uptake of this particular genre of political action, whereby both sides tended to share the optimistic view that Canadian suffragists where not yet in need of militancy. Standardized academic English is now understood to be rooted in histories and practices that are colonial, classist, nationalist, heteronormative, ableist, and sexist. Current teaching of academic English carries an ethos of making practices of research writing accessible to students from marginalized backgrounds through explicit attention to language patterns and genre structures. In the context of both ideological critique and explicit pedagogy, I discuss three pragmatic elements of research writing—positionality, citation, and evaluation—with examples from one of my courses. I present these (...) elements and my approach to teaching them as a practice that is attentive to both details of published scholarship and students’ agency and intentionality in shaping their own writing projects, claims, and arguments. My work is framed by a functional approach to grammar where grammar is not interesting as a standardized apparatus but as a code that provides a range of options for producing performative effects. In the process of mentoring instructors of writing into the field of writing studies, there is a tension between practical surface of writing instruction and underlying theoretical depth. This paper calls for more systematic thinking about that tension between surface and depth. It emphasizes the important roles that metalanguage plays in mediating that tension and points out the indignities of contract employment that in many ways prevent writing instruction in Canada from becoming the deep and thoroughly researched practice it could (...) be. Artificial intelligence (AI) tools increasingly influence writing practices in educational contexts, yet writing studies expertise is too often sidelined in current discussions about writing in the context of generative AI. This paper presents core insights from rhetorical genre theory and genre-based pedagogy as a way to inform the teaching of research and writing in relation to generative AI tools. Our analysis focuses on three key concepts that are of central concern: intention, process, and trust. Attention to these concepts helps us (...) navigate between extreme hype and grave concern about generative AI tools and writing pedagogy. We draw on established theoretical frames and recent empirical research and highlight how longer-standing insights about intention, process, and trust relate to the teaching of research and writing in the presence of generative AI tools. This work contributes to ongoing conversations about the role of AI in writing pedagogy by foregrounding deep disciplinary expertise and recent empirical evidence. (shrink)

This essay focuses on the woman's page in the *Grain Growers' Guide,* edited between 1912 and 1917 by Francis Marion Beynon. I approach this material with questions that have become prominent in rhetorical studies of women's writing. How were women called forth to speak, and what were their motivations to participate in public debate? How did woman's page editors shape the conditions under which they themselves and other women could articulate their concerns? I show that suffragist editor Francis Marion Beynon (...) created situations in which she and other women could speak publicly and politically about issues such as women's suffrage. (shrink)

This article reviews recent government incursions on questions of free speech at universities and colleges in Ontario and Alberta and presents the challenge they pose to university autonomy. Inherent in university autonomy is the possibility—or the obligation—that universities make decisions based on ethical responsibilities that can extend beyond the limits of current law. As a case study of university autonomy in matters of expressive freedom, I highlight events at the University of British Columbia, which leads me to a discussion of (...) how questions of ethical responsibility have been raised particularly in relation to the speech protection of transgender members of the university. A central issue is the need for universities to adjudicate when free speech rights meet related responsibilities with which they can conflict. I detail how, for instance, the invitation of some anti-trans speakers can pose such a conflict and should lead university communities to consider adjusting their responses in extreme cases so as to be able to more autonomously regulate hateful speech beyond applicable law. Literary studies are often seen as a discipline without method. Research articles in literature do not have method sections, nor do they list what type of evidence has been included in a particular project or by what procedures primary material was analyzed. Because of implicitness of questions of method and research design, writing in literary studies is difficult to teach and often relies on students' abilities to infer their own strategies for reading and writing. I analyze a textual corpus of (...) recent research articles from Canadian Literature and Studies in Canadian Literature in order to clarify typical discursive patterns that are used when discussing methods of literary scholarship. On the basis of these findings, we can ask: How can teaching in literary studies be adjusted in order to demystify the methodological practices of the discipline? (shrink)

Während es in der Praktischen Philosophie und Angewandten Ethik ausführliche Debatten und Konzepte etwa zu den Fragen gibt, wie mit Problemen globaler Armut und Ungerechtigkeit umzugehen ist, welche Rechte und Pflichten Nationalstaaten angesichts zunehmender Flüchtlings- und Migrationsströme haben und welche Umweltschäden wir zukünftigen Generationen zumuten dürfen, bleiben einige andere innerstaatliche und naheliegende moralische Fragestellungen oftmals auf der Strecke: Welche moralischen Ansprüche haben sozial ausgegrenzte, ökonomisch benachteiligte und in Notlagen lebende Personen, die zu unserer Gesellschaft dazugehören? Mit den Problemen in der (...) Lebensgestaltung von Personengruppen wie Drogenabhängigen, Obdachlosen, Menschen mit Behinderungen und Arbeitslosen beauftragt der Sozialstaat – oftmals über subsidiär übertragene Kompetenzen – soziale Einrichtungen und ihre Sozialarbeiterinnen und Sozialarbeiter. Mit Blick auf diese „Dreieckskonstellation“ stellen sich zwei grundlegende ethische Fragen: Welche moralisch relevanten Gesichtspunkte bestimmen das Verhältnis von Sozialstaaten und gesellschaftlich ausgeschlossenen und benachteiligten Bürgerinnen und Bürgern bzw. – weiter gefasst – Bewohnerinnen und Bewohnern? Welche moralisch relevanten Gesichtspunkte sollten die Interaktion von Sozialarbeiterinnen und Sozialarbeitern mit ihren Klientinnen und Klienten in Beratungs- und Hilfskontexten bestimmen? Diesen basalen Fragen einer Ethik der Sozialen Arbeit wird, so unsere zentrale These, bisher von Seiten der Praktischen Philosophie noch zu wenig Aufmerksamkeit entgegengebracht. Diesem Zustand soll der vorliegende Themenschwerpunkt der Zeitschrift für Praktische Philosophie entgegenwirken, indem die darin enthaltenen Beiträge besonders auf die zweite Frage reagieren. Diese befassen sich insbesondere mit theoretischen und methodologischen Fragen einer Ethik der Sozialen Arbeit, etwa der Arbeitsteilung zwischen empirischen und normativen Ansätzen, der Funktion eines Rawls’schen weiten Überlegungsgleichgewichts und der Rolle und angemessenen Verständnisweise des Prinzips des Respekts vor Autonomie in der Praxis der Sozialen Arbeit. In this paper I will show that you can distinguish two main types of argumentation in respect to feeling and emotions in the philosophy of religion of William James, which point to two different kind of criticism of religion. Especially in his early works, James argues that you may lawfully adopt religious beliefs on the basis of passional grounds. This argumentation points to a type of criticism of religion, which denies that beliefs based on such emotional grounds may be justified. (...) In his famous study The Varieties of Religious Experience, James defines religious experience as an experience of inner conversion, where the individual gets in touch with a higher self. The philosophical interpretation of religious experience points not at least to a type of criticism of religion in the tradition of Ludwig Feuerbach, which is known as the theory of projection. Purpose This systematic review aims to identify factors that influence parents’ decisions regarding pediatric diagnostic and predictive genetic testing (DT/PT). Factors are integrated into a conceptual model of decision-making. Implications for genetic counseling, research, and ethics are derived. Methods PubMed, PsychInfo, WebofScience and references of related reviews were searched for original publications between 2000 and 2023. Extracted factors were categorized into an existing model. Results Of 5843 publications, 56 met inclusion criteria. The included studies differentiate between DT, traditional, and expanded (...) PT and describe factors impacting parental decisions on both to have the child genetically tested and to be informed about additional findings. Factors included: 1. benefits/hopes, 2. worries/concerns, 3. values and beliefs, 4. individual circumstances, and 5. emotional states. Conclusion Our work extends an existing empirical decision model of family decisions about genome sequencing to genetic testing in pediatrics in general, adding the categories “individual circumstances” and “emotional states”. The factors can be further integrated into the Health Belief Model; the importance of emotional states is reflected in dual-process theories, such as Fuzzy Trace Theory. Research is required on emotional states, differences between DT and PT, parents’ decisions about result disclosure, and dyadic variables as decision-making predictors. (shrink)

In ancient philosophy, there is no discipline called “logic” in the contemporary sense of “the study of formally valid arguments.” Rather, once a subfield of philosophy comes to be called “logic,” namely in Hellenistic philosophy, the field includes (among other things) epistemology, normative epistemology, philosophy of language, the theory of truth, and what we call logic today. This entry aims to examine ancient theorizing that makes contact with the contemporary conception. Thus, we will here emphasize the theories of the “syllogism” (...) in the Aristotelian and Stoic traditions. However, because the context in which these theories were developed and discussed were deeply epistemological in nature, we will also include references to the areas of epistemological theorizing that bear directly on theories of the syllogism, particularly concerning “demonstration.” Similarly, we will include literature that discusses the principles governing logic and the components that make up arguments, which are topics that might now fall under the headings of philosophy of logic or non-classical logic. This includes discussions of problems and paradoxes that connect to contemporary logic and which historically spurred developments of logical method. For example, there is great interest among ancient philosophers in the question of whether all statements have truth-values. Relevant themes here include future contingents, paradoxes of vagueness, and semantic paradoxes like the liar. We also include discussion of the paradoxes of the infinite for similar reasons, since solutions have introduced sophisticated tools of logical analysis and there are a range of related, modern philosophical concerns about the application of some logical principles in infinite domains. Our criterion excludes, however, many of the themes that Hellenistic philosophers consider part of logic, in particular, it excludes epistemology and metaphysical questions about truth. Ancient philosophers do not write treatises “On Logic,” where the topic would be what today counts as logic. Instead, arguments and theories that count as “logic” by our criterion are found in a wide range of texts. For the most part, our entry follows chronology, tracing ancient logic from its beginnings to Late Antiquity. However, some themes are discussed in several eras of ancient logic; ancient logicians engage closely with each other’s views. Accordingly, relevant publications address several authors and periods in conjunction. These contributions are listed in three thematic sections at the end of our entry. (shrink)

The objective of Working Group 4 of the COST Action NET4Age-Friendly is to examine existing policies, advocacy, and funding opportunities and to build up relations with policy makers and funding organisations. Also, to synthesize and improve existing knowledge and models to develop from effective business and evaluation models, as well as to guarantee quality and education, proper dissemination and ensure the future of the Action. The Working Group further aims to enable capacity building to improve interdisciplinary participation, to promote knowledge (...) exchange and to foster a cross-European interdisciplinary research capacity, to improve cooperation and co-creation with cross-sectors stakeholders and to introduce and educate students SHAFE implementation and sustainability. To enable the achievement of the objectives of Working Group 4, the Leader of the Working Group, the Chair and Vice-Chair, in close cooperation with the Science Communication Coordinator, developed a template to map the current state of SHAFE policies, funding opportunities and networking in the COST member countries of the Action. On invitation, the Working Group lead received contributions from 37 countries, in a total of 85 Action members. The contributions provide an overview of the diversity of SHAFE policies and opportunities in Europe and beyond. These were not edited or revised and are a result of the main areas of expertise and knowledge of the contributors; thus, gaps in areas or content are possible and these shall be further explored in the following works and reports of this WG. But this preliminary mapping is of huge importance to proceed with the WG activities. In the following chapters, an introduction on the need of SHAFE policies is presented, followed by a summary of the main approaches to be pursued for the next period of work. The deliverable finishes with the opportunities of capacity building, networking and funding that will be relevant to undertake within the frame of Working Group 4 and the total COST Action. In Slovenia, the collaborative economy is in the early stages of development. The collaborative economy became a popular topic in 2015 when the government intensified its efforts to initiate a debate on legal reforms that would better accommodate foreign collaborative economy companies in Slovenia. While in 2016, the government was actively working on the topic and eager to start the discussions on legal reform in line with the European agenda for the collaborative economy since 2018, the issue has lost its (...) momentum. After the Act Amending the Hospitality Act was adopted, the government has slowed down its efforts to create a regulatory framework conducive to the needs of the collaborative economy. Nevertheless, the practice is becoming more and more common, with several sharing initiatives surfacing in the past few years. Most collaborative economy services are not yet subject to taxation and regulation, one of the most pressing questions that will have to be answered in Slovenia is how to regulate and tax the collaborative economy. ABSTRACT: Contrary to much Kant interpretation, this article argues that Kant’s moral philosophy, including his account of charity, is irrelevant to justifying the state’s right to redistribute material resources to secure the rights of dependents (the poor, children, and the impaired). The article also rejects the popular view that Kant either does not or cannot justify anything remotely similar to the liberal welfare state. A closer look at Kant’s account of dependency relations in “The Doctrine of Right” reveals an argumentative (...) structure sufficient for a public institutional protection of dependents and evidence that Kant identifies concerns of economic justice as lying at the heart of the state’s legitimacy.RÉSUMÉ: Au contraire de ce qu’affirment bon nombre d’interpretations, le présent article soutient que la philosophie morale de Kant et ses explications sur la charité ne justifient pas adéquatement le droit de l’État à redistribuer les biens matériels afin de garantir les droits des citoyens non autonomes (les pauvres, les enfants, les handicapés). Cet article rejette aussi l’idée largement diffusée que Kant ne justifie pas ouest incapable de justifier quoi que ce soit s’approchant même vaguement d’un État providence de type libéral. Une lecture attentive aux explications sur les relations de dépendance que l’on trouve dans «La doctrine du droit» dévoile une structure argumentative à même de défendre une institution publique vouée à la protection des citoyens non autonomes et fournit des preuves à l’effet que Kant voit la question de la justice économique comme un élément central de la légitimité de l’État. Dans l’histoire de la métaphysique, l’époque initiée par Descartes se caractérise par le projet de tirer toute connaissance de son propre fonds. C’est ce que Kant a exprimé par la révolution copernicienne : les structures universelles des objets de l’expérience (temporalité, spatialité, grandeur, force, mathématisabilité, etc.) se règlent sur les structures a priori impliquées dans la constitution du sujet transcendantal (les facultés et leurs formes pures). Par là, toute l’ontologie de l’objet d’expérience possible trouve son fondement dans une présupposition transcendantale (...) : celle de la préconstitution invariante du sujet transcendantal, caractérisée par un système de facultés (sensibilité, imagination, entendement, raison) et de formes pures (intuitions, schèmes, concepts et Idées pures). N’est-il pas possible d’élaborer une philosophie transcendantale qui fasse l’économie d’un tel présupposé ? Tel est le projet que l’auteur voit dans la phénoménologie husserlienne : un dépassement de la révolution copernicienne, dont le but n’est nullement de restaurer une ontologie réaliste, mais d’élucider l’essence du sujet transcendantal sans en présupposer l’identité, ni les facultés invariantes. En voici le principe : toute catégorie d’objets prescrit au sujet transcendantal une structure régulatrice, de sorte que le système des facultés du sujet peut être réélaboré au fil conducteur des types d’objets possibles. Dès lors se présente un cercle apparemment insoluble : l’essence du sujet pur se lit à partir des catégories d’objets, mais ces mêmes objets sont constitués par l’activité synthétique du sujet. Or, comment peut-on admettre le paradoxe selon lequel le sujet serait le produit de ses produits ? (shrink)

Larousse La hausse des prix des carburants proposée pour lutter contre le changement climatique et mettre en œuvre les principes de la « transition écologique » adoptés par la France lors de la COP21, a fait naître le mouvement des gilets jaunes. Plus globalement c’est une bonne partie des français qui se trouve concernée, celle qui vit dans (...) des zones excentrées et qui ne bénéficie pas d'un réseau de transports très efficient tel celui qui émaille par exemple le territoire parisien. Ainsi, augmenter les prix des carburants, en particulier le diesel, a été perçu comme un contresens économique anti-populaire. Pendant des en, les producteurs d’automobiles, avec le support des politiques publiques, ont présenté le diesel comme le carburant le moins polluant. Mais aujourd’hui devenu le carburant « satanique », les consommateurs qui l’ont choisi, en toute bonne conscience, se sentent manipulés. La reconversion vers l’achat d’une voiture électrique est hors de la portée de la plupart de ceux qui aujourd’hui manifestent. Les aides du gouvernement ne changent pas cette réalité socioéconomique. Sous quel angle, les média ont-ils restitué le mouvement des gilets jaunes? Alors qu’on voit émerger au sein de ce mouvement des revendications pour plus de justice sociale, qu’en est-il de la justice environnementale? L'ensemble de l'œuvre de Platon est restée intacte jusqu'à ce jour, influençant de manière décisive la culture occidentale. Pour Platon, le dialogue est le seul outil capable de mettre en évidence le caractère de recherche de la philosophie, élément clé de sa pensée. Certes, l'écrit est plus précis et approfondi que le discours, mais le discours oral permet un échange de vues immédiat sur le sujet en discussion. Le principal protagoniste des dialogues est Socrate, à l'exception des derniers dialogues où (...) il se voit attribuer un rôle secondaire, disparaissant complètement dans Lois et Épinomis. Les dialogues platoniciens ont été regroupés par de nombreux commentateurs dans diverses classifications. Selon certains, un classement serait chronologique : les premiers dialogues seraient caractérisés par la forte influence de Socrate, ceux de la maturité dans lesquels il aurait développé la théorie des idées, et la dernière période dans laquelle il éprouvait le besoin de défendre son propre conception des attaques contre l'adresse de sa philosophie, réalisant une profonde autocritique de la théorie des Idées. -/- DOI: 10.13140/RG.2.2.10198.32327. Il s’agit d’un excellent examen des interactions génétiques / environnement sur le comportement et, en dépit d’être un peu daté, est une lecture facile et utile. Ils commencent par des études jumelles qui montrent l’impact écrasant de la génétique sur le comportement. Ils notent les études de plus en plus connues de Judith Harris qui étendent et résument les faits que l’environnement familial partagé n’a presque aucun effet sur le comportement et que les enfants adoptés grandissent pour être aussi différents (...) de leurs demi-frères et soeurs que les personnes choisies au hasard. Un point fondamental qu’ils (et presque tous ceux qui discutent de la génétique comportementale) ne parviennent pas à noter est que les centaines (des milliers selon votre point de vue) des universels comportementaux humains, y compris toutes les bases de nos personnalités, sont 100% déterminés par nos gènes, sans aucune variation dans les normales. Tout le monde voit un arbre comme un arbre et non une pierre, cherche et mange de la nourriture, se met en colère et jaloux, etc. Donc, ce dont ils parlent surtout ici, c’est de la quantité d’environnement (culture) qui peut influer sur la mesure dans laquelle les divers traits sont montrés, plutôt que leur apparence. Enfin, ils discutent de l’eugénisme de la manière politiquement correcte habituelle, à défaut de noter que nous et tous les organismes sommes les produits de l’eugénisme de la nature et que les tentatives de vaincre la sélection naturelle avec la médecine, l’agriculture, et la civilisation dans son ensemble, sont désastreuses pour toute société qui persiste à le faire. Jusqu’à 50% de toutes les conceptions, soit environ 100 millions par an, se terminent par un avortement spontané précoce, presque tous sans que la mère soit au courant. Cet abattage naturel de gènes défectueux stimule l’évolution, nous maintient relativement génétiquement sains et rend la société possible. Dysgenics est suffisant pour détruire la civilisation, mais la surpopulation sera do ild’abord. Pour la première fois en langue française, la traduction du Commentaire des huit livres des Physiques d'Aristote de Thomas d'Aquin, offre la quintessence de ce qu'on a appelé l' « aristotélo-thomisme ». Encore méconnue des spécialistes d'Aristote, l’œuvre constitue pourtant le sommet qui domine toute la tradition philosophique antique et médiévale. Traversant les aléas critiques du modernisme et du scientisme des trois derniers siècles, ce commentaire brille d'une actualité renouvelée grâce à l'évolution des sciences physiques et humaines les plus récentes, (...) avec lesquelles il est étonnamment en accord. Les Leçons sur la Nature (autre titre du livre) d'Aristote sont le porche d'entrée pour quiconque veut approfondir la philosophie et en vivre. Le métaphysicien reçoit d'elles le modèle méthodologique et l'assise conceptuelle pour sa contemplation ; le moraliste en hérite les principes d'une éthique rationnelle et sociale ; le théologien y puise les fondements naturels de sa discipline. En détachant le fonds philosophique de son apparat méthodologique, cette traduction met singulièrement l'un et l'autre en relief. La densité de réflexion se voit ainsi libérée des nombreuses coupures techniques, pour permettre une lecture ininterrompue, tandis que l'ordre de progression, dont Thomas d'Aquin avait un tel souci, est exhaussé pour lui-même. L'ensemble se veut donc autant une oeuvre de méditation qu'un instrument de travail. (shrink)

En examinant le rôle des discours et arguments scientifiques en droit, cette contribution explore comment les courants du droit naturel et du positivisme juridique y réagissent, et postule l’existence d’un dualisme ontologique qui persiste dans ces deux approches. Ce dualisme sépare le domaine des faits « objectifs » (incluant la « nature » et la « vérité scientifique ») du domaine des valeurs, du subjectif, de la politique et du droit. Dans cet espace dualiste, les discours scientifiques peuvent revendiquer une (...) neutralité et objectivité, parfois avec une dimension normative. En effet, le droit naturel prête à ces discours une dimension normative, tout comme le positivisme sociologique qui voit dans le fait social une source de normativité. En revanche, le positivisme juridique isole le droit « pur » des éléments externes et réaffirme la séparation entre faits et valeurs, mais renforce paradoxalement le caractère « indiscutable » des éléments extérieurs. Cet article conclut que le droit naturel et le positivisme juridique sont mal équipés pour contrer les arguments épistocratiques, et souligne la nécessité d’approches plus critiques et interdisciplinaires du droit.
